231, Permit an existing accessory b, CorrespondenceJune 11, 1979 Dr. and Mrs. Stanley Wishner 31 Portuguese Bend Road Rolling Hills, California 9.0274 City Council City of Rolling Hills #2.Portuguese Bend Road Rolling Hills, California 90274 Members of the Council: On June 5th, the planning commission denied a variance of the front yard requirement for our acces- sory building #.1 on the basis that the building in its present location is undesirable. We request that the city council take jurisdiction in this matter, assess the situation, and hopefully come to a different conclusion. In reviewing this matter please consider the following: 1. The structure was built in 1944 as a stable and conforms to all ordinances in effect at that time. 2. Because we want to have the structure classified as an accessory building and not a stable in order to construct a new addition to the house, the commission concluded that the structure would loose its non -conforming use classification un- der ordinance #33, Section 5.06 and require a, front yard variance that they did not grant. 3. We have never used the structure for a stable or intend to use it for a stable. (Present use is storage for wood and garden equipment.) 4. A legal stable site is provided for on the site. 5. Although the present location is indicated to be "undesirable," we are unaware of any complaints regarding the building during the 35 years it has been there. 6. If our request is denied, the sturcture can legally remain there as a stable. 7. If our request is approved, it would prohibit • the use of the structure as a stable in such close proximity to the street and adjacent properties. 8. We are willing to make alterations to the building to prevent its use as a -stable, remove the corral fence, and lanscape between the. structure and the street easement as a condition. of approval.
