A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ROLLING HILLS APPROVING A FRONT YARD AND SIDE YARD
SETBACK VARIANCE IN ZONING CASE NO. 372
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES FIND AND
RESOLVE AS FOLLOWS:
Section 1. An application was duly filed by Chacksfield
Merit Homes for a variance from the minimum front yard and side yard
setback requirements, at 8 Morgan Lane (Lot 170-5-MS), Rolling Hills,
California. The application seeks a variance to allow a for the
construction of a portion of a retaining wall that, in turn, creates
an on -site parking area, for a new residence. The proposed front yard
encroachment is 25 feet and the proposed side yard encroachment is 7
feet.
Section 2. The Planning Commission opened the public hearing
on October 18, 1988 and continued it to November 15, 1988. A duly
noticed field trip was conducted, to which the applicant and all
members of the public were invited. the Commission has considered the
evidence, both written and oral, presented to it in connection with
this application.
Section 3. In accordance with Sections 17.32.010 through
17.32.030 of the Municipal Code, the City Council finds as follows:
1. The subject property is exceptional in that it is a
recently created building site. The property has a relatively steep
slope grade. And, the site is located on a cul-de-sac, which creates a
narrowing of the front yard, from side yard to side yard. The proposed
variances from setback minimums are intended to reduce, to a minimum,
the amount of grading and disturbance of the natural slope contours
and the natural vegetation that will be necessary to create a building
pad.
2. Approval of the variances does not give to the applicant
a special privilege because it merely allows for the constructing of a
low -profile retaining wall that will allow for the provision of an
on -site parking area, in the residential building and garage area. The
proposed residential building structure will be located in accordance
with minimum setback requirements.
3. The variances are necessary to the applicant's ability
to enjoy his property to the same extent as other similar properties
in the same vicinity and zone. It will permit the applicant to
construct a new residential building, in accordance with a design plan
that maximizes the building pad area, while minimizing the area to be
graded; and, the disturbance of the natural slope and native
vegetation.

Section 4. In accordance with the foregoing findings, the
variances from the minimum front yard and side yard setback
requirements applied for in Zoning Case No. 372, are hereby approved.
