The proposed residence respects the General Plan and Zoning Ordinances; with the exception
of disturbed area, which is already exceeded by the existing development, the project meets the
requirements and guidelines of the Code and Ordinances.
Variances are sought for the following:
1. Location of pool in front yard area
2. Location of future stable in front yard area

Criteria to be satisfied for grant of Variance
Such change is based upon the following described exceptional or extraordinary circumstances
or conditions that do not apply generally to other property in the same vicinity and zone.
The parcel, being at a bend in Johns Canyon Road, has two front yard setbacks per the Code.
_ As the existing pad is located to the extreme rear of the parcel, almost the entirety of the lot is
deemed 'front yard'. Additionally, the applicant has attempted to locate the residence to the rear
- corner to minimize massing from the street and preserve views from above; the result is that
there is no way to locate these features outside the front yard.
The existing disturbed area is over 40% of the net lot area, minor increases result from grading
to reshape the pad; an additional Q /o of disturbed area is requested.

Such change will not be materially detrimental to the public welfare nor injurious to the
property or improvements in such vicinity and zone where property is located because
- The changes sought are the result of the site being located with street on two sides and the
location of the existing pad. Moving the house to increase the rear yard area to avoid the
- variance would result in more grading, a more massive presence of the house from Johns
Canyon Road, and imposition on views from the neighboring parcels.

SITE PLAN REVIEW CRITERIA
Site plan review criteria upon which the Planning Commission must make an affirmative finding. Describe
in detail the project's conformance with the criteria below:
A. Is the project compatible with the General Plan, the Zoning Ordinance and surrounding uses? Explain how it
compares to the sizes, setbacks and other characteristics of neighboring houses.
The proposed residence respects the General Plan and Zoning Ordinances; with the exception
of disturbed area, which is already exceeded by the existing development, the project meets the
requirements and guidelines of the Code and Ordinances. As the property has two front yard
setbacks and the existing pad is located to the rear, variances are sought for location of
improvements in the front yard.
B. How does the project preserve and integrate into the site design, to the maximum extent feasible, existing natural
topographic features of the lot including surrounding native vegetation, mature trees, drainage courses, and land
forms (such as hillsides and knolls)? Explain how the project preserves and integrates existing natural features.
_ The existing undisturbed hillsides below the existing pad and above John's Canyon Road are
left undisturbed, and in general the existing pattern of development for the parcel is respected
by the proposed development.
C. How does the site development plan follow natural contours of the site to minimize grading? Extensive grading and
recontouring of existing terrain to maximize buildable area shall not be approved. Graded slopes shall be rounded and
contoured so as to blend with existing terrain. Grading shall not modify existing drainage or redirect drainage flow
unless into an existing drainage course. Explain the nature and extent of the impact of grading and proposed
minimization on lots.
Minimal grading is proposed to enlarge the existing pad and to accommodate the footprint of the
proposed residence. In part, the grading is driven by the desire to provide a raised floor without .
increasing the finish floor of the house.
D. To what extent does the site development plan preserve surrounding native vegetation and supplement it with
landscaping that is compatible with and enhances the rural character of the community? Landscaping should provide
a buffer and transition zone between private and public areas. Explain how the project preserves native vegetation,
integrates landscaping and creates buffers.
Existing native vegetation is preserved to the maximum extent possible, and proposed
landscaping will provide a buffer between public zones.

E. How does the site development plan preserve the natural and undeveloped state of the lot by minimizing building
coverage? Lot coverage requirements shall be regarded as maximums and the actual amount of lot coverage
permitted should depend upon the existing buildable area of the lot.
Lot coverage calculations are provided; the undeveloped portions of the lot are generally left
— undeveloped.
F. Is the site development plan harmonious in scale and mass with the site, the natural terrain and surrounding
residences? Setbacks shall be regarded as minimums and more restrictive setbacks shall be imposed where necessary
to assure proportionality and openness. Explain how the proposed project setbacks compare with the existing setbacks
of neighboring properties.
Yes; the proposed house is sited such that views from adjoining parcels are respected, finish
floor height matches the existing finish floor height, and the existing building pad location is
respected.
G. Is the site development plan sensitive and not detrimental to convenience and safety of circulation for pedestrians and
vehicles? Explain how the number and types of vehicles relate to the driveway location, design, landscaping and
other on -site parking or storage areas.
Yes; driveway location is the same as the existing; vehicle storage is hidden from Johns Canyon
Road.
H. Does the site development plan conform with the requirements of the California Environmental Quality Act? Explain
how the project impacts the environment, e.g. significant impact, proposed mitigation measures.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1. A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by the information sources a lead agency cites in the
parentheses following each question. A "No Impact" answer is adequately
supported if the referenced information sources show that the impact simply does
not apply to projects like the one involved (e.g. the project falls outside a fault
rupture zone). A "No Impact" answer should be explained where it is based on
project -specific factors as well as general standards (e.g. the project will not expose
sensitive receptors to pollutants, based on a project -specific screening analysis).
2. All answers must take account of the whole action involved, including off -site as
well as on -site, cumulative as well as project -level, indirect as well as direct, and
construction as well as operational impacts.
3. Once the Lead Agency has determined that a particular physical impact may occur,
then the checklist answers must indicate whether the impact is potentially
significant, less than significant with mitigation, or less than significant.
"Potentially Significant Impact" is appropriate if there is substantial evidence that
an effect may be significant. If there are one or more "Potentially Significant
Impact" entries when the determination is made, an EIR is required.
4. "Negative Declaration: Less Than Significant With Mitigation Incorporated"
applies where the incorporation of mitigation measures has reduced an effect from
"Potentially Significant Impact" to a "Less Than Significant Impact." The Lead
Agency must describe the mitigation measures, and briefly explain how they
reduce the effect to a less than significant level (mitigation measures from Section
XVII, "Earlier Analyses," above may be cross-referenced).
5. Earlier analyses may be used where, pursuant to the tiering, program EIR, or other
CEQA process, an effect. has been adequately analyzed in an earlier EIR or
negative declaration. See State CEQA Guidelines Section 15063(c)(3)(D). In this
case, a brief discussion should identify the following:

b. Impacts Adequately Addressed. Identify which effects from the above checklist were within the
scope of and adequately analyzed in an earlier document pursuant to applicable legal standards,

• Submit the attached Form. Submit additional sheets if necessary to detail the
project
• Submit site plan showing areas of study/borings
• Submit pictures of site including slopes in the vicinity of exploration area
• Erosion control plan may be required
• Borings and test pits must be backfilled to existing grade immediately after
exploration is completed and area secured for erosion control
• No export or import of dirt is allowed
• Dirt from excavation to be covered and watered as needed for dust control
• Boring sites and holes to be secured and fenced
• If grading is necessary to access the site, a grading plan must be submitted to
the City
• If grading for the access or to create a pad for the equipment entails more
than 3 ft. cut and/or more than 3 ft. fill, a review by the Planning Commission
under the Site Plan Review process is necessary
• If access to the exploration area was graded and the applicant thinks it may
be utilized for future construction, if within six months of said approval
plans and application are not submitted for construction on the site, the
access shall be restored to its pre -exploration conditions, including
landscaping. Said site restoration shall be completed within three months.
