FINDING AND FORMAL REPORT
The application of Mr. R. Turcoite, Lot 104A-RH, Roiling
Hills Tract, for a variance of Uses Permitted, Seetiun 3.0, A(4)
came on for hearing on the 18th day of April, 1972 at the hour of
8:00 P.M. at the Administration Building of the City of Rolling
Hills, California, and the applicant, having submitted evidence in
support of his application, the Planning Commission, being advised,
now makes its Findings and Formal Report as required by the Ordi-
nances of the City of Rolling Hills, California.
The Commission finds that the applicant, Mr. V. R. Turcotte,
is the owner of that certain real property described as Lot 104A-RH,
Rolling Hills Tract, located in the City of Rolling Hills, California,
and that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Rolling Hills, California.

The Commission further finds that no person appeared at said
public hearing in opposition to the application for a variance, and
that no evidence was received by the Commission in opposition thereto.
Further, the Commission finds that Mr. Bernard G. Mueller, General
Contractor, appeared in behalf of Lhe owner, and advised the Commis-
sion that a small structure already Located on the property will be

ved to a location in the rear of the proposed residence, and will
serve as caretaker's quarters, and there is a kitchen in the existing
structure, which is presently the main structure en the property.

The Commission finds, however, that the Rolling Hills Community
Association does,permit cooking facilities i;ra servants quarters but. the
City does not permit additional kitchen facilities in ei.her guest or
servant quarters unless a variance is obtained. The Planning Commission
may grant a variance when practical difficulties or unnecessary hardship
result; however, the Commission finds that no such hardship exists, there-
fore, a variance of Uses Permitted for approval of kitchen facilities in
the .servants' quarters should not be granted to the applicant in order
to preserve substantial property rights possessed by other property in
the same vicinity and zone, and that the granting of such variance would
be materially detrimental to the public welfare and injurious to proper-
ty in the same vicinity and zone.

From the foregoing it is concluded that a •variance of Uses
Permitted should not be granted by the Planning Commission of the City
of Rolling Hills to Mr. V o R a Turcotte 9 Lot 104A-RE1, and it is,
therefore, so ordered.
