120, Construct a deck & 7 ft fence , Resolutions & Approval ConditionsBL'ORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGNLES, STATE OF CALIFORNIA In the Matter of the Application ) of Mr, James Langworthy Lot 249-82-UR ) FINDINGS AND REPORT The application of Mr, James Langworthy, Lot 249-B2-UR, Upper Midd.eridge Tract, for a conditional use permit under Section 3.06,. Article III, Ordinance No. 33 came on for hearing on the 17th day of January, 1973'in the 'Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the. applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California, ZONING CASE NO. 120 I. The. Commission finds that the applicant, Mr. James Langworthy, is the owner of that certain real property described as Lot 249* B2'URt UFPer Midd1eridge Tract, located in the City of Rolling Hills, Ca.ifornia, and that notice of the Public hearing in connection with said application was given as required by Sections 8,06 and 8,07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evidence was received by the Commission in opposition there- to. Further, the Commission finds that Mr, J. Merrill Gray, architect, appeared on behalf of Mr. Langworthy, and advised the Commission that he is designing a home with a garden bath, and he considered it necesr nary to construct a deck and screening fence as an.architeotural feature of the homey Ill• The Commission finds further that the applicant requests the con- ditional.use permit for construction 13 feet from the road.. The Qpa mission finds that a conditional use permit should .be granted in . order to preserve substantial property rights possessed by other property in the same vicinity and zone. IV.
