This letter shall serve to notify you that the City Council at their September 26,
2005 meeting received and filed the resolution of approval adopted by the Planning
Commission on September 20, 2005, granting your request for determination of rear
yard.
The Planning Commission determined that the rear yard of your property shall be that
area which is most opposite of the front of the lot, which is along Portuguese Bend
Road.
The attached exhibit and Resolution of approval memorializes the Planning
Commission's action.

RESOLUTION NO. 2005-25
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A REAR YARD DETERMINATION FOR
AN EXISTING LOT IN ZONING CASE NO. 708A, AT 25 PORTUGUESE
BEND ROAD (LOT 89-A-RH), (CHO).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY
FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. and Mrs. Philip Cho with
respect to real property located at 25 Portuguese Bend Road (Lot 89-A-RH) requesting a
revised determination from the Planning Commission in respect to the location of the
rear yard.
Section 2. On April 18, 2000 the Planning Commission adopted Resolution No.
2000-09 determining the front, side and rear yards on subject property. The rear yard
was determined to be located at the north side of the lot at the northern terminus of
Pheasant Lane.
Section 3. The Planning Commission considered the request at a duly noticed
meeting held on July 19, 2005 and at a field trip visit on August 16, 2005. The applicants
were notified of the meetings in writing by a first class mail. Evidence was heard and
presented from all persons interested in affecting said proposal and from members of
the City staff and the Planning Commission having reviewed, analyzed and studied the
request. The applicants and their representatives were in attendance at the meetings.
Section 4. The Planning Commission hereby determines that the rear yard is
located at the northwesterly side of the property, along Pheasant Lane, and the north
side of the property at the northern terminus of Pheasant Lane, previously determined
to be the rear yard is the side yard.

SUBJECT: ZONING CASE NO. 708A and 708B, Request for rear yard determination and
request for a Site Plan Review, Conditional Use Permit and a Variance to construct an addition, a
guest house and a tennis court.
This letter shall serve to notify you that the Planning Commission at their regular meeting on
September 20, 2005, adopted a Resolution granting your request in Zoning Cases No. 708A and
708B. That action, accompanied by the record of the proceedings before the Commission will be
reported to the City Council on Monday. September 26, 2005, at their regular meeting
beainning at 7:30 PM. You or your representative should be present to answer any
auestions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days after the
adoption of the resolution by the Commission, unless an appeal has been filed or the City Council
takes jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of the
Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision will be
stayed until the Council completes its proceedings in accordance with the provisions of the
Municipal Code.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final and you will be
required to cause to be recorded an Affidavit of Acceptance Form together with the subject
resolution in the Office of the County Recorder before the Commission's action takes effect.
A copy of the staff report to the City Council will be forwarded to you on Friday, September 23,
2005. Following the City Council's action, I will mail to you instructions for recordation of the
Affidavit Of Acceptance Form and the Resolution, unless the Council takes the case under
jurisdiction.

Review, Conditional Use Permits and a Variance, (Lot 89-A-RH)
Dear Mr. and Mrs. Cho:
This letter shall serve to notify you that the Planning Commission voted at their regular meeting
on August 16, 2005 to direct staff to prepare resolutions to approve your request in Zoning Case
No. 708A & B and shall be confirmed in the draft resolutions that are being prepared. The
Planning Commission will review and consider the draft resolutions, together with conditions of
approval, at an upcoming meeting on September 20, 2005 and make its final decision on your
application for determination of the rear yard and construction of a guest house, game court and
additions to the existing residence.
The findings and conditions of approval of the draft resolutions will be forwarded to you before the
Planning Commission meeting.
The decision shall become effective thirty days after the adoption of the Planning Commission's
resolutions unless an appeal has been filed or the City Council takes jurisdiction of the case
within that thirty (301 day appeal period. (Section 17.54.010(B) of the Rolling Hills Municipal
Code). Should there be an appeal, the Commission's decision will be stayed until the Council
completes its proceedings in accordance with the provisions of the Municipal Code.
As stated above, the Planning Commission's action taken by resolution approving the
development application is scheduled for Tuesday, September 20, 2005. That action,
accompanied by the record of the proceedings before the Commission, is tentatively scheduled to
be placed as a report item on the City Council's agenda at the Council's regular meeting on
Monday September 26, 2005.

SUBJECT: ZONING CASE NO. 708A and 708B, request for Site Plan Review,
Conditional Use Permit, Variance and determination of the rear yard. (Lot 89-A-RH)
The Planning Commission will conduct a field visit of the above -mentioned zoning cases
on Tuesday. Auaust 16. 2005.
The Planning Commission's schedule is to visit four other properties beginning at 4:00 p.m.
and then proceed to 25 Portuguese Bend Road. Please expect the Planning Commission
and staff at about 5:20-5:30 p.m., unless unforeseen circumstances at the other properties
either delay or speed up the visit. You or your representative(s) must be present to answer
any questions.
The site must be prepared according to the following requirements:
A. Stake/delineate the existing and proposed 50-foot
rear yard setback;
B. A full-size ground silhouette in conformance with
the attached guidelines must be prepared for all
of the proposed structures showing the footprints
and ridge heights, including the future stable;
C. Show/delineate the access to the future stable;
D. Delineate with tape and show height of the
proposed covered porches, and with different
color tape trellis (es), if any, and porte cochere,
if any;
E. Stake the side property line and side setback line
in the area of the proposed sports court;(as it
appears after the lot line adjustment);
F. Stake the sports court;
G. Indicate (i.e. with a ribbon), which trees, shrubs
and other vegetation will be removed as a result
of this project;
H. Delineate the extent of the area to be disturbed,
the toe of the slopes and the cut and fill areas, as

well as the elevation of the finished grade for all
of the proposed structures.
Your neighbors within 1000-foot radius will be notified
of this site visit.
After the field trip, the next Planning Commission meeting will take place on
August 16, 2005, (same night as the field trip), at 6:30 p.m. at City Hall. at which
time the Commission will further discuss and deliberate this project.
