This letter is to serve as official notice, pursuant to Section
17.32.090 of the Rolling Hills Municipal Code,that a Conditional Use
Permit for a paddle tennis court has been approved by the Planning
Commission for your property at 8 Buggy Whip Drive. 0n May 15, 1984
the Planning Commission approved the paddle tennis court as shown on
a plan dated May 12, 1984. The Planning Commission conditioned the
approval on having a landscape plan approved by the Community Associ-
ation's Landscape Committee, with particular emphasis to be placed
upon the screening, height of fence and color of retaining walls. A
standard copy of conditions for tennis courts has been given to Mr.
Douglas McHattie.
This notice shall serve as a copy of the decision of the Planning'
Commission. A formal report of the. Commission's action as required by
Section 17.32.086 of the Municipal Code is contained in the minutes of
the proceedings before the Commission.
The City Council of the City of Rolling Hills will be reviewing
the action of the Planning Commission on Monday, June 11, 1984 at
7:30 P.M. in the Council Chambers at City Hall, pursuant to Section
17.32.140 of the Municipal Code to determine whether the action of
the Planning Commission should be appealed by the Council. Should

Paddle Tennis Court
A plan for a paddle tennis court on your property at 8 Buggy
Whip Drive, submitted as a condition of approval by the Planning
Commission on February 21, 1984 of a paddle tennis. court, on Lot
247B-2-MS, was reviewed by the City Council attheir meeting on
Monday, March 12., 1984. The plan which showed the revised court
location, as approved by the Planning Commission, was not approved
by the Council, since it showed only that portion of your property
on which the proposed paddle tennis court is to be located. A full
plan of the property, showing all improvements, is required for the
file. Mr. McHattie of South Bay Engineering has been advised of
the requirement. The plan shows a five foot high retaining wall,
which is not in compliance with the Planning Commission's require-
ment that retaining walls: incorporated as a part of the overall plan
of the court shall not be greater than four feet in height. (Section
17.16.012 F(11), Rolling Hills Municipal Code. '
It has come to the attention of this office than an existing
stable on your property is being modified by addition of windows.
This is in violation of Section 17.16.050 of the Municipal Code,
which specifies that no building shall exceed one story in height
except a barn or stable which may have a loft without glazed openings
to be used exclusively and only for the storage of feed, tack and
stable equipment. •The Department of Building and Safety has been
requested to place a notice on your property that all work on the
stable is to cease until the matter has been resolved.
The Rolling Hills City Council will hold a special meeting at
7:00 A.M. Friday, March 16, 1984 to review the plans for your property,
pursuant to Section 17.32.140 of the Municipal Code.

As per our request, Stone & Associates submitted the additional information
necessary for our review of the subject project. This information consisted
of a quantitative runoff analysis and a topographical map indicating existing
and proposed drainage facilities.
The additional and previously submitted data have been reviewed and field
checked by this office. The field check was conducted to verify topograph-
ical data and investigate possible erosion problems on site and in the down-
stream canyon areas. It is our conclusion that the increase in runoff due
to the proposed paddle tennis court and swimming pool is insignificant and
will not cause any drainage impact on the site and/or downstream canyon areas.

As requested, we have reviewed the hydrology statement and report
prepared by Stone & Associates for the subject project.
Insufficient information was submitted to properly evaluate the drainage
impact on the site and downstream canyon areas. A quantitative runoff
analysis comparison should be made and onsite and downstream topo-
graphical information, including existing drainage facilities erosion
problems, etc., should also be identified and considered in the overall
appraisal.

The report dated December 13, 1983 by Robert Stone and Associates
Inc. has been reviewed. The plan for the pool was submitted the
first part of December and was approved with the following conditions
on the basis of information in the report.. The consultant's recom-
mendations must be followed and the pool excavation must be inspected
and approved by the consultant prior to placing of steel or pouring.
The grading plan for the Paddle Tennis Court can be approved from a
geologic standpoint provided the plan incorporates the consultant's,
recommendations and •the plan is approved by the consultants.

I would like these comments to be entered in the
record since I will be unable to attend the meeting
on Nov 15.
X feel that careful consideration should be given
to the erosion of the canyon floor west of Buggy
Whip Dr., which canyon drains the property under
consideration. I have noticed an increased
flow of water with resulting erosion as the
ground cover has been removed from the properties
at #8 and #2 Buggy Whip Dr. The erosion has been
prevented from cutting into the property at #8
by placing in the streem flow at the canyon
bottom a large quantity of concrete pieces.
While this will reduce the headward erosion, the
downstream erosion remains.
I•suggest that the Planning Commission consider
the increase in peak water flow which will be
caused by replacing the semi absorbent ground
with a totaly'impermiable paddle tennis court.
Additionaly I notice that the drawing indicates a
possible swimming pool with surrounding deck area.
This also will contribute to the peak water flow.
I suggest that the Commission members look at the
canyon bottom by walking (riding their horses?)
along the trail from Hix Ring to Johns Canyon R.

Dear. Mr. Smith:
As discussed by phone this date, we are advising you that
the subject additions to the S.M. Kim property does not
significantly change or alter the surface water regimen
downstream from the subject site. As discussed in the previous
report by Michael Scullin, Project #82111, April 22, 1982;
the riding ring also acts as a desilting basin that collects
silt and allows the water to pass thru. Mr. Kim is probably
one of the few or the only one that has such a flood control
structure or device on their site.
The swimming pool and the paddle tennis court are proposed
to be constructed up the slope and out of the water course. They
will not significantly contribute to the increase in water
runoff. The residential area was stabilized with a buttress fill
under inspection of Pacific Soils Engineering Inc. This office
has made recommendations for the safe design of retaining walls
to support the pool and paddle tennis court. These should
provide adequate safety against sliding within the site.

Whatever water that runs off the site thru the desilting basin
has always been contributary to the water course downstream.
That ravine has been there for centuries and it has carried
the water runoff long before any development of #8
Buggywhip Drive. The proposed additions will not change that
condition.
