To refresh your memory, I am including the correspondence sent to Robertson's by Juge Deign & Construction dated 10-10- 11. There are two outstanding issues that need to be resolved. They are separate and independent of one another and are outlined as follows: Issue Number One — Concrete spill on the roadway: On September 30th when your trucks delivered concrete to the job site they spilled concrete on the street that left a trail of concrete for about a quarter of a mile beginning at Dr. & Mrs. Weinstein's home. Robertson's made attempts to clean up the spilled concrete but the street still has not been restored to pre spill conditions. The attempted clean up in front of Dr. Weinstein's home is particularly bad and the street has been reduced to a "gravel road" type of surface. The Weinstein's are particularly upset and I have told them I am attempting to get the road repaired to pre spill conditions. The clean up accomplished to date may be acceptable to standards for a roadway in the industrial section of San Pedro but this is a private community of homes where people take great pride in the maintenance and upkeep of their property. Should you wish to contact Mrs. Weinstein directly to discuss further and/or offer an apology, she can be reached at the number I previously gave you (310-540-1953). The maintenance of the private roads in this community is under the direction of our Association Manager, Kristen Raig. You will need to coordinate with her to resolve the road repair issue. Issue Number Two — Deduction of Expenses from your billing: Please refer to the attached letter from John Juge detailing the deductions that were made to your invoice for the additional expenses incurred by us due to the gross failure of Roberson's to deliver the concrete on a timely basis. For the record we feel very justified in eliminating these expenses from the bill as I have previously stated in our conversations. In addition to what was deducted we incurred additional costs in subsequent attempts to repair the road damage which we did not seek reimbursement for to date. I have told John Juge under no circumstances do I intend to pay the costs which were deducted from your invoice. Hopefully you will concur after re -reading his attached correspondence. I stopped by the office the other day and was told that since this was a new construction vs. a remodel project there was no need for a Recycling plan per se. I would like to provide the inspector an approval letter from you related to our recycling efforts for this project. You are correct that there is very little waste and trash being produced during the construction process. The major by product is wood scraps generated when the framing lumber is cut to dimension. All of that wood has been put in a pile and generally at the end of the day the construction crew takes it home to be used as firewood. The plastic water bottles and aluminum coke cans are put in the blue box for Waste Management during their regular pick up schedule. Other than those main items very little trash is generated and what little trash is generated I put in my regular trash cans for Waste Management. The other major trash was all the forming lumber used to form and pour the concrete foundation. Those materials were given to a friend of mine who lives in RPV to construct storage shed at his house. If this letter satisfies the recycle obligation, I would appreciate your acceptance below so that I can provide this to Mr. Kellogg. Thank you for your attention to this matter. Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable. Bracing should be provided. Lumber, wire or other suitable material should be used to delineate roof ridges and eaves. Flags in close proximity to each other must be attached to the wire or twine to aid in the visualization of the proposed construction. Property lines, setback lines and easement lines must be staked along the areas of construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must be flagged and marked on their sides: • Property line ( red or pink flag) • Setback line (green flag) • Easement line (yellow flag) and remain in the ground throughout the entire review and approval process as well as during the entire construction process, when required by the Commission.
