231, Permit an existing accessory b, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Dr. Stanley Wishner Lot 105-1-RH FINDINGS AND REPORT ZONING CASE NO. 231 The application of Dr. Stanley Wishner, Lot 105-1-RH, Rolling Hills Tract, for a variance of Front Yard Requirements under Article III, Section 3.05, Ordinance No. 33 for conversion of an existing stable to a playroom came on for hearing on the 5th day if June, 1979 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in, support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Dr. Stanley Wishner, is the owner of that certain real property described as Lot 105-1-RH, located at 31 Portuguese Bend Road in the city of Rolling Hills, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills. The Commission finds that no communica- tion, written or verbal, was received in favor of or in opposition to the request. II. The Commission finds that the applicant requested a variance of front yard requirements to permit an existing stable located in the front yard, which was constructed prior to adoption of the zoning ordinance, to be converted to a playroom. Subsequently the applicant stated that the plan submitted shows a stable as required by the City's ordinance, and the existing building is used for storage, not for housing animals. The Commission finds that a variance should not be granted in order to preserve substantial property rights in the same vicinity and zone, and that the granting of such variance would be materially detrimental to the public welfare and injurious to property in the same vicinity and zone. y • III. From the foregoing it is concluded that a variance should not be granted to Dr. Stanley Wishner, Lot 105-1-RH for an existing building in the front yard, with a finding that the building in the present location is undesireable, and it is, therefore, so ordered. /s/ Joanne Murdock Chairman, Planning Commission /0ecretary, Planning(ommission NOTE: The decision of the Planning Commission was appealed to the City Council by Dr. Wishner. On June 25, 1979 the Council voted to overrule the decision of the Planning Commission, and grant a front yard variance on condition that the building not be used to house animals.
