A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS GRANTING A VARIANCE TO ENCROACH INTO THE
FRONT YARD SETBACK TO PERMIT A ROOM ADDITION, AN ENTRY AREA,
AND AN ADDITIONTO THE GARAGE IN ZONING CASE NO. 452.
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Ms. Michelle
Mottola with respect to real property located at 7 Flying Mane
Road, Rolling Hills (Lot 51-SF) requesting a Variance to the front
yard setback to permit a room addition, an entry area, and an
addition to the garage to encroach into the front yard setback.
Section 2. The Planning Commission conducted a duly noticed
public hearing to consider the application for Variances on April
16, 1991 and May 21, 1991, and at a field trip visit on May 4,
1991.

Section 3. Sections 17.32.010 through 17.32.030 permit
approval of a Variance from the standards and requirements of the
Zoning Ordinance when exceptional or extraordinary circumstances
applicable to the property and not applicable to other similar
properties in the same zone prevent the owner from making use of a
parcel of property to the same extent enjoyed by similar
properties. A Variance to Section 17.16.060 is required to
construct a room addition, an entry area, and an addition to the
garage in the fifty (50) foot front yard setback. The applicant is
requesting additions that will encroach a maximum of twenty-seven
(27) feet into the front yard setback. The Planning Commission
finds:
A. There are exceptional and extraordinary circumstances
and conditions applicable to the property and the intended use that
do not apply generally to the other property in the same vicinity
and zone. The Variance is necessary because the existing legal
nonconforming residence was built within the front yard setback
and the building pad is located close to the street and adjacent
residences.
B. This Variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone, but which is denied to the
property in question. The Variance is necessary because the
existing development pattern on the lot precludes the requested
additions from being built into the rear yard.
C. The granting of this Variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in the vicinity or zone in which the property is
located. Development on the pad will allow a substantial portion
of the lot to remain undeveloped.

Section 4. Based upon the foregoing findings, the Planning
Commission hereby approves the Variance to encroach into the front
yard setback to construct a room addition, an entry area, and an
addition to the garage to a maximum of 27 feet as indicated on the
Development Plan attached hereto as Exhibit A subject to the
conditions contained in Section 5. The Planning Commission also
finds that the project conforms with the requirements of the
California Environmental Quality Act and is categorically exempt
from environmental review.
Section 5. The Variance to the front yard setback approved in
Section 4, as indicated on the Development Plan attached hereto and
incorporated herein as Exhibit A, is subject to the following
conditions:
A. The Variance shall expire unless used within one year
from the effective date of approval as defined in Section 17.32.110
of the Municipal Code.
B. It is declared and made a condition of the Variance
approval, that if any conditions thereof are violated, the Permit
shall be suspended and the privileges granted thereunder shall
lapse; provided that the applicant has been given written notice
to cease such violation and has failed to do so for a period of
thirty (30) days.
C. All requirements of the Zoning Ordinance and of the zone
in which the subject property is located must be complied with
unless otherwise set forth in the Permit, or shown otherwise on an
approved plan.
D. The lot shall be developed and maintained in substantial
conformance with the Development Plan on file marked Exhibit A
except as otherwise provided in these conditions.
E. The garage shall be screened on the north side property
line with drought -tolerant landscaping approved by the landscaping
consultant.
F. The project must be reviewed and approved by the Rolling
Hills Community Association Architectural Review Committee prior to
the issuance of any building or grading permit.
G. The working drawings submitted to the County Department
of Building• and Safety for plan check review must conform to the
development plan approved with this application.
.H. The applicant shall execute an Affidavit of Acceptance
of all conditions- of this Variance, pursuant to Section 17.32.087,
or the approval shall not be effective.

I. All conditions of this Variance approval, except for
Paragraphs (D) and (E), must be complied with prior to the issuance
of a building or grading permit from the County of Los Angeles.

SILHOUETTE CONSTRUCTION GUIDELINES
1. When required by the Planning Commission or City Council, a
silhouette of proposed construction should be erected for the
week preceding the designated Planning Commission or City
Council meeting. The Silhouette shall not remain erected for
a period longer than one week unless directed by the Planning
Commission or City Council.
2. Silhouettes should be constructed with 2" x 4" lumber.
Printed boards are not acceptable.
3. Bracing should be provided where possible.
4. Wire, twine or other suitable material should be used to
delineate roof ridges and eaves.
5. Small pieces of cloth or flags should be attached to the wire
or twine to aid in the visualization of the proposed
construction.
6. The application may be delayed if inaccurate or incomplete
silhouettes are constructed.

SUBJECT: ORDINANCE N.O. 230; AN ORDINANCE OF THE CITY OF
ROLLING HILLS ESTABLISHING A MINIMUM SIZE FOR STABLES AND
CORRALS AND AMENDING THE MUNICIPAL CODE.
Dear Ms. Mottola:
Please find enclosed a copy of City Ordinance No. 230 adopted by
the City Council on January 28, 1991. This new Ordinance will take
effect on February 27, 1991.
Please note that this Ordinance may affect the progress of the
plans you have submitted because it stipulates that a minimum of
1,000 sq.ft. must be set aside for horsekeeping facilities (a
minimum of 450 sq.ft. for stable and 550 sq. ft. for corral). The
Ordinance further states that the stable and corral must be located
on property having a slope of no greater than 4:1, and that the
stable foot print will be included in calculation of structural
coverage of the lot.
If this new Ordinance does impact your project, you are advised to

1. Proiect Description:
This 40 year old house was built prior to the new planning standard and as such is located
within the 50'-0" front setback standards. As with any old home , particularity one located in a
prosperous and outstanding neighborhood such as Rolling Hills, it is comparatively very dated in
such accepted amenities such as size of bedrooms, bathrooms, closet space, kitchens,
entertainment areas, and garage space. The living space in the home is presently only 2,096
s.f, and has not been remodeled in recent history. The family wishes to add only 440 s.f. to
improve the livability of the home without requiring significant changes. All proposed changes
are quite modest and include a small entry addition and kitchen nook addition, the majority of
which will be under the existing roof.
In addition to the living spaces an additional garage is being proposed. Today a 3-car garage is a
real necessity, and in order to avoid the parking of vehicles on the driveway it is preferable to
have adequate garage parking. As such, a single car garage is proposed in addition to the existing
2-car garage.
It was our attempt to design very modest additions to the old and dated home in order to update it
and modify it to meet our needs and improve the overall condition of the property. It is beyond
our control that the home does not comply with the new standards, however we believe these
improvements will substantially improve the residence for ourselves and the community. As
such we believe our request is not unreasonable and respects the goals of the community plan.
2. Exceotional or extraordinary circumstances;
As stated above, this home was built 40 years ago, prior to the new planning standards. As such
1t 1s impossible to make the modest improvements, which we are requesting.
3. Public Welfac@;,
The existing property has become some what neglected, and it is our intention to improve it in
both appearance and maintenance. In conjunction with the modest addition we plan to Improve
the overall property, which will benefit the overall public welfare. The impact of the addition
will not infringe on the public welfare in any way. Neighborhood privacy will not change, nor
will any views be effected. The project is intended to be a positive contribution to the
community.
