On February 19, 2013, the Planning Commission adopted a resolution, with conditions,
granting your request for a CUP and Variance Zoning Case No. 833. That action, accompanied
by the record of the proceedings before the Commission will be reported to the City Council on
Monday, February 25, 2013 at their regular meeting beginning at 7:30 PM. You or your
representative should be present to answer any questions the Council may have.
Please familiarize yourself with the conditions of the Resolution and if you have any questions
or objections you may appeal the Planning Commission's decision to the City Council. The
Resolution is the same that was mailed to you with the staff report to the Planning
Commission last week.
The Planning Commission's decision in this matter shall become effective thirty days after the
adoption of the resolution by the Commission, unless an appeal has been filed or the City
Council takes jurisdiction of the case within that thirty (30) day appeal period. (Section
17.54.010(B) of the Rolling Hills Estates Municipal Code). Should there be an appeal, the
Commission's decision will be stayed until the Council completes its proceedings in
accordance with the provisions of the Municipal Code.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final and you will be
required to cause to be recorded an Affidavit of Acceptance Form together with the subject
Resolution in the Office of the County Recorder before. the Commission's action takes effect.
The staff report to the City Council, together with the Resolution will be mailed to you on
Friday, February 22, 2013. After the City Council's action, I will forward to you instructions for
recordation of the Affidavit Of Acceptance Form and the Resolution.

This letter shall serve to notify you that the City Council at their regular meeting on February
25, 2013 received and filed the Planning Commission resolution granting your request in
Zoning Case No. 833.
The decision shall become effective thirty days after the adoption of the resolution by the
Planning Commission, unless an appeal has been filed to the City Council within that thirty
(30) day appeal period. (Section 17.54.010(B) of the Rolling Hills Estates Municipal Code).

The approval of this project is valid for two years. Therefore, construction must commence
within that two-year period, unless an extension is requested and approved by the Planning
Commission prior to expiration of this approval.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING APPROVAL OF A SITE PLAN REVIEW
FOR GRADING AND CONDITIONAL USE PERMIT FOR THE
CONSTRUCTION OF A CABANA WITH SUBTERRANEAN STORAGE
AREA AND A SPORTS COURT IN ZONING CASE NO. 833 AT 9
MIDDLERIDGE LANE SOUTH, (LOT 248 C-UR), ROLLING HILLS, CA.
(WAGNER). THE PROJECT HAS BEEN DETERMINED TO BE
CATEGORICALLY EXEMPT PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mr. and Mrs. Keith Wagner with
respect to real property located at 9 Middleridge Lane South (Lot 248 C-UR) Rolling
Hills, requesting Conditional Use Permit for a 558 square foot partially open cabana
with a 405 square foot walk-in subterranean wine cellar, to be located under ground
and behind the cabana, and a 1,350 square foot sports court as well as a Site Plan
Review (SPR) for grading of 198.55 cubic yards of cut and 198.55 cubic yards of fill,
including excavation of the wine cellar and for the wine cellar. The project also includes
outdoor hardscape and landscaping improvements throughout the lot, including new
patio areas, outdoor barbeque, stairs and paths to the lower area of the sports court and
the cabana, various short walls, grape vines on the slopes and on grade walking paths.
Section 2 The Planning Commission conducted duly noticed public hearings
to consider the application on January 15, 2013 in the field and January 15, 2013 at their
regularly scheduled meeting. Neighbors were notified and invited to the hearings. The
applicant and the applicant's representative were in attendance at the hearings. Several
neighbors attended the field trip. The neighbors at 17 Middleridge Lane South
requested that privacy be kept between the properties.
Section 3. The applicants were notified of the above -referenced hearing in
writing by first class mail. Evidence was heard and presented from all persons
interested in affecting said proposal, from all persons protesting the same, and from
members of the City staff. The Planning Commission having reviewed, analyzed and
studied the information found that the project is satisfactory and meets the City's
Conditional Use Permit and Site Plan Review criteria based on the findings enumerated
below.
Section 4. The Planning Commission finds that the project qualifies as a Class
1 Exemption [State CEQA Guidelines, Section 15301(e)] and is therefore categorically
exempt from environmental review under the California Environmental Quality Act.

Section 5. Section 17.16.210(A)(2) of the Rolling Hills Municipal Code permits
approval of a cabana under certain conditions, provided the Planning Commission
approves a Conditional Use Permit. With respect to this request for a Conditional Use
Permit, the Planning Commission finds as follows:
A. The granting of a Conditional Use Permit for the cabana would be
consistent with the purposes and objectives of the Zoning Ordinance and General Plan
because the use is consistent with similar uses in the community, meets all the
applicable development standards of the Zoning Ordinance and no deviations from the
development standards are requested.
B. The nature, condition, and development of adjacent uses, buildings, and
structures have been considered, and the construction of a cabana will not adversely
affect or be materially detrimental to these adjacent uses, buildings, or structures
because the cabana is of sufficient distance from nearby residences so that the cabana
will not impact the view or privacy of surrounding neighbors.
C. The project is harmonious in scale and mass with the site, the natural
terrain, and surrounding residences because the cabana complies with the low profile
residential development pattern of the community, will be mostly located on an existing
building pad and will be screened from neighbors' view.
D. The proposed conditional use complies with all applicable development
standards of the zone district because the 558 square foot size of the cabana does not
exceed the maximum permitted under the Municipal Code and the cabana does not
encroach into any setback areas and is not located in the front. Underground storage
areas have historically been allowed, because they are not visible from the outside.
E. The proposed conditional use is consistent with the portions of the Los
Angeles County Hazardous Waste Management Plan relating to siting criteria for
hazardous waste facilities because the project site is not listed on the current State of
California Hazardous Waste and Substances Sites List.
F. The proposed conditional use observes the spirit and intent of Title 17 of
the Zoning Code because the proposed project meets all of the development standards
of the Zoning Regulations and has an existing stable, corral and access thereto. Minimal
grading is necessary for construction of the cabana and the structure will not be
obtrusive to neighbors.
G. The project conforms to the requirements of the California Environmental
Quality Act and is exempt.
Section 6. Section 17.46.030 requires a development plan to be submitted for
Site Plan Review and approval before any grading requiring a grading permit or any

Dear Mr. and Mrs. Wagner,
Pursuant to state law the City's staff has completed a preliminary review of the
application noted above and finds that the information submitted is:
X Sufficiently complete as of the date indicated above to allow the application to be
processed.
However,
1. a landscaping plan showing type of plants that would screen the court on all four
sides, as required by the Zoning Code, must be submitted prior to the Commission
acting on the case.
2. 7 sets of accurate and complete plans must be submitted to the City by January
8, 2013.
3. Pictures of the interior and exterior of the existing stable, to ascertain if the stable
structure meets City's requirements for stable and corral. The structure does not have to
be used for a stable; it could be used for storage. However, it must look on the inside
and outside like a stable.
Please note that the City may require further information in order to clarify, amplify,
correct, or otherwise supplement the application. If the City requires such additional
information, it is strongly suggested that you supply that information promptly to avoid
any delay in the processing of the application. Additionally, should the field visit reveal
conditions that are not on the plan submitted by your agent, the plans will have to be
revised.
Your application for Zoning Case No. 833 has been set for public hearing consideration
before the Planning Commission at their meeting on Tuesday.. January 15. 2013. The
meetina will start in the field (at your property) at 7:30 am. The proiect must be
staked as per the enclosed instructions.
The meeting will continue to 6:30 PM in the Council Chambers, Rolling Hills City Hall
Administration Building, 2 Portuguese Bend Road, Rolling Hills. You or your designated
representative must attend to present your project and to answer questions.
The staff report for this project,will be available at the City Hall after 3:00 PM on Friday,
January 11. We will forward the report to you and your representative.

SILHOUETTE REQUIREMENTS
The owner and/or representative must be present at the field trip and the evening
meeting to answer questions regarding the proposal. The project must be staked a
minimum of a week prior to the meeting as follows:
• A full-size silhouette in conformance with the attached
guidelines must be prepared for the project showing
the footprint of the sports court, cabana and if
possible the wine cellar and hei,ght of any walls
and/or fence for these structures;
• Stake the ridge line of the cabana
• Stake/show the access to the wine cellar
• Delineate and/or stake to the greatest ability possible
the wine cellar
• Stake/delineate limits of grading
• Show/delineate new patio areas
• Show/stake all new walls, including their heights from
finished grade
After the field trip, the next regular meeting of the Planning Commission will take place on the
same day, Tuesday. January 15. 2013 at 6:30 PM at City Hall, at which time the Commission
will further discuss and deliberate your proposal.

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 2 1/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
