Effective immediately, the three large buses must be parked each night at
Rancho Palos Verdes City Hall. As you know, we can only have fourteen
(14) vehicles parked on our lot each night and they must be all small buses.
Once the Compton strike is settled, we may have First Transit adjust where
they park the excess buses each night. You can park at the RPV City hall
between 4:30 p.m. and 7:30 a.m.
Thanks for your assistance. Please remember to keep the noise level down in
the morning and don t start your vehicles prior to 6:00 a.m.

Your letter to the Honorable Jody Murdock, Mayor of Rolling Hills, was forwarded to us
for follow up and comment. We did try to reach you by phone several times. In lieu of
making personal contact, we trust you do not mind this written communication.
When the CUP was granted in 1996, the School District and the Transit Authority agreed
to expend a considerable amount of funding to ascertain that the vehicles would be
screened from the neighbors above the canyon. This was done by landscaping as well as
an environmentally sensitive fencing method. We furthermore agreed that the vehicles
would be parked in a manner that there would be no backing up and that noises would be
kept to a minimum during the morning hours.
Your comments addressed the last two items. It may be that we had lost a bit of our
vigilance in this area as there have not been any complaints until this, our fifth, year.
Or perhaps, with the fall start-up several of the newly hired drivers were not adequately
made aware of the extreme care that must be taken in not disturbing the neighbors above
the canyon.
Please be assured that appropriate steps have been taken immediately. Vehicles are NOT
to be backed up and our contractor has been put on notice that we expect their personnel
to be well aware of the fact that noises carry a long way during the early morning hours.
The contractor has further responded by having supervisor(s) present at that time. So has
PV Transit on a "spot check" basis. Meanwhile, we are exploring the possibility of
restriping and signing the parking spaces to eliminate any misunderstanding as to how the
vehicles are to be parked.
We trust that these steps will take care of any discomfort caused to you by PV Transit's
activities. It is apparent to us that the above reminders to these employees need to be
made on a repeated and ongoing basis. We do have a favor to ask from yourself: If there
is any further incident on any particular morning, would you please give us a call?
Timely notification may enable us to ascertain which driver/vehicle was involved so that
appropriate disciplinary action can be taken as appropriate.

Craig: I have tried several times to return your call while at PV yesterday. Since then 1
got word from PVUSD that a lady complained about the number of vehicles, I want to
assure you that we are not exceeding the limit spelled out in the CUP.
There may have been one or two days during the first days of the MTA strike that the
socalled "Buspool" vehicle was present. This is the vehicle that brings up several drivers
from our contractors yard (the car pooling, as requested) which was being picketed
During the first week of the strike by the MTA union and we did not want our drivers
exposed to that, The picketing ended when an injunction against secondary picketing was
issued and we were able to resume the normal carpooling.
A second item I want to bring to your attention even though flit may not have any impact
on the CUP situation: Two weeks ago the District moved our office out of the large
warehouse into a separate building next door. The reason being that they are upgrading
their purchasing function and needed that space. They moved us into the computer
technicians facility, the latter being moved back into the warehouse in a desire to
consolidate their operations into that one location, This may have changed the actual
square footage on our behalf but 1 would question if this change is material enough to
warrant changes in the CUP language.

We have enclosed a copy of the Conditional Use Permit relating to the PV Transit use of
this facility. It would be appreciated if you could make certain that all of your drivers
are operating within all of the parameters of the Conditional Use Permit, specifically,
Section G which requires that the vehicles shall be parked in a manner so as to prevent
and prohibit the backing up of vehicles.

Several years ago, the City of Rolling Hills passed a conditional use permit allowing
commercial vehicles used in the transportation of school children to park at the school
board maintenance yard off of Crest Road. A number of Rancho Palos Verdes residents,
including me, were at the town meeting to protest this plan. It was pointed out that there
are many other places on the "Hill" where these vehicles might park that would pose no
disturbance to residents. The plan was passed despite our concerns that the vehicles in
question would add to the already high noise volume generated by the school board
maintenance yard's activities. The fact that these vehicles would begin operation before
7am was also noted.
The City of Roiling Hills promised us that the commercial vehicles would be parked in
such a way that they would not be backing up in these early morning hours and that every
effort would be made to keep the noise generated by the maintenance yard to a minimum.
This promise has not been fulfilled. I have been awakened on countless mornings by the
arrival of the employees who drive these vehicles, the honking of horns andthe backup
beeps.
When the City of Rolling Hills chose to allow these vehicles to park at the school board
maintenance yard the city was assured that there would be "no significant detrimental
effect to the environment". I pointed out at that time that the men who said this
obviously did not sleep at 19 Coveview Drive. The school board maintenance yard itself
was once allowed to be placed in the middle of a residential neighborhood under a
"conditional use" permit which has become all too permanent . Through the years the
noise levels have increased. For those of us who live on Coveview Drive, it is
comparable to living over a large construction site that never ends and only grows in size
and scope. I love my home and when I bought this house many years ago I bought it with
the intention of growing old peacefully overlooking the beautiful Palos Verdes hills. The
school board maintenance yard has made this dream a nightmare every morning. I have
been as patient as I know how over these many years, bat my patience is now at an end.

I would appreciate your help in guaranteeing that the City of Rolling Hills lives up to its
promise to make sure that the vehicles do NOT back up in the morning, that the
employees NOT honk their horns or speak loudly, and that every effort is made to be
respectful of the fact that they conduct business in a residential neighborhood where
people may work late and need to sleep.
Thank you for any help that you might be able to extend to your bleary-eyed neighbors in
Rancho Palos Verdes.

RESOLUTION NO. 98-7
A RESOLUTION OF THE PLANNING COMIVISSION OF THE CITY
OF ROLLING HILLS GRANTING A CONDITIONAL USE PERMIT
FOR JOINT POWERS TRANSIT AUTHORITY LIMITED USES IN
ZONING CASE NO. 578.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by the Palos Verdes Peninsula
Unified School District with respect to real property at the . *31.14 acre western
portion of Lot 72-RH, and currently, 38 Crest Road. West, Rolling Hills, requesting to
reestablish and continue a Conditional Use Permit to permit portions of the Palos
Verdes Peninsula Unified School District Crest Road property that is used for a
maintenance and warehouse facility to continue to be used . by the Palos Verdes
Peninsula Transit Authority for administrative uses and thestorage parking of up
to 14 vans at the school district property.
Section 2. Prior City actions with respect to this property and this proposed
use include the following:
A. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The. Conditional Use
Permit expired . on February 26, 1964 and no new buildings were constructed.
B. On, June 5, 1964 a Conditional Use Permit was denied by the . Planning
Commission to permit the construction of an (1) administration building, (2)
elementary school building, and (3) district maintenance , building. The Planning
Commission found that the construction and location of . the proposed
administration building, maintenance building and garage would establish and
permit a commercial use. of the property that would consist of , a garage for the
storage of approximately thirty-seven (37) diesel school buses,, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for.. the repair and , maintenance ofschool property, all of
which uses will create noise, dirt and confusion from 6 AM in , the morning until
approximately 5 PM in the afternoon each day the facilities are in .operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.
C. On November 13, 1995, the Zoning Ordinance was amended to allow
joint powers transit authority uses as a conditionally permitted use in the RA-S-2

Zone. On November 17, 1995, a Conditional Use Permit to allow portions of school
district property to be used by the Palos Verdes Peninsula Transit Authority for
administrative uses and the storage parking only of 10 vans at the school district
property.
D. On June 18, 1996, the Planning Commission adopted Resolution No.
96-12 in Zoning Case No. 532A to extend a Conditional Use Permit for Transit
Authority uses for two years with reviews in December and March each year and
permitting storage parking for up to 14 vans. Conditions included the limitation
that eleven vans be operational at any given time, that the Transit Authority
encourage carpooling among drivers, where feasible, and that the transit service not
allow vehicles to start their engines prior to 6 AM.
Section 3. A Negative Declaration for the original project was prepared in
accordance with the California Environmental Quality Act and adopted by the
Planning Commission on June 18, 1996. The Planning Commission finds that the
project as presented by this application is within the scope of the previously adopted
Negative Declaration. The Planning Commission further finds that the project will
not have any new or substantially greater environmental impacts than considered
in the original Negative Declaration.
Section 4. The application applies to the ±31.14 acre western portion of Lot
72-RH. The General Plan Land Use designation for this property is Very Low Density
Residential 2+ Net Acres per Dwelling Unit.
Section 5. The subject site is presently occupied by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone
designation for the subject site is RA-S-2 and the zone designation on 'adjacent
properties is RA-S-2.
Section 6. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of up to 14
vans at the site. The site will continue to be used for the storage and maintenance of
school district vehicles and equipment. The school district proposes to permit a
joint powers transit authority to use 500 square feet of the northernmost portion of a
7,600 square foot warehouse for administrative uses and 3,500 square feet of an
existing asphalt paved area of school district property for the storage parking only of
up to 14 vans.
Section 7. The Planning Commission conducted a duly noticed public
hearing to consider the application on April 21, 1998. The . applicants were notified
of the public hearing in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal, from all persons
protesting the same, and from members of the City staff and the Planning

Commission having reviewed, analyzed and studied said proposal. Palos Verdes
Peninsula Unified School District and Palos Verdes Peninsula Transit Authority
representatives were in attendance at the hearing.
Section 9. Ordinance No. 256 was adopted by the City Council on
November 13, 1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of ,these, vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses- and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit . authority
administrative uses and the storage parking only of 14 vans will. comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a *31.14 acre parcel of property that is adequate in
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development
at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County. Hazardous Waste Management Plan relating to siting and siting
criteria for hazardous waste facilities because the project, though listed on the
current State of . California Hazardous Waste and Substances Sites List, will not
require any development at the site.

F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10. Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 578 to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to . the
conditions specified in Section 11.
Section 11. The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 578 to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
• Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit approval shall be subject to yearly staff
review from the effective date of approval until such time that it is suspended or
revoked.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval may be
suspended or revoked and ` the privileges granted thereunder shall lapse; provided
that the applicant has been given written notice to cease such violation, has failed to
do so for a period of thirty (30) days, and the City provides the applicant with a
hearing prior to such suspension or revocation.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

. G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
J. Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
included in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place- at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and, storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. • Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
Q. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

This message is a follow-up to our conversations yesterday regarding a complaint
from Ms. Christa Hawkins. I was at the bus yard from 5:38 a.m. until all buses left
the yard after 7:00 a.m. No buses were started prior to 6:00 a.m. and drivers did a
good job keeping noise levels down prior to 6:00 a.m. I reviewed the CUP
requirements again with the supervisor and drivers and will make periodic early
morning visits to ensure compliance.

Several years ago, the City of Rolling Hills passed a conditional use permit allowing
commercial vehicles used in the transportation of school children to park at the school
board maintenance yard off of Crest Road. A number of Rancho Palos Verdes residents,
including me, were at the town meeting to protest this plan. It was pointed out that there
are many other places on the "Hill" where these vehicles might park that would pose no
disturbance to residents. The plan was passed despite our concerns that the vehicles in
question would add to the already high noise volume generated by the school board
maintenance yard's activities. The fact that these vehicles would begin operation before
7am was also noted.
The City of Rolling Hills promised us that the commercial vehicles would be parked in
such a way that they would not be backing up in these early morning hours and that every
effort would be made to keep the noise generated by the maintenance yard to a minimum.
This promise has not been fulfilled. I have been awakened on countless mornings by the
arrival of the employees who drive these vehicles, the honking of horns and the backup
beeps.
When the City of Rolling Hills chose to allow these vehicles to park at the school board
maintenance yard the city was assured that there would be "no significant detrimental
effect to the environment". I pointed out at that time that the men who said this
obviously did not sleep at 19 Coveview Drive. The school board maintenance yard itself
was once allowed to be placed in the middle of a residential neighborhood under a
"conditional use" permit which has become all too permanent . Through the years the
noise levels have increased. For those of us who live on Coveview Drive, it is
comparable to living over a large construction site that never ends and only grows in size
and scope. I love my home and when I bought this house many years ago I bought it with
the intention of growing old peacefully overlooking the beautiful Palos Verdes hills. The
school board maintenance yard has made this dream a nightmare every morning. I have
been as patient as I know how over these many years, but my patience is now at an end.
I would appreciate your help in guaranteeing that the City of Rolling Hills lives up to its
promise to make sure that the vehicles do NOT back up in the morning, that the
employees NOT honk their horns or speak loudly, and that every effort is made to be
respectful of the fact that they conduct business in a residential neighborhood where
people may work late and need to sleep.
Thank you for any help that you might be able to extend to your bleary-eyed neighbors in
Rancho Palos Verdes.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS GRANTING A CONDITIONAL USE PERMIT
FOR JOINT POWERS TRANSIT AUTHORITY LIMITED USES IN
ZONING CASE NO. 578.
THE PLANNING COMIVIISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by the Palos Verdes Peninsula
Unified School District with respect to real property at the *31.14 acre western
portion of Lot 72-RH, and currently, 38 Crest Road. West, Rolling Hills, requesting to
reestablish and continue a Conditional Use Permit to permit portions of the Palos
Verdes Peninsula Unified School District Crest Road property that is used for a
maintenance and warehouse facility to continue to be used by the Palos Verdes
Peninsula Transit Authority for administrative uses and the storage parking of up
to 14 vans at the school district property.
Section 2. Prior City actions with respect to this property and this proposed
use include the following:
A. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
B. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit the construction of an (1) administration building, (2)
elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.
C. On November 13,1995, the Zoning Ordinance was amended to allow
joint powers transit authority uses as a conditionally permitted use in the RA-S-2

Zone. On November 17, 1995, a Conditional Use Permit to allow portions of school
district property to be used by the Palos Verdes Peninsula Transit Authority for
administrative uses and the storage parking only of 10 vans at the school district
property.
D. On June 18, 1996, the Planning Commission adopted Resolution No.
96-12 in Zoning Case No. 532A to extend a Conditional Use Permit for Transit
Authority uses for two years with reviews in December and March each year and
permitting storage parking for up to 14 vans. Conditions included the limitation
that eleven vans be operational at any given time, that the Transit Authority
encourage carpooling among drivers, where feasible, and that the transit service not
allow vehicles to start their engines prior to 6 AM.
Section 3. A Negative Declaration for the original project was prepared in
accordance with the California Environmental Quality Act and adopted by the
Planning Commission on June 18, 1996. The Planning Commission finds that the
project as presented by this application is within the scope of the previously adopted
Negative Declaration. The Planning Commission further finds that the project will
not have any new or substantially greater environmental impacts than considered
in the original Negative Declaration.
Section 4. The application applies to the t31.14 acre western portion of Lot
72-RH. The General Plan Land Use designation for this property is Very Low Density
Residential 2+ Net Acres per Dwelling Unit.
Section 5. The subject site is presently occupied by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone
designation for the subject site is RA-S-2 and the zone designation on adjacent
properties is RA-S-2.
Section 6. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of up to 14
vans at the site. The site will continue to be used for the storage and maintenance of
school district vehicles and equipment. The school district proposes to permit a
joint powers transit authority to use 500 square feet of the northernmost portion of a
7,600 square foot warehouse for administrative uses and 3,500 square feet of an
existing asphalt paved area of school district property for the storage parking only of
up to 14 vans.
Section 7. The Planning Commission conducted a duly noticed public
hearing to consider the application on April 21, 1998. The applicants were notified
of the public hearing in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal, from all persons
protesting the same, and from members of the City staff and the Planning

Commission having reviewed, analyzed and studied said proposal. Palos Verdes
Peninsula Unified School District and Palos Verdes Peninsula Transit Authority
representatives were in attendance at the hearing.
Section 9. Ordinance No. 256 was adopted by the City Council on
November 13, 1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of these vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious . in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit authority
administrative uses and the storage parking only of 14 vans will comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a ±31.14 acre parcel of property that is adequate in
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development
at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting
criteria for hazardous waste facilities because the project, though listed on the
current State of .California Hazardous Waste and Substances Sites List, will not
require any development at the site.

F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10. Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 578 to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to . the
conditions specified in Section 11.
Section 11. The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 578 to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit approval shall be subject to yearly staff
review from the effective date of approval until such time that it is suspended or
revoked.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval may be
suspended or revoked and the privileges granted thereunder shall lapse; provided
that the applicant has been given written notice to cease such violation, has failed to
do so for a period of thirty (30) days, and the City provides the applicant with a
hearing prior to such suspension or revocation.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
f . Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
induded in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place' at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. • Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
Q. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

First, peacocks are not an unauthorized animal in the City. Some residents cherish
peacocks and others do not want peacocks on their property. As a result, the Wildlife
Preservation Committee created the enclosed flyer which you might find helpful. If this

to visit your property and discuss this situation with you.

The Rolling Hills Wildlife Preservation Committee, with the cooperation of the
City Council, has compiled information on the behavior of peafowl that live on
the Palos Verdes Peninsula. Listed below are tips that will prompt or hinder
peafowl from visiting your property.
Hungry peafowl are attracted to
properties with vegetation they
like to eat. These plants and
flowers . include tomatoes,
broccoli, chives, brussel sprouts,
cabbage, cauliflower, kale,
impatiens, California poppies,
petunias, amaryllis, nasturtiums,
sweet alyssum, primrose,
begonias, kohlrabi, lettuce, young
spinach, and holly berries.
Peafowl are also attracted to
leftover pet food.
Peafowl tend not to visit
properties with dogs. Residents
who have dogs, and wish for
peafowl to visit their property,
may want to keep their dogs in an
enclosed area.
• Peafowl are attracted to wild bird
seed, bread, and pet food. If you do
not wish to invite peafowl to your
property, it is a good idea to feed
pets indoors, and remove any
leftover food immediately.
• Certain vegetation exists which
peafowl do not like. These include,
azaleas, camellias, bougainvillea,
ivy, roses, . jade, geraniums,
cactus, hibiscus, snapdragons,
bird of paradise, pink lady bush,
clivia, canvas, columbine,
coneflower, gladiolus, hostas,
marigolds, peonies, gaillardia,
hardy lavender, gardenias,
poinsettia, mums, painted daisy,
fuchsia, baby's breath, ferns,
lavender, mint, bee balm, blazing
star liatris, butterfly plant, giant
columbine, Shasta daisy,
plumbago, sunburst coreopsis,
gloriosa daisy, phlox, and weigela.

First, peacocks are not an unauthorized animal in the City. Some residents cherish
peacocks and others do not want peacocks on their property. As a result, the Wildlife
Preservation Committee created the endosed flyer which you might find helpful. If this
does not help you, please let me know and I will arrange for an Animal Control Officer
to visit your property and discuss this situation with you.
Second, regarding activities at Rancho Del Mar, I have forwarded a copy of your
correspondence to Palos Verdes Peninsula Unified School District Superintendent Ira
Toibin. I am certain that he can communicate your concerns regarding school facility
access and the use of the Rancho Del Mar fields for sports activities to the appropriate
parties. I have endosed a copy of my letter to him for your records.
Third, regarding your concerns over PV Transit, I have forwarded your correspondence
to PV Transit Administrator John Meyer. I trust that he will also respond to your
concerns.

The Rolling Hills Wildlife Preservation Committee, with the cooperation of the
City Council, has compiled information on the behavior of peafowl that live on
the Palos Verdes Peninsula. Listed below are tips that will prompt or hinder
peafowl from visiting your property.
- Hungry peafowl are attracted to
properties with vegetation they
like to eat. These plants and
flowers include tomatoes,
broccoli, chives, brussel sprouts,
cabbage, cauliflower, kale,
impatiens, California poppies,
petunias, amaryllis, nasturtiums,
sweet alyssum, primrose,
begonias, kohlrabi, lettuce, young
spinach, and holly berries.
Peafowl are also attracted to
leftover pet food. '
• Peafowl tend not to visit
properties with dogs. Residents
who have dogs, and wish for
peafowl to visit their property,
may want to keep their dogs in an
enclosed area.
• Peafowl are attracted to wild bird
seed, bread, and pet food. If you do
not wish to invite peafowl to your
property, it is a good idea to feed
pets indoors, and remove any
leftover food immediately.
Certain vegetation exists which
peafowl do not like. These include,
azaleas, camellias, bougainvillea,
ivy, roses, jade, geraniums,
cactus, hibiscus, snapdragons,
bird of paradise, pink lady bush,
clivia, canvas, columbine,
coneflower, gladiolus, hostas,
marigolds, peonies, gaillardia,
hardy lavender, gardenias,
poinsettia, mums, painted daisy,
fuchsia, baby's breath, ferns,
lavender, mint, bee balm, blazing
star liatris, butterfly plant, giant
columbine, Shasta daisy,
plumbago, sunburst coreopsis,
gloriosa daisy, phlox, and weigela.
• If you have a stable on your
property, keep it and the
surrounding area clean because
peafowl are attracted to the seeds,
bugs, and worms usually found
near manure. The same can be
said of composting. If you wish to
compost, use a covered compost
bin, and keep the composting
area clean.
• As was previously mentioned,
peafowl are afraid of dogs.

Thank you for your correspondence dated January 10, 1999. I hope my response assists
you with your concerns.
First, peacocks are not an unauthorized animal in the City. Some residents cherish
peacocks and others do not want peacocks on their property. As a result, the Wildlife
Preservation Committee created the enclosed flyer which you might find helpful. If this
does not help you, please let me know and I will arrange for an Animal Control Officer
to visit your property and discuss this situation with you.
Second, regarding activities at Rancho Del Mar, I have forwarded a copy of your
correspondence to Palos Verdes Peninsula Unified School District Superintendent Ira
Toibin. I am certain that he can communicate your concerns regarding school facility
access and the use of the Rancho Del Mar fields for sports activities to the appropriate
parties. I have enclosed a copy of my letter to him for your records.
Third, regarding your concerns over PV Transit, I have forwarded your correspondence
to PV Transit Administrator John Meyer. I trust that he will also respond to your
concerns.

the Palos Verdes Peninsula. Listed below are tips that will prompt or hinder
peafowl from visiting your property.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS GRANTING A CONDITIONAL USE PERMIT
FOR JOINT POWERS TRANSIT AUTHORITY LIMITED USES IN
ZONING CASE NO. 578.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by the Palos Verdes Peninsula
Unified School District with respect to real property at the *31.14 acre western
portion of Lot 72-RH, and currently, 38 Crest Road West, Rolling Hills, requesting to
reestablish and continue a Conditional Use Permit to permit portions of the Palos
Verdes Peninsula Unified School District Crest Road property that is used for a
maintenance and warehouse facility to continue to be used by the Palos Verdes
Peninsula Transit Authority for administrative uses and the storage parking of up
to 14 vans at the school district property.
Section 2. Prior City actions with respect to this property and this proposed
use include the following:
A. On February 26, 1963, a Conditional Use Permit was approved by the
Planning Commission for the following five structures to be constructed at the Palos
Verdes Peninsula Unified School District site: (1) administration building, (2)
education material and library facility building, (3) warehouse building, (4) district
maintenance building, and (5) an elementary school building, The Conditional Use
Permit expired on February 26, 1964 and no new buildings were constructed.
B. On, June 5, 1964 a Conditional Use Permit was denied by the Planning
Commission to permit, the construction of an (1) administration building, (2)
elementary school building, and (3) district maintenance building. The Planning
Commission found that the construction and location of the proposed
administration building, maintenance building and garage would establish and
permit a commercial use of the property that would consist of a garage for the
storage of approximately thirty-seven (37) diesel school buses, a facility for repairing,
maintaining and servicing the buses, a warehouse for the storage of school supplies
and a repair/workshop for the repair and maintenance of school property, all of
which uses will create noise, dirt and confusion from 6 AM in the morning until
approximately 5 PM in the afternoon each day the facilities are in operation, and
these uses would constitute a nuisance and depreciate the value of all property
adjoining the school property and interfere with the enjoyment of the residential
use of the adjacent properties by the residents and owners.
C. On November 13,1995, the Zoning Ordinance was amended to allow
joint powers transit authority uses as a conditionally permitted use in the RA-S-2

Zone. On November 17, 1995, a Conditional Use Permit to allow portions of school
district property to be used by the Palos Verdes Peninsula Transit Authority for
administrative uses and the storage parking only of 10 vans at the school district
property.
D. On June 18, 1996, the Planning Commission adopted Resolution No.
96-12 in Zoning Case No. 532A to extend a Conditional Use Permit for Transit
Authority uses for two years with reviews in December and March each year and
permitting storage parking for up to 14 vans. Conditions included the limitation
that eleven vans be operational at any given time, that the Transit Authority
encourage carpooling among drivers, where feasible, and that the transit service not
allow vehicles to start their engines prior to 6 AM.
Section 3. A Negative Declaration for the original project was prepared in
accordance with the California Environmental Quality Act and adopted by the
Planning Commission on June 18, 1996. The Planning Commission finds that the
project as presented by this application is within the scope of the previously adopted
Negative Declaration. The Planning Commission further finds that the project will
not have any new or substantially greater environmental impacts than considered
in the original Negative Declaration.
Section 4. The application applies to the ±31.14 acre western portion of Lot
72-RH. The General Plan Land Use designation for this property is Very Low Density
Residential 2+ Net Acres per Dwelling Unit.
Section 5. The subject site is presently occupied by 7 school buildings, a
maintenance building, a warehouse building, a computer/office equipment repair
building, a vehicle repair shop, and an administration building. The zone
designation for the subject site is RA-S-2 and the zone designation on adjacent
properties is RA-S-2.
Section 6. The project as proposed is to permit portions of school district
property used as a maintenance and warehouse facility to be used by a joint powers
transit authority for administrative uses and the storage parking only of up to 14
vans at the site. The site will continue to be used for the storage and maintenance of
school district vehicles and equipment. The school district proposes to permit a
joint powers transit authority to use 500 square feet of the northernmost portion of a
7,600 square foot warehouse for administrative uses and 3,500 square feet of an
existing asphalt paved area of school district property for the storage parking only of
up to 14 vans.
Section 7. The Planning Commission conducted a duly noticed public
hearing to consider the application on April 21, 1998. The applicants were notified
of the public hearing in writing by first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal, from all persons
protesting the same, and from members of the City staff and the Planning

Commission having reviewed, analyzed and studied said proposal. Palos Verdes
Peninsula Unified School District and Palos Verdes Peninsula Transit Authority
representatives were in attendance at the hearing.
Section 9. Ordinance No. 256 was adopted by the City Council on
November 13,1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of these vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit authority
administrative uses and the storage parking only of 14 vans will comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a t31.14 acre parcel of property that is adequate in
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development
at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting
criteria for hazardous waste facilities because the project, though listed on the
current State of .California Hazardous Waste and Substances Sites List, will not
require any development at the site.

F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10. Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 578 to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the
conditions specified in Section 11.
Section 11. The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 578 to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit approval shall be subject to yearly staff
review from the effective date of approval until such time that it is suspended or
revoked.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval may be
suspended or revoked and the privilegesgranted thereunder shall lapse; provided
that the applicant has been given written notice to cease such violation, has failed to
do so for a period of thirty (30) days, and the City provides the applicant with a
hearing prior to such suspension or revocation.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
J. Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
included in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
Q. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final and you

Commission having reviewed, analyzed and studied said proposal. Palos Verdes
Peninsula Unified School District and Palos Verdes Peninsula Transit Authority
representatives were in attendance at the hearing.
Section 9. Ordinance No. 256 was adopted by the City Council on
November 13, 1995 requiring a Conditional Use Permit for transit authority uses in
the RA-S-2 Zone. With respect to the request for a Conditional Use Permit for
transit authority administrative uses and the storage parking only of up to 14 vans,
the Planning Commission finds:
A. The granting of a Conditional Use Permit for administrative uses and
the storage parking only of 14 vans by a joint powers transit authority would be
consistent with the purposes and objectives of the Zoning Ordinance and General
Plan and will be desirable for the public convenience and welfare because the use is
consistent with similar school district uses on the property and these uses will be
located in an area of the property where such use will be the least intrusive to
surrounding properties. The transit vans will not use Rolling Hills' roads for access
in and out of the site. In addition, locating the vans at this location will reduce the
travel distances for use of these vans, thereby incrementally decreasing traffic, fuel
consumption and negative impacts to air quality.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the public transit authority administrative
uses and the storage parking only of 14 vans will not adversely affect or be
materially detrimental to adjacent residential uses because the existing residences
are at a sufficient distance away and adequately screened so as not to impact the
view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the public transit authority
administrative uses and the storage parking only of 14 vans will comply with the
low profile residential development pattern of the community, be consistent with
uses on that site, will be located on a t31.14 acre parcel of property that is adequate in
size, shape and topography to accommodate such use.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the public transit authority administrative
uses and the storage parking only of 14 vans will not require any new development
at the existing site.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting and siting
criteria for hazardous waste facilities because the project, though listed on the
current State of California Hazardous Waste and Substances Sites List, will not
require any development at the site.

F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the public transit authority administrative uses and the
storage parking only of 14 vans will not require any new development at the site
and access to the site will be located outside the gates of the City.
Section 10. Based upon the foregoing findings, the Planning Commission
approves the request for a Conditional Use Permit in Zoning Case No. 578 to allow
joint powers transit authority limited administrative uses and the storage parking
only of 14 vans at the Palos Verdes Peninsula Unified School District site, as shown
on the Development Plan dated August 8, 1995 and marked Exhibit A, subject to the
conditions specified in Section 11.
Section 11. The Planning Commission's approval of a Conditional Use
Permit in Zoning Case No. 578 to allow joint powers transit authority limited
administrative uses and the storage parking only of 14 vans at the Palos Verdes
Peninsula Unified School District site is subject to the following conditions:
A. The Conditional Use Permit approval shall be subject to yearly staff
review from the effective date of approval until such time that it is suspended or
revoked.
B. It is declared and made a condition of this Conditional Use Permit
approval, that if any conditions thereof are violated, this approval may be
suspended or revoked and the privileges granted thereunder shall lapse; provided
that the applicant has been given written notice to cease such violation, has failed to
do so for a period of thirty (30) days, and the City provides the applicant with a
hearing prior to such suspension or revocation.
C. All requirements of the Buildings and Construction Ordinance, the
Zoning Ordinance, and of the zone in which the subject property is located must be
complied with unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be maintained in substantial conformance with the site
plan on file dated August 8, 1995 and marked Exhibit A, except as otherwise
provided in these conditions.
E. Administrative office space shall be limited to 500 square feet of the
7,600 square foot warehouse building.
F. The 3,500 square foot storage parking area at the western portion of the
property designated for the 14 transit vans shall be striped and marked "For Van
Storage Parking Only" and shall be maintained as such until the use terminates. No
vans shall be parked on the site outside the 3,500 square foot parking area.

G. The vehicles shall be parked in such a manner so as to prevent and
prohibit the backing up of vehicles.
H. Vehicular access to and from the school district property shall be from
the driveway at the northwest portion of the property outside the gates of the City of
Rolling Hills.
I. Van engines shall not be started nor shall the vans depart from the
school district storage parking site before 6 AM.
J. Car pooling among drivers shall be encouraged where feasible.
Documentation of the fraction and number of drivers who are carpooling shall be
included in status reports as scheduled in Condition Q.
K. Maintenance of the 14 transit vans shall not take place at the school
district property but, at an off -site repair facility.
L. Existing service using 11 vans and storing 3 vans in reserve shall not
be increased.
M. Speed limit signs shall be maintained by the applicant on the internal
driveway of the site.
N. Landscaping shall be maintained to obscure the buildings and vehicles
on the site so that the structures, vehicles, driveway, and slopes are screened and
obscured from view at the northern property line with native drought -resistant
vegetation that is compatible with the surrounding vegetation of the community.
O. Noise on the site shall be limited to reasonable levels and monitored
using measurements, tests or other acoustical evaluation.
P. Any substantial modifications to the project which would constitute
additional development or significantly alter the use shall require the filing of a
new application for approval by the Planning Commission.
Q. The applicant shall execute an Affidavit of Acceptance of all conditions
of this Conditional Use Permit approval, or the approval shall not be effective.

17.54 APPEALS
17.54.010 Time for Filing Appeals
A. All actions of the Planning Commission authorized by this
Title may be appealed to the City Council. All appeals shall
be filed in writing with the City Clerk.
B. All appeals must be filed on or before the 30th calendar day
after adoption of the Planning Commission's resolution on
the project or application. Application fees shall be paid as
required by Section 1730.030 of this Title.
C. Within 30 days after the Planning Commission adopts a
resolution which approves or denies a development
application, the City Clerk shall place the resolution as a
report item on the City Council's agenda. The City Council
may, by an affirmative vote of three members, take
jurisdiction over the application. In the event the City
Council takes jurisdiction over the application, the Planning
Commission's decision will be stayed until the City Council
completes its proceedings in accordance with the provisions
of this Chapter.
17.54.020 Persons Authorized to File an Appeal
Any person, including the City Manager, may appeal a decision of
the Planning Commission to the City Council, in accordance with
the terms of this Chapter.
17.54.030 Form, Content, and Deficiencies in an Appeal Application
A. All appeals shall be filed in writing with the City Clerk on a
form or forms provided by the City Clerk. No appeal shall
be considered filed until the required appeal fee has been
received by the City Clerk.
B. The appeal application shall state, at a minimum, the name
and address of the appellant, the project and action being
appealed, and the reasons why the appellant believes that
the Planning Commission erred or abused its discretion, or
why the Planning Commission's decision is not support by
evidence in the record.

C. If the appeal application is found to be deficient, the City
Clerk shall deliver or mail (by certified mail), to the
appellant a notice specifying the reasons why the appeal is
deficient. The appellant shall correct the deficiency with an
amendment to the appeal form within seven calendar days of
receiving the deficiency notice. Otherwise, the appeal
application will be deemed withdrawn, and the appeal fee
will be returned to the applicant.
17.54.040 Request for Information
Upon receipt of a written and complete appeal application and fee,
the City Clerk shall direct the Planning Commission Secretary to
transmit to the City Council the complete record of the entire
proceeding before the Planning Commission.
17.54.050 Scheduling of Appeal Hearing
Upon receiving an appeal, the City Clerk shall set the appeal for a
hearing before the City Council to occur within 20 days of the filing
of the appeal. In the event that more than one appeal is filed for
the same project, the Clerk shall schedule all appeals to be beard
at the same time.
17.54.060 Proceedings
A. Noticing
The hearing shall be noticed as required by Section 17.30.030 of
this Title. In addition, the following parties shall be noticed:
1. The applicant of the proposal being appealed;
2. The appellant; and
3. Any person who provided oral testimony or written
comments to the Planning Commission during or as part of
the public hearing on the project.
B. Hearing
The City Council shall conduct a public hearing pursuant to the
provisions of Chapter 1734 of this Title. The Council shall
consider all information in the record, as well as additional
information presented at the appeal hearing, before taking action
on the appeal.

C. Action
The Council may act to uphold, overturn, or otherwise modify the
Planning Commission's original action on the proposal, or the
Council may remand the application back to the Planning
Commission for further review and direction. The Council shall
make findings to support its decision.
D. Finality of Decision
The action of the City Council to approve, conditionally approve, or
deny an application shall be final and conclusive.
E. Record of Proceedings
The decision of the City Council shall be set forth in full in a
resolution or ordinance. A copy of the decision shall be sent to the
applicant or the appellant.
17.54.070 Statute of. Limitations
Any action challenging a final administrative order or decision by
the City made as a result of a proceeding in which by law a hearing
is required to be given, evidence is required to be taken, and
discretion regarding a final and non -appealable determination of
facts is vested in the City of Rolling Hills, the City Council, or in
any of its Commissions, officers, or employees, must be filed within
the time limits set forth in the California Code of Civil Procedure,
Section 1094.6
