VARIANCE
VARIANCE
A variance is a form of permit which is required of any property owner who seeks to vary
from the provisions of the City's zoning ordinance in the development of property in the
City. In order to obtain a variance, the applicant must be able to demonstrate that
practical difficulties or unnecessary hardships result through the strict and literal
interpretation and enforcement of the zoning provisions. Variances are considered and
decided upon by the Planning Commission following a public hearing.
APPLICATION AND REQUEST FOR HEARING
In order to obtain a variance, a property owner or his or her agent must submit an appli-
cation and request a hearing before the Planning Commission. To do so, the applicant
should complete the requirements enumerated herein, assemble the necessary application
documents and call to make an appointment at (213) 377-1521. Making an appointment will
assurethat someone is available to explain the necessary procedures and review the case
material for completeness and .accuracy.
PLAN SUBMITTAL INFORMATION
Complete and submit for each application:
1. "Request.for Hearing" Application.,
2. Owner's Declaration

Seven (7) copies of plan MUST .accompany application.

3. Plan submittal using the "Checklist" as guide. Each plan must have computation of lot
coverage printed on the plot plan.
4. Ownership List: Prepare a complete list of names and mailing addresses of all property
owners of each parcel, within or partially within a 1,000 foot radius of the exterior
boundaries of the property under consideration, including the owner of the subject
property. Assign a number to each name on the list. This information must be as it
appears on the latest available assessment roll of the Los Angeles County Assessor.
This list shall be certified to be true and correct (complete Certified Property Owner's
Affidavit). An inaccurate or incomplete list is cause for removal of the case from
the agenda or to require a rehearing of the case.
Type Self -Adhesive Mailing Labels: In addition to the Ownership List required, submit
one complete set of typed self-adhesive mailing labels for all property owners listed
on the Ownership List.

REGULAR MEETINGS
1
Once an application has been accepted as complete by the City, a hearing will be set before
the Planning Commission. Applications are considered at the regular meetings of the Plan-
ning Commission, which are held the third Tuesday of each month. Applications must be
submitted to the Planning Commission Secretary no later than the last Monday of the month
immediately preceding the regular meeting at which the matter shall be considered. Provide
sufficient time in your plans to attend at least two meetings to allow the Planning Com-
mission to study the facts presented and to make a field trip review of the physical
conditions. The applicant or a representative must appear at the meeting.
AUTHORITY AND RESPONSIBILITY
In reviewing a request, the Planning Commission must consider the following:
1. The Planning Commission shall consider all matters presented to it fairly and impar
tially, recognizing the rights of the applicant as well as its obligation to enforce
all zoning ordinances and resolutions adopted by the City Council of the City of
Rolling Hills.
2. The development and use of all land within the City of Rolling Hills should be directed
to the continuation of the existing rural open areas surrounding the existing residences
in the City, and each new improvement or use of land should be carefully examined to
determine what effect the proposed improvement or use of land will have on the terrain,
trees and natural flora in the City.
3. The granting of variances shall be carefully scrutinized to protect bridle trails, .:.:.".
and provide the proper spacing of residences and accessory building so as to prevent
overconstruction of the lot or parcel to be improved.

CHECKLIST FOR PLAN SUBMITTAL
The following information must be included on any plan submitted for checking to the
Rolling Hills Planning Commission for:
a) Conditional Use Permit
b) Variance (including grading requirements)
Show the following:
1. Name and address of resident and name and address of architect and
Civil Engineer.
2. Vicinity map, scale 1:200 feet.
Requested improvements should be dimensioned to property line and
residences of all contiguous properties.
Easements should be shown and dimensioned on subject property and
all contiguous properties, on property line nearest improvement.
North arrow and scale of plans.
4. Existing contours of the entire lot.
5. Square footage of'pads in accordance with City Ordinance 188.
6. Computation of lot coverage in accordance with City Ordinance 188.
7.•. All slopes shall not be steeper in slope than two horizontal to one.

measurements.
13. Show a graded area of not less than 200 square feet for the construction
of a stable and a graded road of not more than 25% grade for vehicular

14. Sections should be shown through highest slope and through other areas.

LOT COVERAGE (Ordinance No. 188)
Main buildings, accessory buildings, structures, tennis courts, swimming pools,
service yards (enclosed or unenclosed), stables, or an area of not less than 200 square
feet for the construction of a stable (with vehicle access thereto) shall not cover
more than twenty (20%) percent of the netlot area; provided further that in addition
to the above described improvements, the areas included within driveways, parking
space, walks, patios, decks and asphalt or concrete paving of any kind excepting
roads maintained by the Rolling Hills Community Association, shall not cover more
than thirty-five (35%) percent of the net lot area. .
For the purposes of this Section 'net area' shall exclude all perimeter easements
to a maximum of ten feet and that portion of the lot or parcel of land which is used
for roadway purposes, and shall also exclude any private drive or driveway which pro-
vides ingress and egress to any other lot or parcel of land, and access strip portion
of any flag lot.

Criteria to be satisfied for grant of Variance
Such change is based upon the following described exceptional or extraordinary
circumstances or conditions that do not apply generally to other property in the
same vicinity and zone.
The barn placement, requiring a variance, is necessary due to the severity of slope
in the rear portion of the lot.. Placement of the barn on the rear of the lot would
require an excessive amount of grading, severely altering the existing lot conditions.
Such change will not be materially detrimental to the public welfare nor injurious to
the property or improvements in such vicinity and zone where property.is located because•
The change will not be detrimental because the structure has been designed to coordinate
with the architecture of the surrounding buildings and, due to the eauestrian nature of
the area, it is not unexpected for one to view an attractive accessory buildina from
the street.

Chairman Roberts opened discussion of a request by Mr. and
!Mrs. William Martin for a Variance for construction of a stable
in the front yard of Lot 20-RH, located at 17 Caballeros Road..
Commissioner Lay said he wished to abstain from voting on the
request, since he lives immediately adjacent to the applicant,
and his property will be impacted by the stable if the request
is approved and a Variance is granted. Commissioner Lay was excused
and was seated in the audience.
The plot plan was displayed and the Manager explained that
there are two requests before the Commission; a request for
encroachment into the established front yard for construction
.of a.s'table which would be located between the existing residence
and the road easement, and construction of a retaining wall within
the required front yard setback. Mr. David Breiholz, engineer,
advised the Commission that his firm had been retained by the
applicant to construct a stable in an area that was graded illegally
by a previous owner of the property, and an effort was made to
limit the length and width of the structure.
Commissioner Hankins noted that the proposed stable will
be closer to the residence on adjacent property than to the
residence on the applicants' property, and asked whether it was
a problem. The Manager explained that the proposed stable as
shown is in compliance with requirements of the City's Zoning
Ordinance and State Health Department restrictions with regard
to proximity to living quarters.
Mr. Allen Lay, 19 Caballeros Road, addressed the Commission
and explained that he is the owner of property adjacent to the
Martin property, and because of the steep grade of the street,
his home is located about 150 feet directly below the proposed
location, and the stable in the proposed location will have an
impact on the entrance to the Lay property. Mr. Lay said that
if the stable and surrounding area were not properly maintained
there would be a negative impact on Caballeros Road and on the
entrance to his residence. Additionally, he said his property
will be impacted by dust and odor emanating from the area due
to natural air drainage of the slope, and the situation could
have an extremely serious impact if the stable and corral areas
were not properly maintained. In spite of his concerns, Mr. Lay
said he supports the Martins right to develop a stable on their
property, and would support the Commission's approval of a variance
request. To minimize the concerns expressed, he asked that the
Planning Commission consider including the following conditions
in the approval of the variance if it is granted:
1. That sufficient screening plant materials be maintained
on the street side of the stable area to break up the
outline and substantially obscure the stable from viewers
coming down Caballeros Road.
2. That a dense line of screening material such as oleanders
or myoporum or other densely growing material be required
to be planted below the stable and corral areas in the
vicinity of the property easement line in order to partially
contain the dust and thereby mitigate the impact on the
properties located below the proposed stable.
3. That wording be added to the variance to the effect that
due to the stable being located adjacent to Caballeros Road
and above the residences of adjacent property, that proper
maintenance is especially important and failure to adequately
maintain the stable area and required landscaping would result
in the variance being rescinded.

Mr. Lay said he has discussed the items with Mr. Martin,
who has indicated his willingness to comply with the request.
Further, Mr. Lay said that he is not concerned about the maintenance
'issues so long as Mr. and Mrs. William Martin retain ownership
of the property, but would appreciate the inclusion of the wording
concerning maintenance in the record because if the stable and
associated landscaping were not •maintained by future owners it
could seriously impact the appearance of the street and the
properties below. Mr. Breiholz said the requests is reasonable,
and he would ask that the same conditions be required if he were
a neighbor. Chairman Roberts closed the public hearing.
Commissioner Bundy moved that the request for construction
of a stable and retaining wall in the front yard of Lot 20-RH
owned by Mr. and Mrs. William Martin, 17 Caballeros Road, be
approved subject to conditions requested in a letter dated October
17, 1986 from Allen Lay, 19 Caballeros Road, as entered into the
record. The motion was seconded by Commissioner Hankins and carried
by the following roll call vote:

THE ROLLING HILLS MUNICIPAL CODE :.
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Title 17, Chapter 17.32.of the Rolling
Hills Municipal Code is amended by adding a new Section 17.32.087.
thereto to read:
17.32.087. Affidavit . of Acceptance.
No conditional use permit or variance shall be
.effective for any purpose until the applicant•executes
'an affidavit provided 'by the •City declaring that the
applicant is aware. of and accepts the.. conditions • that
have been imposed upon the -permit or variance. Each
conditional use permit and variance granted shall
contain a condiiton to this effect.. The executed
affidavit shall be recorded with the County Recorder.
