Describe and delineate on plans any new basement area square footage .4//"X • • PLUIMER RESIDENCE One Lower Black Water Canyon Road January 14, 2008 VARIANCE REQUEST The Variance Request consists of the permission to remodel and expand the existing breakfast area; a new Trellis covered path to the breakfast area; and a 2'6 buffet expansion of the new dining area. The existing residence, patio covered trellis and bbq area exist within the current roadway easement and required set -back. This new request would state a maximum of 4' encroachment into the roadway easement to allow for a trellis column, in the path to the breakfast area. The existing trellis over the patio and bbq area are are currently encroaching 13' into the existing 60" roadway easement. It is important to note that Mr. Pluimer is working with the Board of Directors on a relocation and reduction of the easement to the center of the existing road which would correct the placement of the easement and eliminate any encroachment and set -back. Upon several discussions in which the Community Association and the Board of Directors are in support of this adjustment, time is of the essence and we are required to file for this variance in order to keep this project moving. It is estimated that it will take at least 6 months to record the Easement relocation. A copy of the proposed easement relocation diagram is provided attached. SITE PLAN REVIEW CRITERIA Site plan review criteria upon which the Planning Commission must make an affirmative finding. Describe in detail the project's conformance with the criteria below: A. Is the project compatible with the General Plan, the Zoning Ordinance and surrounding uses? Explain how it compares to the sizes, setbacks and other characteristics of neighboring houses. • B. How does the project preserve and integrate into the site design, to the maximum extent feasible, existing natural topographic features of the lot including surrounding native vegetation, mature trees, drainage courses, and land forms (such as hillsides and knolls)? This variance request proposes a maximum of 4' encroachment into the roadway easement to allow for a trellis column, in the path to the breakfast area. A large portion of the existing house exists within the required set -back, and the existing trellis over the patio and bbq area are currently encroaching 13' into the existing 60' roadway easement. This condition existed prior to the purchase of this property and not to the knowledge of Mr. & Mrs. Pluimer. Upon discussing the proposed improvements with the Planning Department, and Community Association, we concluded that the existing roadway easement does not align with the existing paved road and it is very close to the existing house which consequently causes a major portion of the house to be inside the existing roadway set- back of 20'. Besides the issue of having a non -conforming existing condition, the current easement location prevents any improvements on that side of the house The existing residence, patio covered trellis and bbq area exists within the current roadway easement and required set -back. Once again, upon additional discussions with the Planning Department and the Community Association, we concluded that the easement location does not make any sense and should be relocated to the center of the existing driveway, which ultimately would resolve any non -conforming issues and allow Mr. & Mrs. Pluimer more flexibility in any intended improvements. Unfortunately, this exercise takes a considerable amount of time and would preclude Mr. & Mrs. Pluimer to pursue their project without a Variance. It is important to note that Mr. Pluimer is currently working with the Board of Directors on the relocation and reduction of the easement to the center of the existing road, which would correct the placement of the easement and eliminate any encroachment and set- back issues. It is estimated that it will take at least 6 to 8 months to record the Easement relocation. A copy of the proposed easement relocation diagram is provided attached.
