RE: ZONING CASE NO. 377, I.S.C.O., 4 MORGAN LANE
The development plan submitted, with the conditional use permit
applications for a tennis court and a guest house, proposes an intense
development pattern. The structural lot coverage square footage is
17,884, which is 19.19% of the net lot area of 93,218 square feet
(2.14 acres). The flatwork/hardscape lot coverage is 11,494 sq. ft.,
which is 12.33% of the net lot area. The total lot coverage is 29,378
sq. ft., which is 31.52% of the net lot area.
The development plan is characterized as being substantially an urban
estate in design and use patterns. This type of design and development
plan is not compatible with rural character that the City's General
Plan seeks to enhance and preserve. The intensity of the proposed lot
coverage is incompatible with the residential uses in the surrounding
area; and, would result in overdevelopment of the lot inconsistent
with the rural character of the community.
The elevation of the building pad, on the subject lot, is
substantially higher than the other lots located in the immediate
vicinity. As a result, the viewscape of the neighboring properties and
the viewscape of those who utilize the communities easements will be
adversely impacted or impaired, even with landscape mitigation
measures. In fact, the landscape proposed for the subject site will
further create an urban estate character to the site development
rather than one of a rural, natural character. Therefore, the site
development plan would not be consistent with the General Plan or
compatible with the purpose of the Zoning Ordinance.
The Planning Commission findings for denial of the conditional use
permit applications were were based upon the rationale discussed in
paragraghs 2 and 3 above.
