Dear Roy:
We have received the enclosed letter from Criss Gunderson, project architect, informing
us that the applications for plan check for the proposed development of a single family
residence and stables at 3 Appaloosa Lane have expired. We have reviewed the letter
explaining the circumstances of this case and would like you to consider an extension of
all related plan check applications for a maximum of six months, without assessing the
applicant additional fees.
The City's approval of this case expires in November 2006. The applicant is required to
commence grading and/or construction on the property on or before November 21, 2006,
or the case will become null and void. Pursuant to the Zoning Ordinance, no further
extensions may be allowed. Therefore, we would support your consideration for
extending the plan check applications to allow the applicant to complete the plan check
process, and proceed with the project, so that grading and building permit can be issued
prior to November 21, 2006.

Dear Ms. Schwartz,
As we discussed yesterday, I have been informed by the building department that Dr.
Fozoomnehr's permit applications for building and safety, and I believe soils and geology as well
as grading, have expired. If you recall, we were granted a 6 month extension by building and
safety. Mr. Itoni, the manager of the Lomita district office, has informed me that there are no
other vehicles available in the building code which allows for any additional extensions. But he
does believe he may be able to grant us an additional extension should the city support such a
request.
Our geologist has been drilling additional borings for investigation as requested by the county.
The results have been very promising. We believe that in approximately one month the response
to the county will be complete. At that time, the grading plan will most likely have to be revised
to reflect the updated geological information with regards to mitigation measures for the ancient
landslide on the property. I\Ir. I\Ic1-Iattie will update you on any revisions relative to the
originally approved grading design by the planning commission. Should the revisions not be a
large deviation from the original design, and you can support the changes, we believe that before
the end of the. year a complete package can be resubmitted to the county, and the review process
continued.
Attached is a copy of the original fee receipts from the county. As you can see, Dr. Fozoomnehr
has very large investment in plan check fees. It would be greatly appreciated if you would
contact the county, and request that all related plan check applications be granted an extension
to allow Dr. Fozoomnelu• to complete the process without experiencing any additional costs from
the county.

Dear Dr. and Mrs. Fozoonmehr:
As you know, your approval in Zoning Case No. 669 would have expired on November 21, 2005,
unless grading or construction commenced prior to that date. A new provision of the Zoning
Code pertaining to time extension of zoning cases took effect on December 22, 2004. This
provision established an opportunity for applicants to request a two-year time extension of their
cases, rather than one year as previously allowed. Staff made an administrative policy to afford
those cases with one-year extensions the same benefit of two years extensions as other cases
that were approved after the code amendment took effect.
This letter is to notify you that the City Council at their August 22, 2005 meeting upheld staff's
administrative policy to extend your case, as well as several other cases for one more year.
Therefore, please note that the approval for grading and construction of a new residence and
stable will expire on NOVEMBER 21. 2006, unless grading or construction commences
prior to that date.
Please be advised that prior to obtaining a grading or building permit, you must satisfy several
conditions of the original Resolution, Resolution No. 2003-19, including submission to Planning
Department of a landscaping plan and a security deposit for the landscaping. Please review
these conditions.

I understand that the above referenced application will expire on May 8, 2005. Do to situations
out of my control., the building plan check application has been delayed. As we discussed, the
building site has not been approved by Geology and Soils at this time. Our ability to respond
timely to the concerns of the 'Materials Engineering division has been affected by the extreme
rains we have experienced over the last 6 months. Currently our response is in the hands of
Materials Engineering.
It would be greatly appreciated by my clients, the Fozoonmehrs, if you would extend the plan
check application so that we may wait for approvals from the Materials Engineering division
with out incurring additional costs or fees. Once geology, soils and grading have been approved,
I will move as quickly as possible to complete the building plan check process.

THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. A request has been filed by Dr. and Mrs. Fozoonmehr with respect
to real property located at 3 Appaloosa Lane (Lot 246-MS), Rolling Hills requesting an
extension to previously approved Site Plan Review to permit grading and construction
of a new residence and a stable.
Section 2. The Commission considered this item at a meeting on November 16,
2004, at which time information was presented indicating that additional time is needed
to process the development application through the County departments.
Section 3. Based upon information and evidence submitted, the Planning
Commission does hereby amend Paragraph A, Section 9 of Resolution No. 2003-19,
dated October 21, 2003, to read as follows:
"A. The Site Plan Review approvals shall expire within two years from the
effective date of approval, unless work commences within that time period, as defined in
Section 17.46.080 of the Zoning Ordinance."
Section 4. Except as herein amended, the provisions of Resolution No. 2003-19
shall continue to be in full force and effect.

Dear Dr. and Mrs. Fozoonmehr:
Please be informed that the Landscape Plan for bond calculation for Zoning Case No.
669 has been APPROVED.
The City, with the landscape consultant has determined that the cost provided by you for
materials and labor appear accurate. Therefore, in accordance with Resolution No.
2003-19, Section 9, Condition "M" and "N" a bond/security deposit/Certificate of Deposit
in the amount of $48,307.90 (naming the City as the beneficiary) shall be deposited with
the City. This includes the cost of material and labor plus 15%.
The bond shall be retained with the City for not less than two years after landscape
installation. The retained bond will be released by the City Staff after staff determines
that the landscaping was installed pursuant to the landscaping plan as approved, and
that such landscaping is properly established and in good condition.
In addition, please assure (as required by condition "M"), that those new avocado trees,
if any, located at the level of .the finished grade of the residence or stable do not exceed
25 feet in height, and that those trees located on slopes do not grow higher than 25 feet
above the finished grade of these structures.
During installation of the landscaping, please maintain records of when the landscaping
was installed, so that you can know when to contact the City for the release of the bond.

Dear Planning Commission:
This letter is sent as a response to the letter dated August 25th, 2004 sent to our residence
in regards to zoning case number 669. We are writing to request a one year extension on
the approval simply because it would be impossible for us to commence grading or
construction by the current deadline of November 21st, 2004.
The planning portion of the development process has been held up by the County of Los
Angeles, as a number of minor changes have had to be made to the plans as a direct result
of requests made by the County. These factors, along with others which have been out of
our control have led to a slight delay in the project schedule.
We sincerely apologize for having to make this request, however, as you can undoubtedly
see; we have no choice in the matter. Projections can only take one so far, and they are
not infallible.

Dear Dr. and Mrs. Fozoonmehr:
This letter shall serve to notify you that the Planning Commission adopted Resolution No.
2003-19 on October 21, 2003, granting a request for a Site Plan Review to permit
construction of a new single family residence and stable which require grading. That action,
accompanied by the record of the proceedings before the Commission was reported to the
City Council on October 27, 2003.
At the Council meeting, the City Council directed staff to clarify condition No. AD (page 6) of
the Resolution to state as follows: "The trails shall not be altered or modified in any way
without the approval of the Rolling Hills Community Association and Caballeros".
Currently condition AD (page 6) of the Resolution states: "The Rolling Hills Community
association with input from Caballeros shall approve any modification to the existing trail".
The Planning Commission's decision in this matter shall become effective thirty days after
the adoption of the resolution by the Commission, unless an appeal has been filed or the
City Council takes jurisdiction of the case within that thirty (30) day appeal period.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's resolution, the Planning Commission's action will become final and you will be
required to cause to be recorded an Affidavit of Acceptance Form together with the subject
resolution in the Office of the County Recorder, before the Commission's action takes effect.
Please find enclosed a copy of the Resolution and an Affidavit of Acceptance Form. Please
complete the AFFIDAVIT OF ACCEPTANCE FORM, have the signature(s) notarized, and
forward (or hand deliver) the completed form and the Resolutions to:

At the regular meeting of the Rolling Hills Traffic Commission held Thursday,
September 25, 2003, the Traffic Commission considered the proposed driveway for the
new residence to be located at 3 Appaloosa Lane.
Members of the Traffic Commission have recommended the following conditions be
included in the resolution of approval that will be presented to the Planning
Commission on October 21, 2003. These conditions include:
► That the driveway apron will be 20 feet in width, however, that it will be located 10
feet to the northeast from its original proposed location.
► That a 5-foot radius will be incorporated into each side of the driveway as it meets
the roadway.
► That the applicant will cause the removal of 3 oleander bushes uphill on the
opposite side of the roadway from the driveway entrance.
Rolling Hills Community Association Architectural Inspector Roger Vink attended the
field trip. He reported that the oleanders are within the easement and can be removed.
We suggest you contact Roger Vink regarding any approvals that might be required
for the removal of these oleanders.

Review for grading and construction of a new single-family residence on a vacant lot.
Dear Dr. and Mrs. Fozoonmehr:
This letter shall serve to notify you that the Planning Commission voted at their regular meeting
on September 16, 2003 to direct staff to prepare a resolution to approve your request in Zoning
Case No. 669 and shall be confirmed in the draft resolution that is being prepared. The Planning
Commission will review and consider the draft resolution, together with conditions of approval, at
an upcoming meeting on October 21, 2003 and make its final decision on your application at that
meeting.
At the September 16, 2003 meeting, the Commission requested a revised site plan showing the
location of the existing trails and marking them as such. Please submit a revised Site Plan to that
effect. (Submit seven copies, two for file and five for the City Council).
The findings and conditions of approval of the draft resolution will be forwarded to you before the
Planning Commission meeting.
The decision shall become effective thirty days after the adoption of the Planning Commission's
resolution unless an appeal has been filed or the City Council takes jurisdiction of the case within
that thirty (30) day appeal period. (Section 17.54.010(B) of the Rolling Hills Municipal Code).
Should there be an appeal, the Commission's decision will be stayed until the Council completes
its proceedings in accordance with the provisions of the Municipal Code.
As stated above, the Planning Commission's action taken by resolution approving the
development application is scheduled for Tuesday, October 21, 2003. That action, accompanied
by the record of the proceedings before the Commission, is tentatively scheduled to be placed as
a report item on the City Council's agenda at the Council's regular meeting on Monday, October
27, 2003.

Plan Review request for a new residence at 3 Appaloosa Lane. Establishment of this
residence requires that the driveway access at 3 Appaloosa Lane be reviewed by the
Traffic Commission.
The Traffic Commission will review your proposed driveway location at their meeting
to be held on Thursday, September 25, 2003 beginning at 8:30 a.m. in the Rolling Hills
City Council Chambers, 2 Portuguese Bend Road, Rolling Hills. It is anticipated that
the Commission will adjourn to a site visit of the location. It would therefore be
appreciated if you could please stake the driveway width as it meets Appaloosa Lane.

I have reviewed the preliminary plans for the home on Appaloosa Lane. This seems to be
an optimistic project involving a large home on a limited thin building site. Mr.
Gunderson will remember the struggle we had building a six thousand square house on
the same Lane. Obviously the planning commission has liberalized its guidelines or the
rules of engagement have changed.
At any rate, we are pleased that the home site will be on the Northern part of the lot and
will not obstruct our view. I would like to request that the applicant consider pruning and
maintaining the avocado trees on the Southern portion of the lot adjoining our property so
as to improve and retain our city view
We would like to invite the Fozoonmehr family to come by to introduce themselves and
become acquainted with our family whenever they are visiting their project.

The Planning Commission will conduct a field inspection of your property to view a
silhouette of the proposed project on Tuesday. September 9. 2003 at 5:30 PM.
The owner and/or representative must be present to answer any questions regarding the
proposal.
The site must be prepared according to the enclosed Silhouette Construction Guidelines
and the following requirements:
A. A full-size silhouette in conformance with the
attached guidelines must be prepared for ALL
STRUCTURES of the project showing the footprints
and roof ridges indicating heights;
B. Stake the side property line and setback line in
the area of the proposed residence and stable;
C. Show the height of the finished floor of the
proposed residence and stable;
D. Show the outline of the proposed basement;
E. Indicate (i.e with a ribbon), which trees, shrubs.
and other vegetation will be removed as a result
of this project;
F. Delineate the extent of the area to be disturbed;
G. Stake the driveway approach and the entire length
and curvature of the proposed driveway;
H. Stake the pool and pool deck;
If possible, delineate the extent of the landslide
area on your property and the area, which will be
disturbed for the 5 Sagebrush Lane slope repair.

SILHOUETTE CONSTRUCTION GUIDELINES
When required by the Planning Commission or City Council, a silhouette of
proposed construction should be erected for the week preceding the
designated Planning Commission or City Council meeting.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not
acceptable.
Bracing should be provided where possible.
Wire, twine or other suitable material should be used to delineate roof ridges
and eaves.
Small pieces of cloth or flags should be attached to the wire or twine to aid in
the visualization of the proposed construction.
The application may be delayed if inaccurate or incomplete silhouettes are
constructed.
