333, Construct Barn within the fron, Resolutions & Approval Conditions• • BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS'ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) of ) Mr. & Mrs. William Martin ) Lot 20-RH ) ZONING CASE NO. 333 FINDINGS AND REPORT The application of Mr. & Mrs. William Martin, Lot 20-RH, Rolling Hills Tract, for a Variance under Section 17.32.010 of the City of Rolling Hills Municipal Code, came for hearing on the 16th day of September 1986 and the 21st day of October 1986 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California. The Planning Commission, after being appropriately advised by staff and hearing public testimony; now makes its Findings and Report as required by the Municipal Code of the City of Rolling Hills, California. I. The Commission finds that the applicants, Mr. & Mrs. William Martin, are the owners of that certain real property described as Lot 20-RH, located at 17 Caballeros Road in the City of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Section 17.32.080 of the Municipal Code of the City of Rolling Hills, California. The Commission finds, further, that no comment, written or verbal, was received in opposition to the request. However, verbal and written comment from Mr. Alan Lay, 19 Caballeros Road, was received which conditionally supported the application. Further, the Commission made an on -site, field investigation, on October 4, 1986. II. The Commission finds that the applicants have requested a Variance from Sections 17.08.260 and 17.08.270 yard and front yard requirements and Section 17.16.060 minimum front yard setback requirements. The applicants have requested an encroachment of 76 feet into the established front yard of 126 feet, which would leave a remaining front yard of 50 ft. The applicants have requested a 21 foot encroachment into the minimum front yard setback of 50 feet • • which would leave a 29 foot front yard setback. The applicants have requested said encroachment varriance in order to build a stable and corral area, including retaining walls. The applicants indicate that due to extreme topographical gradients on their property, the excessive grading which would be required to allow for building a stable in other locations of the property, could be detrimental to the environmentment. Therefore, the applicants request the granting of the Variance so that they may have the same rights to property as others in the same vicinity and zone, which would otherwise be denied if they be denied if they were not able to fully utilize the existing graded corral area. The Commission finds that there are extraordinary topograph- ical and physical conditions which exist on the property which do not apply to other properties in the vicinity and zone, which im- pinge upon the applicant's ability to fully utilize his property, without damaging the environment. The Commission finds that a Variance should be granted in order to preserve substantial property rights in the same vicinity and zone, and that the granting of such Variance would not be materially detrimental to the public welfare, not injurious to property in the same vicinity and zone. III. From the foregoing, it is concluded that a Variance should be granted to Mr. & Mrs. William Martin, Lot 20-RH, 17 Caballeros Road under Section 17.32.010 of the City of Rolling Hills Municipal Code for a Variance from Sections 17.08.260 and 17.08.270, yard and front yard requirements, and Section 17.16.060 minimum front yard require- ments subject to the following conditions: 1) Encroachment into the established front yard shall not exceed 76 feet; 2) The front yard encroachment into the minimum front yard shall not exceed 21 feet; 3) The landscaping plan be approved by the Planning Commission; and, a bond in the amount of estimate for the cost of landscaping, plus 15%, be posted. Said bond shall be held for not less than two years after installation of approved landscaping, which should include: a) sufficient screening plant materials on the Caballeros Road side of the stable corral area to significantly obscure the visual impact of the stable; b) sufficient screening plant materials, specifically densily growing types of (oleanders', myoporum, etc.) be installed on the northerly side of • • the stable/corral, in the vicinity of the property easement so as to effectively contain the dust emanating from the 'site; 4) Due to the proximity of the stable to Caballeros Road and the adjacent northerly property, proper levels of stable, corral and landscaping maintenance and cleanliness must be established and adhered to; as, failure to do shall result in the rescision of the Variance.
