SUBJECT: RESOLUTION NO. 2005-25. A RESOLUTION OF THE
PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
GRANTING A REAR YARD DETERMINATION FOR AN
EXISTING LOT IN ZONING CASE NO. 708A, AT 25
PORTUGUESE BEND ROAD (LOT 89-A-RH), (CHO).
1. The Planning Commission adopted Resolution No. 2005-25, which is
attached, on September 20, 2005 at their regular meeting granting determination
of a rear yard in Zoning Case No. 708A. The vote was 4-0-1. Chairwoman DeRoy
was absent and excused.
2. In April of 2000, the Planning Commission, upon request by the
applicants, made a determination pertaining to location of yards at the property
at 25 Portuguese Bend Road. The lot is irregular in shape.
3. At that time, the Planning Commission determined that the front yard is
located along Portuguese Bend Road, the rear yard is located at the north side of
the lot at the northern terminus of Pheasant Lane, (in the back of the residential
structure and swimming pool) and that all other yards are side yards.
4. The applicants' representative has requested that the rear yard be
designated along the northwestern side of the property, adjacent to Pheasant
Lane, not at the northern terminus thereof.
5. Under a separate application, the property owners applied for a lot line
adjustment between this lot and the lot north thereof, which was approved. The
lot line adjustment straightens out the previously designated rear lot line to be in
line with the line of the northern side yard.
6. Section 17.12.120 of the Zoning Ordinance defines rear lot line as follows:
"Rear lot line means the lot line opposite and most distant from the front lot line;

or in the case of an irregularly shaped lot, a straight line not less than ten feet
long within the lot, and most nearly parallel to and at the maximum distance
from the front lot line".
Section 17.12.250 defines rear yard as follows: "Rear yard means the space
extending across the full width of the lot between the side lot lines, the depth of
which is measured between the rear lot line and the nearest rear line of the
primary building or the nearest line of any enclosed or covered porch. Where a
rear yard abuts a street or a roadway, the depth shall be measured from the
roadway easement".
7. In this case, with the lot line adjustment where the north side property
line was adjusted to be in line with the current rear property line so that the
entire north eastern side of the property becomes a side yard, determining the
northwestern property line as the rear property line would most closely meet the
City's regulations.
RECOMMENDATION
It is recommended that the City Council receive and file this report or provide
other direction to staff.

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. Philip Cho with
respect to real property located at 25 Portuguese Bend Road (Lot 89-A-RH) requesting a
revised determination from the Planning Commission in respect to the location of the
rear yard.
Section 2. On April 18, 2000 the Planning Commission adopted Resolution No.
2000-09 determining the front, side and rear yards on subject property. The rear yard
was determined to be located at the north side of the lot at the northern terminus of
Pheasant Lane.
Section 3. The Planning Commission considered the request at a duly noticed
meeting held on July 19, 2005 and at a field trip visit on August 16, 2005. The applicants
were notified of the meetings in writing by a first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal and from members of
the City staff and the Planning Commission having reviewed, analyzed and studied the
request. The applicants and their representatives were in attendance at the meetings.
Section 4. The Planning Commission hereby determines that the rear yard is
located at the northwesterly side of the property, along Pheasant Lane, and the north
side of the property at the northern terminus of Pheasant Lane, previously determined
to be the rear yard is the side yard.

6. Staff reviewed the Rolling Hills Municipal Code and determined that, if
the lot line adjustment is approved, (Zoning Case No. 707), it would be
reasonable to allow the rear yard to be located along the northeastern side of the
property, as proposed by the applicants.
