A copy of the minutes of that meeting, which incorporate a list of requested conditions of approval submitted by Mr. Allen Lay, 19 Caballeros Road, is enclosed for your information. An acceptance form, as required by Ordinance No. 207, is also enclosed. Please complete the form, have the signature(s) notarized, and forward the document to the Office of the County Recorder, Room 15, 227 North Broadway, Los Angeles, CA 90012, with a check in the amount of $7.00. Request for Variance for construction of stable in front yard Statement of Mr. Allen Lay, 19 Caballeros Road Mr. Chairman, members of the Planning Commission and Staff: Thank you for the opportunity to make this statement. My wife, and I are neighbors of the Martins and owners of the adjacent property on Caballeros Road. The street is very steep in the area, and our home which is the closest to the proposed stable is located down a steep slope directly below the proposed location and about 150 ft from it at its closest point. Due to the nature of the°lot layout in the area the location. of the proposed stable in effect lies in our front yard set back as well as the Martin's and at a minimum the presence of a stable in that location will have an impact on the entrance to our property. If the proposed stable and surrounding area were not properly maintained it would have a negative impact on both Caballeros Road due to its location in reference to the curve of the street and on the entrance to our residence. Additionally, since our residence at 19 Caballeros is positioned at the bottom of a steep slope directly below the proposed stable and corral area; our property will be impacted by dust and odor emanating from the area. We believe that*this impact will be felt under the best of circumstances due to the natural air drainage of the slope which will carry dust particles and odors down the slope to the residence, but this situation could have an extremely serious impact if the stable and corral areas were not properly maintained. Having expressed our concerns we, at the same time, understand the Martin's desire to develop a stable on their property and support their right to do so. We further believe that the location they have chosen is probably the optimum location under the circumstances, and therefore would support the commission's approval of this variance request. However, to minimize the concerns we have raised and the impact of the proposed stable upon the street and upon our property we propose that the following conditions be included in your approval of the variance should it be granted. 1. That sufficient screening plant materials be maintained on the street side of the stable area to break up the outline and substantially obscure the stable from viewers coming down Caballeros Road. 2. That a dense line of screening material such as oleanders or myoporum or other densely growing material be required to be planted below the stable and corral areas in the vicinity of the property easement line in order to partially contain the dust and thereby mitigate the impact on the properties located below the proposed stable. 3. That wording be added to the variance to the effect that due to the"stable being located adjacent to Caballeros Road and above the residences of adjacent property that proper maintenance is especially important and failure to adequately maintain the stable area and required landscaping would result in the variance being rescinded. I would hasten to add that knowing Bill and Silver Martin we are not at all worried about the maintenance issues so long as they retain ownership of the property. It will be impeccable. We would appre- ciate the inclusion of the wording concerning maintenance in the variance however because if the stable and associated landscaping were not maintained by future owners it could seriously impactthe appearance of the street and the properties below. I have discussed these points with Bill ;and he has indicated his willingness to comply with the points raised. Thank you.
