Pursuant to Section 17.32.090 (enclosed) of the Rolling Hills
Municipal Code, this letter shall serve as official notification that
the above -stated Zoning Case application was reviewed by the Planning
Commission at their regular meeting of July 17, 1990. At that
meeting, the Planning Commission voted to approve the request for a
variance to encroach into to the rear yard setback to construct a
residential addition.
The Planning Commission's decision will be reported to the City
Council at their regular meeting on August 13, 1990. The decision of
the Planning Commission may be appealed pursuant to Sections 17.32.140
and 17.32.150 (enclosed) of the Municipal Code. A copy of Resolution
614, establishing the fee for filing an appeal, is also enclosed for
your information.

on September 10, 1990, voted to ratify the Planning
Commission's approval of the above referenced planning/zoning
case application.
Pursuant to Section 17.32.087, Ordinance No. 207, an Affidavit
of Acceptance form must be executed before the approval becomes
effective. A copy of the Resolution of Approval, specifying
conditions of approval set forth by the Planning Commission,
is enclosed for your information. Once you have reviewed
the Resolution of Approval, please complete the enclosed
Affidavit of Acceptance form, have the signature(s) notarized,
and forward the Affidavit to the Office of the County Recorder,
Room 15, 227 North Broadway, Los Angeles, CA 90012, with
a check in the amount of $7.00. When the Affidavit of
Acceptance has been returned to the City, duly executed and

RESOLUTION NO. 90-2.1..
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROLLING HILLS GRANTING A VARIANCE TO THE
REAR YARD SETBACK IN ZONING CASE NO. 419
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. William
Martin with respect to real property located at 17 Caballeros,
Rolling Hills (Lot 20-SK) requesting a variance to the rear yard
setback requirement to construct a residential addition and retaining
wall.
Section 2. The Planning Commission conducted a duly
noticed public hearing to consider the original application on
February 20, 1990 and March 20 1990 and conducted a field site review
on March 17, 1990. The Planning Commission adopted Resolution No.
90-6, denying the original Variance request. The Commission
rejected two following requests by the applicant for reconsideration
of the action on April 7, 1990 and April 18, 1990. The action of the
Commission was reported to the City council on May 14, 1990, whereby
the Council took jurisdiction upon the matter. The City Council
conducted a duly noticed public hearing on June 11, 1990 to consider
a revised request, and remanded the application to the Planning
Commission for additional review. Correspondingly, the Planning
Commission conducted a duly noticed public hearing on July 17, 1990.
Section 3. Sections 17.32.010 through 17.32.030 permit
approval of a variance from the standards and requirements of the
Zoning Ordinance when exceptional or extraordinary circumstances
applicable to the property and not applicable to to other similar
properties in the same zone prevent the owner from making use of a
parcel of property to the same extent enjoyed by similar properties.
Section 17,16.080 requires a rear yard setback in the residential
zone to be 50 feet. The applicant is requesting to encroach 22 feet
into the rear yard setback to construct a retaining
wall and an addition to the nonconforming residence.
findings:
Section 4. The Planning Commission makes the following
A. There are exceptional or extraordinary circumstances or
conditions applicable to the property or to the intended
use that do not apply generally to the other property or
class of use in the same vicinity and zone because the
property under application is unusually shaped and has
topographical and lot development constraints that justify
the continued encroachment.
B. The variae is necessary for the prervation and
enjoyment of a substantial property right possessed by
other property in the same vicinity and zone, but which is
denied to the property in question because due to the
existing development pattern and the configuration of the
property, the residence cannot be expanded significantly
within the front or side yards. Further, expansion of the
subject residence will be compatible in size with the
surrounding properties.
C. The granting of the variance would not be materially
detrimental to the public welfare or injurious to the
property or improvements in such vicinity and zone in which
the property is located because the proposed project will
be developed at a point far removed from the roadway and
surrounding residences, and the project will result in no
greater incursion into the rear yard than currently
existing.
Section 5. Based on the foregoing findings, the Planning
Commission hereby approves the Variance for Zoning Case No. 419 to
permit an encroachment of twenty-two (22') feet into the easterly
rear yard as indicated in the Development Plan submitted with this
application and incorporated herein by reference as Exhibit A,
subject to the following conditions:
A. The variance to the rear yard setback shall expire if
not used in one year from the effective date of approval as
defined and specified in Section 17.32.110 of the Municipal
Code.
B. The building plan must be approved by the Rolling Hills
Community Association Architectural Committee before the
applicant receives a building permit from the County of Los
Angeles.
C. The working drawings submitted to the County Department
of Building and Safety for plan check must conform to the
Development Plan approved with the variance.
D. Prior to the submittal of a final grading plan, if
necessary, to the County of Los Angeles, the grading
plan shall be submitted to the Rolling Hills Planning
Commission Department, along with related geology, soils
and hydrology. This grading plan must conform to the
development plan as approved by the Planning Commission.
E. Any modifications to the project which would constitute
a modification to the Development Plan as approved by the
Planning Commission, shall require the filing of an
application for modification of the Development Plan
pursuant to Section 17.34.070 of the Rolling Hills
Municipal Code.

F. Applicant shall execute an affidavit of acceptance of
all conditions pursuant to Section 17.32.087 or this
variance shall not be effective.

Dear Mr. Barto,
In response to your request of August 30, 1990 I reviewed the above referenced
plans dated 8/27/90 and visited the site Friday, September 7, 1990. The
purpose of the site inspection, as you know, was to determine from the existing
slope the constructed height of a concrete block retaining wall designed and
anticipated to be 5'-0" ± based upon existing topography survey information.
Using a 19'-2" (existing residence to back side of new wall) line -level, the
proposed retaining wall would vary from 5'-4" high at the east end to 6'-8" high
at the west end. To hold the wall height to 5'-0"+ and in order not exceed the
existing 2:1 maximum slope, it appears that the face of the slope could be cut
from the back of the proposed wall to the top of the slope (approximate 25')
along the western end of the wall where the slope is closest to the house:. If the
City will accept an overall slope slightly steeper than 2:1, A railroad tie - Garden
wall could be placed on the slope above the retaining wall to keep the retaining
wall to a maximum of 5'-0':
