FINDINGS AND REPORT
The application of Mr. & Mrs. Orrin Pollock, Lot 170C-6-MS,
Rolling Hills Tract, for a Conditional Use Permit under Section
17.32.040 of the City of Rolling Hills Municipal Code, came for
public hearings on the 18th day of November, 1986, andithe 16th day
of December 1986, in the Council Chambers of the Administration
Building, 2 Portuguese Bend Road, Rolling Hills, California. The
Planning Commission, after being appropriately advised, now makes
its Findings and Report as required by the Municipal Code of the
City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Orrin Pollock,
is the owner of that certain real property described as Lot
170C-6-MS, located at 5 Morgan Lane in the City of Rolling
Hills, and that notice of the public hearing in connection with said
application was given as required by Section 17.32.080 of the
Municipal Code of the City of Rolling Hills, California. The
Commission finds, further, that no comment, written or verbal, was
received in opposition to the request.
II.
The Commission finds that the applicant has requested a
Conditional Use Permit for a guest house as required by Section
17.16.012 (F). The applicant has requested the construction of a
780 square foot guest house on property located at 5 Morgan
Lane. The applicant was reminded of the conditions of approval
for a guest house as set forth in a memorandum dated March 18,
1980.
The Commission finds that there are not significant topographical,
environmental, or physical conditions which exist on the
property which impinge upon the applicant's ability to fully
utilize the property for purpose of constructing a guest house. The
Commission finds that a Conditional Use Permit should be granted
subject to the conditions established and determined, by the
Commission.
III
From the foregoing, it is concluded that a Conditional Use.
Permit be granted to Mr. Orrin Pollock, Lot 170C-6-MS, 5 Morgan
Lane, under Section 17.32.040 of the City of Rolling Hills Municipal
Code for a Conditional Use Permit pursuant to Section 17.16.012 (F)
for a 780 square foot guest house, subject to the following
conditions: 1) The eleven. (11) conditions set forth in the attached
memorandum dated March 18, 1980; 2) Condition number 8 in the March
18, 1980 memorandum is modified to read as follows: The landscaping
plan be approved by the Planning Commission, and a bond in the
amount of estimate for the cost of landscaping, plus 15%, be posted
after landscape installation, for not less than two years. The
Conditional Use Permit, is therefore, so ordered. This approval
shall expire after one year, if not used.

41CONDITIO S OF APPROVAL 4111
GUEST HOUSES/SERVANTS' QUARTERS
While a complete list of conditions cannot be recommended until a
public hearing has been held and all testimony taken, the following
list of conditions pertaining to guest houses/servants' Quarters is
provided:
1. This Conditional Use Permit shall not be effective for any
purpose until the owner of the property involved, or his duly
authorized representative, has filed with the City Clerk of
the City of Rolling Hills an affidavit stating that he is
aware of and agrees to comply with all the conditions of the
Permit.
2. It is declared to be the intent of .the Planning Commission that
if any provision of the Permit is held or declared to be invalid,
the permit shall be void and the privileges granted thereunder
shall lapse.
3. It is declared and made a'condition of the Permit that if any
conditions thereof are violated, or if any law, statute or
ordinance is violated, the Permit shall be suspended and the
privileges granted thereunder shall lapse; provided that the
applicant has been given written notice to cease such violation
and has failed to do so for a period of thirty (30).days.
4. All requirements of the Zoning Ordinance and of the zone in
which the subject property is located must be complied with
unless otherwise set forth in the Permit, or shown otherwise
on an approved plan.
5. The property shall be developed and maintained in substantial
conformance with the site plan on file marked Exhibit "A".
except as otherwise provided in these conditions.
6. No vehicular access or paved parking area be developed within
fifty (50) feet of the proposed guest house or servants' quarters.
7. Occupancy of the proposed guest house or servants' quarters be
limited to persons employed wholly on the premises and their
immediate families, or by the temporary guests of the occupants
of the main residence. No guest may remain in continuing
occupancy for more than thirty days in any six month period.
8. Landscaping, irrigation plans and bonding may be required of the
applicant where applicable, to the satisfaction of the Planning
Commission.

9. Prior to issuance of building permits a grading plan, if necessary,
satisfactory to the City Engineer shall be submitted.
10. Renting of guest houses or servants' quarters is prohibited.
11. No sleeping quarters are permitted in cabanas or recreation rooms.
This Conditional Use Permit shall expire unless used within one year
from the date of grant.
