375, Construct a cabana with a bath, Staff Reports• • AGENDA MEMORANDUM DATE: October 11, 1989 TO: PLANNING COMMISSION FROM: STAFF SUBJECT: ZONING CASE NO. 375; Request for extension of approval for a Conditional Use Permit to allow a cabana on proerty located at 1 John's Canyon Road, Lot 174-C-1-MS Owner: Nick Hornburger DISCUSSION Staff is in receipt of a letter, dated September 27, 1989, from Criss Gunderson, representing Mr. Nick Hornburger. The applicant is requesting an extension of approval for a conditional use permit received earlier this year. Mr. Hornburger has indicated that he will not be able to build the cabana this year. The Planning Commission, at their regular meeting of January 17, 1989, approved Zoning Case No. 375 which allowed the cabana subject to conditions of approval. Subsequently, the City Council at their meeting of February 13, 1989, accepted the report of approval. Section 17.32.110 of the Rolling Hills Municipal Code requires that "any conditional use permit which is not used within one year of the effective date of such approval, becomes null and void and of no effect except that where a written application requesting an extension is received by the City prior to such expiration date, the Commission at its sole option may extend such approval for a period of not to exceed one year". The applicant's approval actually expires on February 13, 1990, but he anticipates that construction would not begin before that time. In reviewing the applicant's request, Staff would have no objection acquiescing to the applicant's request for an extension. RECOMMENDATION Correspondingly, Staff would recommend that the Planning Commission approve an extension of one year to an expiration date of February 13, 1991.
