FINDINGS AND REPORT
The application of Mr. Shel Medall, Lot 5-BW, Buggy Whip
Tract, for a variance from the requirements of Section 7009 (a),
Maximum slope and Section 7010 (c) Fill Slope, of Ordinance No. 153,
the Grading Ordinance, came on for hearing on the 20th day of March,
1979 in the Council Chambers of the Administration Building, 2 Portu-
guese Bend Road, Rolling Hills, California, and the applicant,
having submitted evidence in support of the application, the Planning
Commission, being advised, now makes its Findings and Report as
required by the Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Shel Medall,
is the owner of that certain real property described as Lot 5-BW,
located at 18 Buggy Whip Drive, and that notice of the public hearing
in connection with said application was given as required by Sections
8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills,
California. The Commission finds, further, that no comment, written
or verbal, was received in opposition to the request.

II.
The Commission finds that the applicant has requested a
variance for regrading and slope stabilization at the original 1 1/2:1
to correct a distressed condition caused by settling and lateral
movement. The Commission finds that grading at the currently required
2:1 would disturb the natural drainage course on the property. The
Commission finds further that theproposed remedial 1 1/2:1 grading
is necessary to stabilize the existing 1 1/2:1 fill slope. The Com-
mission finds that a variance of grading requirements should be granted
in order to preserve substantial property rights in the same vicinity
and zone, and that thegranting of such a variance would not be
materially detrimental to the public welfare, nor injurious to
property in the same vicinity and zone.
III.
From the foregoing it is concluded that a variance of grading
requirements should be granted to Mr. Medall to permit 1 1/2:1 correct-
ive grading subject to the following conditions:
1) That the planting be done to the satisfaction of the
staff with regard to use of jute;
2) That the plan for slope planting and irrigation be submitted
to and approved by the Landscape Committee;
3) That all planting be done within 60 days after completion
of grading;
4) That deposits be made with the City as follows: a sum equal
to the estimate + 15% for inflation for the irrigation sys-
tem, to be released upon completion and inspection of the
system, and a sum equal to the estimate + 15% for inflation
for landscaping, the funds to be kept for a period of two
years to guarantee growth;
and it is, therefore, so ordered.
