The Commission asked that the hardscape not be enlarged, except for the deck and that it be brought to the current coverage of 41.9%. Your representatives, Howe and McHattie, said that you would agree to put "Grass Crete" or similar pervious material. I also heard that you will be withdrawing the entire request, but have not heard from you. I need a written request from you ASAP. Please either call me or email with your decision. If you decide to pursue, I must prepare a resolution which would approve the deck but deny the variance for hardscape coverage, and new plans have to be submitted to show how you accommodated the coverage and still retained 41.9%. I have been requesting this information from McHattie and Howe for two weeks with no resolution. The Planning Commission meeting is next Tuesday 6/17 and I must know by TODAY noon. Site Plan Review to construct an above grade deck and a Variance to exceed the total net lot coverage Dear Mr. and Mrs. Berenato: This letter shall serve to notify you that the Planning Commission voted at their continued meeting on May 15, 2008 to direct staff to prepare a resolution to approve vour reauest in Zonina Case No. 755 for the deck. but NOT for exceedance of the currently non-conformina hardscape coverage on vour property. A draft resolution will be prepared. The Planning Commission will review and consider the draft resolution, together with conditions of approval, at an upcoming meeting on June 17, 2008 beginning at 6:30 PM, and make its final decision on your application at that meeting. At that time the Commission will also hear any new testimony and consider new information, including a plan to show the reduction in the hardscape. Please submit seven sets of plans reducing the hardscape to no more than 41.9% of the net lot area (or less) by June 5, 2008, so that the amendments could be incorporated into the resolution. Should you wish not to reduce the hardscape coverage, staff would prepare a resolution for Planning Commission consideration, approving the deck but denying the Variance for total lot coverage, at which time you would have the opportunity to appeal Planning Commission's decision to the City Council. There is a fee associated with the appeal process. The findings and conditions of approval of the draft resolution will be forwarded to you before the Planning Commission meeting. The decision shall become effective thirty days after the adoption of the Planning Commission's resolution unless an appeal has been filed by anyone or the City Council takes jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010 of the Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision will be stayed until the Council completes its proceedings in accordance with the provisions of the Municipal Code. As stated above, the Planning Commission's action taken by resolution in the matter of this application is scheduled for Tuesday, June 17, 2008. That action, accompanied by the record of the proceedings before the Commission, is tentatively scheduled to be placed as a report item on the City Council's agenda at the Council's regular meeting on Monday, July 14, 2008. I spoke in strong opposition to the proposed variance at the April 15 meeting of the planning commission. This opposition was based on past issues on the back property line and the impact of the two story barn placed by the immediate previous property owners inside the property rear set back - apparently without a variance for same. It is my view that set backs are primarily for the purpose of separating adjacent properties buildings so that their use does not significantly impact neighbors regarding noise views and privacy. I am very pleased that the current property owners are acting responsively and going thru the proper processes to improve their property. I spoke with Mr. and Mrs. Berenato following the meeting and they described their project in more detail and answered numerous questions that I had and even invited me on to their property. They are the kind of neighbors that anyone would want to have and we wish them to be able to properly develop and fully enjoy their property. Finally I wish to thank the planning commission for its oversight of development in the city. The previous invitation that I extended to the Commission to view the proposed project from my property is also WITHDRAWN.
