FINDINGS AND REPQRT
The application of Mr, Robert Volk, Lot 53-EF, Eastfield Trac,
for a variance of Front yard,Requirecnepts under Section 3.06 and
Side Yard Requirements under Section 3.07, Article III of Ordinance
No, 33 Game op for hearing on the 24th day of October, 1972 in the
Council Chambers of the Administration Building, 2 Portuguese Bend
Road, Rolling Hills, California, and the applicant, having submitted'
evidence in support of the application, the Planning Commission,
being advised, now snakes its Findings and Report as required by the
Ordinances of the City of Rolling Hills, California.

The Commission finds that the applicant, Mr. Robert Volk,. is
the owner of that certain real prope'ty described as Lot 53-EF,
Eastfield Tract, located in the. City of Rolling Hills, California,
and that notice of the public hearing in connection with acrid apPlir
cation was given as required by Sections 8.06 and 8.07 of Ordinance:
No. 33 of the City of Rolling Mills, California.

The Commission further finds that no person appeared at sa1d
public hearing in opposition to the application for a variance, and
that no evidence was received by the Commission in opposition thereT
to.
III.
The Commission further finds that the applicant requests the
variances to construct a tennis court in front of his residence
which would project 10 feet into the side yard, but would preserve
the 10 foot trail easement. The applicant has stated that the
site of the court is 45 feet below grade level, of Eastfield Hrive
the area to the rear of the residence is fully developed apd land-
scaped, and he considers it detrimental to the concept of best use
of the property to attempt to locate the tennis court in a developed
area. The Commission finds that variances to permit construction pf
a tennis court in the front yard and projecting 10 feet intothe side'
yard should be granted in order to preserve substantial property
rights possessed by other property in the same vicinity and zone.
IV.
From the foregoing it is concluded that a variance pf Front Yard
Requirements under Section 3.Q6 and Side Yard Requirements under
Section 3.07, Article III of Ordinance No. 33 should be granted by
the Planning Commission of the City of Rolj.ing Hills to Mr. Robert
Volk, Lot 53-EF, Eastfield Tract, in accordance with the plot plan
marked Exhibit I on file in these proceedings, and it is, therefore:.
