FINDINGS AND REPORT
The application of Mr. and Mrs. Marvin Goodman, Lot 173B-MS
Miscellaneous Tract, for a Variance of Front Yard Requirements under
ARTICLE III, Section 3.06 of Ordinance No. 169 came on for hearing on
the 22nd day of April, 1980 in the Council Chambers of the Administra-
tion Building, 2 Portuguese Bend Road, Rolling Hills, California; and
the applicant, having submitted evidence in support of the application,
the Planning Commission, being advised, now makes its Findings and
Report as required by the Ordinances of the City of Rolling Hills,
California.
I.
The Commission finds that the applicants, Mr. and Mrs.
Marvin Goodman, have entered into an escrow to purchase that certain
real property described as Lot 173 B-MS, owned by Mr. and Mrs. Robert
Gose and located at 3 Johns Canyon Road, and that they have the per-
mission of the owners to apply for the variance of front yard require-
ments. The Commission finds, further, that notice of the public hearing
in connection with said application was given as required by Sections
8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, Cali-
fornia, and that no comment, written or verbal, was received in favor
of or in opposition to the request.
II.
The Commission finds that the applicant wishes to have a
swimming pool constructed in -the front yard to enjoy property rights
enjoyed by other property owners in the area. The Commission finds,
further that the site in the front yard lends itself to the most
efficient application of solar energy for pool heating, and will not
require changes to the terrain and environment for grading or tree
removal. The Commission finds that construction of a swimming pool in

a legal location in the rear yard would require removal of an entire
grove of mature eucalyptus trees, which would destroy the privacy and
impair the aesthetic value of the property, since.a pool in a legal
location would be' visible from the bridle trail and from the adjacent
properties. The Commission finds that the request should be approved,
and a Variance of Front Yard Requirements should be granted in order
to preserve substantial property rights in the same vicinity and zone,
and that the granting of such Front Yard Variance would not be materi-
ally detrimental to the public welfare, nor injurious to property in
the same vicinity and zone.
III.
From the foregoing it is concluded that a Variance of Front
Yard Requirements should be granted to Mr. and Mrs. Marvin Goodman for
construction of a swimming pool in the front yard of .Lot 173 B-MS
subject to conditions that the pool be landscaped to be screened from
Johns Canyon Road, with all visible portions of the pool and pool equip-
ment screened to the satisfaction of the Planning Commission, that there
be no slide adjacent to the pool, that all appurtenant structures not
exceed•42" in height, and that the approval not become effective until
close of escrow, and it is, therefore, so ordered.
This approvalshall expire one year from the date of grant,
if not acted on.
