A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ROLLING HILLS APPROVING A CONDITIONAL
USE PERMIT FOR A .GU'C N� IN ZONING
CASE NO.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES FIND
AND RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs.
Nicholas Hornberger for a Conditional Use Permit for a cabana, at
property located at 1 Johns Canyon Road (Lot 174-C-1-MS), Rolling
Hills, California. The application seeks a Conditional Use Permit
for the construction of a cabana.
Section 2. The Planning Commission opened the public
hearing on December 20, 1988 and continued it to January 17, 1989. A
duly noticed field trip was conducted on January 14, 1989, to which
the applicant and all members of the public were invited. The
Commission has considered the evidence, both written and oral,
presented to it in connection with this application.
Section 3. In accordance with Sections 17.32.060 of the
Municipal Code, the Planning Commission finds as follows:
1. That Conditional Use Permit for a cabana on the
subject property is consistent with the purposes and
objectives of the Zoning Ordinance and is not
detrimental to the public health, safety and
welfare.
2. That the Conditional Use Permit for a cabana on the
subject property is compatible with uses in the
surrounding area.
3. This project is categorically exempt under the
California Environmental Quality Act.
Section 4. The Planning Commission, as consideration for
approval, does hereby set forth the following conditions with which
the property owner must comply.
1. This Conditional Use Permit shall not be effective
for any purpose until the owner of the property
involved, or his duly authorized representative, has
filed with the City Clerk of the City of Rolling
Hills an affidavit stating that he is aware of and
agrees to comply with all the conditions of the
Permit.
2. It is declared to be the intent of the Planning
Commission that is any provision of the Permit is
held or declared to be invalid, the Permit shall be
void and the privileges granted thereunder shall
lapse.
3. It is declared and made a condition of the Permit
that if any conditions thereof are violated, or if
any law, statute or ordinance is violated, the
Permit shall be suspended and the privileges granted
thereunder shall lapse; provided that the applicant
has been given written notice to cease such
violation and has failed to do so for a period of
thirty (30) days.
4. All requirements of the Zoning Ordinance and of the•
zone in which the subject property is located must
be complied with unless otherwise set forth in the
Permit, or shown otherwise on an approved plan.

5. The property shall be developed and maintained in
substantial conformance with the site plan on file
marked Exhibit "A", except as otherwise provided in
these conditions.
6. Use of the cabana is limited to purpose indicated
which is to be for recreation uses; not for
habitation of a temporary or permanent nature.
7. Landscaping, irrigation plans and bonding are
required of the applicant, and must be approved by
the Planning Commission and be bonded at estimated
cost of landscaping, plus 15%.
8. Prior to issuance of building permits and grading
permits, complete geological soils and hydrological
testing must be accomplished to determine the
compatibility of construction with the topography,
geology and environmental issues related to the
site.
9. Renting of the cabana and utilizing it as a guest
house, servants' quarters, or any temporary or
permanent habitat is prohibited.
10. This Conditional Use Permit shall expire unless used
within one year from the date of grant, pursuant to
Section 17.32.110.
11. This Conditional Use Permit shall not be valid or
effective unless the applicant has received final
architectural approval from the Rolling Hills
Community Association Architectural Committee.
12. An engineered drain system must be incorporated into
the design of the recreation room and, be approved
by the City engineer.
13. The grading required to construct the cabana cannot
exceed that which is indicated on the plan approved
as Exhibit "A".
Section 5. In accordance with the foregoing findings the
Use Permit sought in Zoning Case No. 375 is hereby
PASSED, APPROVED, and ADOPTED this 17th day of January,

CONDITIONAL USE PERMIT
CONDITIONAL USE PERMIT
Certain uses of property are permitted in the City only upon approval of a Conditional
Use Permit. Such uses are set. forth in Sections 17.16.010 and 17.20.010 of the Municipal
Code.
APPLICATION AND REQUEST P'OR HEARING
In order to obtain a conditional use permit, a property owner or his or her agent must
submit an application and request a hearing before the Planning Commission. To do so, the
applicant should complete the requirements enumerated herein, assemble the necessary appli-
cation documents and call to make an appointment at (213) 377-1521. Making an appointment
will assure that someone is available to explain the necessary procedures and review the
case material for completeness and accuracy.
PLAN SUBMITTAL INFORMATION
Complete and submit for each application:
1. "Request.fQr Hearing" Application. Fifteen copies of plan MUST•accdmpany application
2. Owner's Declaration
3. Plan submittal using the "Checklist" as guide. Each.plan must have computation of
lot coverage printed on the plot plan.
4. Ownership List: Prepare a'complete list of names and mailing addresses of all property
owners °reach parcel, within or partially within a 1,000 foot radius of the exterior
. boundaries of the property under consideration, including the owner of the subject
'property. Assign a number to each name on the list. This information must be as it
appears on the latest available assessment roll of the Los Angeles County Assessor.
This list shall be certified to be true and correct (complete Certified Property
Owner's Affidavit). An inaccurate or incomplete list is.cause for removal of the
case from the agenda or to require a rehearing of the case.'
.Type Self -Adhesive Mailing Labels: In addition to the Ownership List required, submit
one complete set of typed self-adhesive mailing labels for all property owners listed
on the Ownership List.

REGULAR MEETINGS
Once an application has been accepted as complete by the City, a hearing will be set before
the Planning Commission. Applications are considered at the regular meetings of the Plan-
ning Commission, which are held the third Tuesday of each month. Applications must be
submitted to the Planning Commission Secretary no later than' the last Monday of the month
immediately preceding the regular meeting at which the matter shall be considered. Provide
sufficient time in your plans to attend at least twb meetings to allow the Planning Com-
mission to study the facts presented and to make a field trip review of the physical
conditions. The applicant or/a representative must appear at the meeting.
AUTHORITY AND RESPONSIBILITY
In reviewing a request, the Planning Commission must consider the following:
1. The Planning Commission shall consider all matters presented to it fairly and impar-
tially, recognizing the rights of the applicant as well as its obligation to enforce
all zoning ordinances and resolutions adopted by the City Council of the City of
Rolling Hills.

2. The development and use of all land within the City of Rolling Hills should be directed
to the continuation of the existing rural open areas surrounding the existing residence,
in the City, and each new improvement or use of land should be carefully examined to
determine what effect the proposed improvement or use of land will have on the terrain,
trees and natural flora in the City.
3. The granting of conditional use permits shall be carefully scrutinized to protect
bridle trails, and provide the proper spacing of residences and accessory building so
as to present overconstruction of the lot -or parcel to be improved.
