MICHAEL WELLER 3 FLYING MANE ROAD (LOT 49-SF) BACKGROUND Attached is a request from Dr. Weller for a one year time extension for a Site Plan Review for proposed residential additions of 1,109 square feet. Dr. Weller gave monetary reasons as the need for the request. Planning Commission Resolution No. 90-15 was approved on August 4, 199M. You may notice that Dr. Weller's letter was received on August 6, 1991. But, after consultation with the Assistant City Attorney, staff concluded that since August 4, 1991 was a Sunday, we received the letter only one day late and there was also a misunderstanding about the actual approval date. RECOMMENDATION It is recommended that the Planning Commission review the case. I **** STAFF REPORT DATE: TO: FROM: JULY 6, 1990 PLANNING COMMISSION - STAFF SUBJECT: ZONING CASE NO. 429; Request for Site Plan Review of residential additions; 3 Flying Mane Road, Lot 49-SF; Owner: Weller DISCUSSION The above -stated meeting of June to conduct the field inspection, addition project cubic yards of building pad. application was continued from the regular Commission 19, 1990 to the adjourned meeting of June 30, 1990 so as field inspection of the site and neighborhood. At the it was noted that a portion of the proposed residential (1,132 square feet total) requires minor grading of 92 cut/fill and a retaining wall structure to expand the Issues addressed from the previous meetings are as follows: 1. Adherence to City policy regarding the coverage of the buildable pad area. Suggested to the applicant that the project extent be reconsidered. 2. Potential grading impacts to the natural terrain, natural vegetation and mature trees and drainage. 3. No apparent view impairment to the northwesterly neighbor as a result of the proposed addition. 4. Additional landscaping should be included to soften visual impact of the northwesterly addition. RECOMMENDATION Upon examining the proposed project and evaluating potential impacts, the Commission must determine that the findings required for site plan review approval as set forth in the ordinance are satisfied. June 9, 1990 1.14 acres gross, Irregular Single family residence swimming pool shape with attached garage, REQUEST: Site Plan Review to determine compatibility of proposed residential additions REVIEW AND EVALUATION OF ISSUES In reviewing the applicant's request under Title 17 (Zoning), staff would identify the following issues for evaluation: 1. The applicant desires site plan review for 1,132 square feet of residential addition that involves increasing the existing structure beyond 25 percent. 2. The proposed additions and retaining wall will comply with required yard setbacks in the RAS-1 zone, and there is no proposal to expand on the existing nonconforming front yard setback. The Commission should evaluate potential view impairment. 3. The project calls for minor grading to an extent of 92 cubic yards of a cut/fill balance in order to expand the pad for proposed construction of a portion of the additions. Contours will not be substantially altered and drainage will occur essentially consistent with the current condition. A retaining wall to a maximum height of five (5') feet is proposed on the to be newly graded slope for stabilization. Landscaping requirements should be addressed regarding retention and/or replacement of vegetation. 4. The issue to require further discussion from the Commission is buildable pad coverage. The subject site was originally developed during the period of smaller setbacks and pads graded for "smaller" residences. The Commission must address the issue of how past developed properties can be expanded and react to present community concerns. Lot coverage totals are not to be exceeded (13.47% structure, 22.50% total). RECOMMENDATION The Planning Commission must determine that the findings required for site plan review approval as set forth by the ordinance are satisfied. The Commission should receive public testimony and continue the matter to an adjourned meeting so as to inspect the site and surrounding properties. zc429rh
