133, Construct a tennis court in fr, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mrs. Joyce Failing Lot 1-EG ZONING CASE NO. 133 FINDINGS AND REPORT The application of Mrs. Joyce Failing, Lot 1-EG, Eastgate Tract, for a conditional use permit under Article III, Section 3.06, Front Yard Requirements, of Ordinance No. 33 came on for hearing on the 17th day of September, 1974 in the Council Chambers of the Admin- istration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the appli- cation, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mrs. Joyce Failing, is the owner of that certain real property described as Lot 1-EG, Eastgate Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said appli- cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II. The Commission finds, further, that no communication, written or oral, had been received in opposition to the request, and that written communications in favor of the request had been received from John M. Bennett, 3 Eastfield Drive and from Dr. & Mrs. Sidney Wechsler, 1 Roundup Road, and that Mrs. Stephanie Enright, owner of property on Hummingbird Lane adjacent to the Failing property had telephoned to express her approval. Further, the Commission finds that a petition containing 33 signatures in favor of the tennis court was in Rolling Hills Community Association files, and that ten residents of the City, neighbors of Mrs. Failing, are present at the meeting in support of the request. III. The Commission further finds that the applicant requests the conditional use permit for construction of a tennis court in the front yard of her property which is served by Hummingbird Lane, a private drive that serves three residences. The applicant has sub- mitted a profile showing projected growth in three to five years of landscaping required for screening. The Commission finds that a conditional use permit should be granted in order to preserve sub- stantial property rights possessed by other property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance of Front Yard Requirements under Article III, Section 3.06 of Ordinance No._33 be granted by the Planning Commission of the City of Rolling Hills to Mrs. Joyce Failing, Lot 1-EG, Eastgate Tract, subject to con- ditions 1 through 7 of the conditions submitted by the staff and attached hereto. In addition.a cash deposit be made to the satis- faction of City staff in an amount satisfactory to the staff in favor of the City of Rolling Hills, with release provisions as follows: 1) Upon completion of the irrigation system, release of a sum equal to the cost of the system. 2) Release of the balance of deposit covering the plants 18 months subsequent, upon determination of the adequacy of the landscaping by the Planning Commission. As a further condition, the fence height shall not exceed ten feet from the surface of the tennis court at any point and no lights are per- mitted for night play.
