ROLLING HILLS PLANNING COMMISSION RESOLUTION NO. 21 A RESOLUTION OF THE PLANNING COMMISSION OF THE'CITY OF ROLLING HILLS CONDITIONALLY APPROVING ZONING CASE NO.' 269 A CONDITIONAL USE PERMIT THE PLANNING COmZISSION OF THE CITY OF ROLLING HILLS HEREBY RESOLVES AND ORDERS AS FOLLOWS: SECTION 1: A public hearing to consider the proposed Condi- tional Use Permit with respect to real property described in Exhibit "A" of Zoning Case No. 269 attached hereto wasduly held on April 27, 1982 in the Council Chambers of the City Hall, 2 Portuguese Bend Road, Rolling Hills, California. Notice of the time, date, place and purpose of the aforesaid hearing was duly given. SECTION 2: Evidence, both written and oral, was duly presented to and considered by the Planning Commission at the aforesaid public hearing. Applicant in Zoning Case No. 269 was represented atthe public hearing by William Stromberg, the applicant's contractor. SECTION 3: The Planning Commission finds, pursuant to Section 17.32.060 of the Rolling Hills Municipal Code, that: 1. The Commission visited the subject property on April 2. 2. The Commission found that the subject property was devel- oped in such a way as .to screen the proposed riding ring from street view. 3. The Commission found that the ring was so situated as to be remote from surrounding residences. 4. The Commission noted that a screen planting program would further separate the proposed riding ring from adjoining residences. 5. The Commission found that certain changes to the riding ring are required. 6. The Commission found that the establishment and use of the ring would not be detrimental to the use and development of surrounding property and was in keeping with equestrian character of the neighbor- hood. SECTION 4: Based on the foregoing findings the Commission hereby approves ConditionalUse Permit No. 269, a request for permis- sion to construct and maintain a riding ring subject to the following conditions: 1. This Conditional Use Permit shall not be effective for any purpose until the owner of the property involved or his duly authorized representative has filed with the City Clerk of the City of Rolling Hills an, affidavit stating that he is aware of and agrees' to comply with all the conditions of the Permit. 2. It is declared to be the intent of the Planning Commission that if any provision of the Permit is held, or declared to be invalid the Permit shall be void and the privileges granted thereunder shall lapse. 3. It is declared and made a condition of the Permit that if any conditions thereof are violated, or if any law, statute or ordinance is violated, the Permit shall be suspended and the privileges granted thereunder shall lapse; provided that the applicant has been given writ- ten notice to cease such violation and has failed to do so for a period of thirty (30) days. . 4. All requirements of the Zoning Ordinance and of the zone in which the subject property is located must be complied with unless otherwise set forth in the Permit or shown otherwise on an approved plan. 5. The property shall be developed and maintained in substan- tial conformance with the site plan on file marked Exhibit "A" except as otherwise provided herein. 6. All fences shall be of a three rail wooden type, painted a uniform white color and continuously maintained. 7. The ring facilities shall be screened by a double. row 'of trees planted and maintained immediately to the south and west of the riding ring. 8. A landscape plan shall be submitted to and subject to the approval of the Landscape Committee. 9. A bond for the required landscaping and irrigation system shall be submitted to the satisfaction of the City Manager. All planting and landscaping shall be completed prior to August 1, 1982. 10. Conditions 1 through 9 of the Geologic Report dated April 1982 shall •be immediately undertaken and completed before August 1, 1982. SECTION 5: The Secretary shall certify to the adoption of this resolution and shall transmit copies of the same to the permit holder and to the City Clerk. SECTION 6: This action shall become final and effective twenty (20) days after the adoption of this resolution unless withinsuch time an appeal is filed with the City Clerk in accordance with the provisions of the Rolling Hills Municipal Code.
