It has been over two weeks since we last spoke concerning the above referenced job order and
I have not heard back from you related to the resolution. To refresh your memory, I am
including the correspondence sent to Robertson's by Juge Deign & Construction dated 10-10-
11. There are two outstanding issues that need to be resolved. They are separate and
independent of one another and are outlined as follows:
Issue Number One — Concrete spill on the roadway:
On September 30th when your trucks delivered concrete to the job site they spilled concrete on
the street that left a trail of concrete for about a quarter of a mile beginning at Dr. & Mrs.
Weinstein's home. Robertson's made attempts to clean up the spilled concrete but the street
still has not been restored to pre spill conditions. The attempted clean up in front of Dr.
Weinstein's home is particularly bad and the street has been reduced to a "gravel road" type of
surface. The Weinstein's are particularly upset and I have told them I am attempting to get the
road repaired to pre spill conditions. The clean up accomplished to date may be acceptable to
standards for a roadway in the industrial section of San Pedro but this is a private community of
homes where people take great pride in the maintenance and upkeep of their property. Should
you wish to contact Mrs. Weinstein directly to discuss further and/or offer an apology, she can
be reached at the number I previously gave you (310-540-1953). The maintenance of the
private roads in this community is under the direction of our Association Manager, Kristen Raig.
You will need to coordinate with her to resolve the road repair issue. She can be reached at
310-544-6222.
Issue Number Two — Deduction of Expenses from your billing:
Please refer to the attached letter from John Juge detailing the deductions that were made to
your invoice for the additional expenses incurred by us due to the gross failure of Roberson's to
deliver the concrete on a timely basis. For the record we feel very justified in eliminating these
expenses from the bill as I have previously stated in our conversations. In addition to what was
deducted we incurred additional costs in subsequent attempts to repair the road damage which
we did not seek reimbursement for to date. I have told John Juge under no circumstances do I
intend to pay the costs which were deducted from your invoice. Hopefully you will concur after
re -reading his attached correspondence. In order to resolve this issue you should contact Mr.
John Juge directly. His contact number is 310-874-3834.

accordingly to get both matters resolved.

Richard Kellogg, the County Inspector stopped by the other day and mentioned I needed to contact you
regarding obtaining some sort of Recycling Plan for the waste generated in the barn construction
project. I stopped by the office the other day and was told that since this was a new construction vs. a
remodel project there was no need for a Recycling plan per se. I would like to provide the inspector an
approval letter from you related to our recycling efforts for this project.
You are correct that there is very little waste and trash being produced during the construction process.
The major by product is wood scraps generated when the framing lumber is cut to dimension. All of
that wood has been put in a pile and generally at the end of the day the construction crew takes it home
to be used as firewood. The plastic water bottles and aluminum coke cans are put in the blue box for
Waste Management during their regular pick up schedule. Other than those main items very little trash
is generated and what little trash is generated I put in my regular trash cans for Waste Management.
The other major trash was all the forming lumber used to form and pour the concrete foundation.
Those materials were given to a friend of mine who lives in RPV to construct storage shed at his house.
If this letter satisfies the recycle obligation, I would appreciate your acceptance below so that I can
provide this to Mr. Kellogg.

Dear Mr. Johnson:
This letter shall serve to notify you that the City Council at their regular meeting
on February 28, 2011, received and filed the Planning Commission's resolution
granting your request in Zoning Case No. 797.
The decision shall become effective thirty days after the adoption of the
resolution by the Planning Commission or on March 17, 2011 unless an appeal
has been filed within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's
decision will be stayed until the Council completes its proceedings in accordance
with the provisions of the Municipal Code.
Before this case takes effect you are required to cause to be recorded an Affidavit
of Acceptance Form, accepting all of the conditions of the resolution, together
with the subject resolution in the Office of the County Recorder.
Please assure that you and your contractor are familiar with the conditions of
approval and place them on the front sheet of the plans to be reviewed by the
Building and Safety Department and on all working drawings, including job site
plans. You now have a choice of Building Departments for plan check
processing, issuance of permits and inspections. You could submit to L.A.
County or Willdan Engineering.
I have enclosed a copy of RESOLUTION NO. 2011-02, specifying the conditions
of approval set forth by the Planning Commission and the approved
Development Plan to keep for your files. Please complete the enclosed

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES

Section 1. Application was duly filed by Mr. Kenneth Johnson with respect
to real property located at 29 Middleridge Lane South (lot 248-A-1-UR) requesting a
Conditional Use Permit to construct a stable with a loft and corral and a Variance to
allow the stable and corral to be located in the front yard setback. The first story of the
stable is proposed to be 2,160 square feet and the loft is proposed to be 800 square feet
including a 160 square foot catwalk, for a total building area. of 2,960 square feet. The
proposed loft area would be 27% of the building area. The corral area is proposed to
be 1,880 square feet.
Section 2 This proposal is subject to the recently adopted stable ordinance,
which requires that all new stables over 200 square feet and corrals over 550 square
feet be reviewed under the Conditional Use Perrnit process. A Variance is required
due to the proposed location of the stable and corral. All but 50 square feet of the stable
is proposed to be located in the front setback and will encroach between 38 feet 25 feet
into the required front setback.
Section 3. In 1996 a Site Plan Review and Variance approval was granted to
the applicant for a 1,200 square foot addition to the residence and for a 3,200 square
foot new stable with a loft and corral, both encroaching into the front yard setback. At
some point prior to 1996, the area where the then stable was proposed was graded.
Section 4. In 1997, the applicant obtained a grading permit for house addition
and remediation of land around the residence. The remediation and grading for the
addition were completed. The improvements were not constructed. In 2000 a
modification to the original request was granted to construct the residential addition
and a 2,600 square foot stable with a loft. Permission to retain an unauthorized graded
area below the residential building pad was also granted. The grading was reviewed
and approved by the County and final inspection was granted in 2002. The applicant
has not constructed the addition or the stable.

This letter shall serve to notify you that the Planning Commission adopted a resolution,
which is enclosed, on February 15, granting your request for a Variance and Site Plan

record of the proceedings before the Commission will be reported to the City Council on

The Planning Commission scheduled to conduct a field inspection of your property to
view the proposed project on Tuesday, January 18, at 7:30 AM.
The owner and/or representative must be present to answer any questions regarding the
proposal.
The site shall be prepared according to the enclosed Silhouette Construction Guidelines
and the following requirements:
A full-size silhouette in conformance with the attached guidelines must be prepared
for THE STABLE INCLUDING THE LOFT, showing the footprints, roof ridges and
exterior walls;
• Stake the extent of the corral;
• Stake the front roadway easement and front setback lines
• Stake the access road to the stable and indicate percent of slope;
• Show the location of any proposed drainage devices
• If the drainage devices are already in, make sure they are visible to the Commission
After the field trip, the next regular meeting of the Planning Commission will take place
on Tuesday, January 18, 2011 at 6:30 PM at City Hall, at which time the Commission will
further discuss your project.

SILHOUETTE CONSTRUCTION GUIDELINES
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.
