FINDINGS AND FORMAL REPORT
The application of Mr. Mark M. Friedman, Lot 53, Southfield
Tract, for a side yard variance came on for hearing on: the 16th
day of July, 1968 at the hour of 8:00 P.M. at the Administration
Building of the City of Rolling Hills,: California, and the appli-
cant having submitted evidence in support of his application, the
Planning Couanission, being advised, now makes its Findings and Formal
Report as required by the Ordinances of the City of Rolling Hills,
California.
I.
The Commission finds that the applicant, Mr. Mark M. Friedman,
is the owner of that certain real property described as Lot 53,
Southfield Tract, located in the City of Rolling Hills, California,
and that notice of the public hearing in connection with said
application was given as required by Sections 8.06 and 8.07 of
Ordinance No. 33 of the City of Rolling Hills, California.

The Couauission.further finds that no person appeared at said
public hearing in opposition to the application: for a variance, and
that no evidence was received by the Coiulnission in opposition thereto.

The Commission further finds that in 1962 Mr. Friedmanhad
asked for and received a side yard variance for a swimming pooland
pool structure, that the pool was constructed late in 1963,. and that
Mr. Friedman did not understand that there was a time limitation on
thevarian.ce, and had allowedthe time limit to expire; that the
variance shouldbe granted to applicant in order to preserve sub-
stantial property rights possessed by other property inthe same
vicinity and zone, and that the granting of such variance will not
be materially detrimental to the public welfare or injurious to pro-
perty in the same vicinity and zone.

From the foregoing it is conc1.6ded that a variance should be
granted to Mr. Mark M. Friedman, Lot 53, Southfield Tract, in accord-
ance with the plot plan marked Exhibit I on file in these proceedings
and it is, therefore, so ordered.
