THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS
DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. An application was duly filed by Mr. David Dennee with respect
to real property located at 1 Blackwater Canton Road requesting a 2-year time
extension for previously approved Conditional Use Permit and a Site Plan Review for
a 396 square foot raised deck and to convert a 663 square foot stable into a recreation
room and to set aside an area for a future stable and corral elsewhere on the lot.
Section.2. The Commission considered this item at a meeting on February
21, 2012 at which time information was presented indicating that additional time is
needed to commence the project.
Section 3. Basedupon information and evidence submitted, the Planning
Commission does hereby amends Paragraph A, Section 11 of Resolution No. 2010-03,
dated January 19, 2010 to read as follows:
A. The Conditional Use Permit and Site Plan Review approvals shall expire
within four, years from the effective date of approval as defined n Sections
17.46.080 and 17.42.070 of the Zoning Ordinance. No further extension to
commence the project shall be granted.
Section 4. Except as herein amended, the provisions and conditions of
Resolution No. 2010-03 shall continue to be in full force and effect.

Dear Mr. and Mrs. Dennee:
This letter shall serve to notify you that the Planning Commission at their regular
meeting on February 16, 2016 received and filed the Planning Commission's
resolution granting your request to remove the "Restricted Development"
Condition from your property.
The decision shall become effective thirty days after the adoption of the
resolution by the Planning Commission, unless an appeal has been filed of the
case within that thirty (30) day appeal period. (Section 17.54.010(B) of the Rolling
Hills Municipal Code). Should there be an appeal, the Commission's decision
will be stayed until the Council completes its proceedings in accordance with the
provisions of the Municipal Code.
During construction your contractors must adhere to the conditions of the
resolution.
You should submit a request for any construction and building requests to the

Conditional Use Permit.
Dear Mr. and Mrs. Dennee:
This is to inform you that the City Council at their January 25, 2010 meeting
received and filed the Planning Commission's decision in your application.
Please note the conditions of approval. Together with the other conditions, it is
required that 50% of the construction/demolition debris be recycled and
verification submitted to the City. The hauler must obtain City hauling permit.
Please have your hauler contact the City for the required forms and insurance.
Other conditions require that a landscaping plan be submitted to the City
prior to obtaining a building permit; that the barbecue/fire place /trellis/plav
house be legalized and building permits pulled; that any future/further
development on the property be submitted for planning commission approval;
that the conditions of approval be printed on the plans submitted to the RHCA
and the County and all of the other conditions.
The approval is valid for two years, with the opportunity to request an up to
two-year extension. The request must be made in writing prior to the expiration
of the approval. The approval becomes null and void if work has not
commenced within the specified period of time.

PROPERTY FOR A FUTURE STABLE AND CORRAL ON A PROPERTY
DEVELOPED WITH A SINGLE FAMILY RESIDENCE. IN ZONING CASE NO. 776,
AT 1 LOWER BLACKWATER CANYON ROAD, (LOT 46-RH) (DENNEE). THE

Section 1. Application was duly filed by Mr. And Mrs. David Dennee with respect
to real property located at 1 Lower Blackwater Canyon Road (Lot 46-RH) requesting a
Conditional Use Permit to convert an existing 663 square foot stable structure to a recreation
room, while reserving an area for future stable and corral elsewhere on the lot and Site Plan
Review to construct a 396 square foot above grade deck (33' x 12') adjacent to the proposed
recreation room. The deck at the highest elevation would be 3'6" above the grade and would
extend 12 feet from the recreation room. Excavation for footings will be necessary without
requiring any grading.
Section 2. The property is zoned RAS-1 and consists of 4.5 acres gross, (196,020
sq.ft.). The net lot area for development purposes is 119,661 square feet or 2.75 acres.
Section 3. The lot is irregular in shape and is located at the convergence of three
streets, Lower Blackwater Canyon Road, Williamsburg Lane and Middleridge Lane North.
Lower Blackwater Canyon Road goes through the property and consists of a forty -foot wide
roadway easement, however, only 18-20 feet of the roadway easement is paved. Recently the
RHCA Board of Directors approved a request by the applicants to reduce the roadway easement
from 60 feet to 40 feet and relocate it to more closely align with the paved road.
Section 4. The property is currently developed with a 2,852 square foot residence,
porch, attached trellis, 792 square foot detached garage, 663 square foot stable, service yard,
swimming pool and equipment area, detached gazebo and trellis, barbeque and fire place.
Records for the property include building permits for the existing home, remodeling, a house
addition, garage, pool and stable. There are no permits of record for an outdoor barbeque,
fireplace and detached trellis but permits are proposed to be obtained concurrent with the new
work.
Section 5. The structure that was originally constructed as a stable is currently not
used as a stable. The applicants propose to use this structure as a recreation room and allocate an

Dear Mr. and Mrs. Dennee:
The Planning Commission received and discussed your proposed project at their
December 15, 2009 meeting. After discussion, they directed staff to prepare a resolution
of approval of your project and bring it to the field trip, which they scheduled for
Tuesday. January 19. 2010. at 7:30 a.m.
The site is to be prepared according to the enclosed Silhouette Construction Guidelines
and the following requirements. Please note that inadeauate staking may result in
postponement of the case to another month.
♦ A full-size silhouette in conformance with the attached
guidelines must be prepared for ALL STRUCTURES of the
project showing the footprints and roof ridges;
• Stake the proposed louvered grilles on the roof of the
stable;
• Stake (delineate) the area of the proposed future stable
and corral and access thereto;
O Stake the proposed porch in a different color ribbon;
♦ Delineate/stake the location of the rear property line,
(by 5 Lower Blackwater Canyon Road);
• Delineate/stake the side setback line and the new
roadway easement line in the vicinity of the proposed
converted stable.
The silhouette shall be constructed a minimum of 5-7 days
prior to the field trio. so that neiahbors who may be away
durina the field trip visit would be able to view the
silhouette and comment to the City prior to the meeting.
The silhouette must remain on the property during the
e ntire review process of this case, including City Council's
review. It is, therefore, imperative that the construction of

the silhouette be of a sturdy nature. including the stakes
for the property and setback lines.
Should the Commission wish to approve your project during the field visit, they could do
so, or continue the hearing to their evening meeting on that day.
After the field trip, the next regular meeting of the Planning Commission will take place
the same evening, Tuesday January 19, 2010 at 6:30 PM at City Hall.

A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 21/2 - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.

As you are aware, the RHCA Board of Directors approved your request for the road
easement to be re -aligned on the portion of Lower Blackwater Canyon Road that crosses
your property. The Board also approved a reduction of the road easement from 60 feet to
40 feet for the easement that crosses lot 46, the parcel where your residence is located.
To proceed with the easement reduction and realignment, please have your engineer
prepare the following documents:
1. The legal description and a map (on 8 'h x 11" paper) of the existing easement,
these will be attached as exhibits to the legal documents for the Association to
vacate the easement.
2. The legal description and a map (on 8 '/ x 11" paper) of the new easement, in
which the center of the easement is aligned with the center of Lower Blackwater
Canyon Road. The easement should be 40 feet wide on lot 46 and 60 feet wide on
lot 45. These documents will be attached to the documentation for the new deed
of easement.
Once we have received the completed legal descriptions and maps, the RHCA's legal
counsel will prepare the documents to vacate the easement and to grant a new deed of
easement. When the documents are completed, originals will be sent to you to be signed
