This letter shall serve to notify you that the Planning Commission voted at their
regular meeting on January 19, 2016 to direct staff to prepare a resolution to
approve your request to remove the "Restricted Development" Condition, with
conditions, and shall be confirmed in the draft resolution that is being prepared.
The Planning Commission will review and consider the draft resolution, together
with conditions of approval, at an upcoming meeting on February 16, 2016 and
make its final decision on your application which will be final immediately.
As stated above, the Planning Commission's action taken by resolution
approving the request to remove the "Restricted Development" condition is
scheduled for Tuesday, February 16, 2016 at 6:30 p.m.

This is to inform you that the City Council at their October 22, 2012 meeting received
and filed the Planning Commission's decision in your application.
Please note the conditions of av vroval. Together with the other conditions, it is
required that the barbecue/fire place /trellis be legalized and building permits
pulled: that any future/further development on the property be submitted for
Planning Commission approval: that the conditions of approval be printed on the
plans submitted to RHCA and the Building and Safety Department.
The approval is valid for two years, with the opportunity to request an up to two-
year extension. The request must be made in writing prior to the expiration of the
approval. The approval becomes null and void if work has not commenced within
the specified period of time.
Enclosed is a copy of RESOLUTION NO. 2012-21, specifying the conditions of
approval set forth by the Planning Commission. The approval will not become

DISCRETIONARY REVIEW IN ZONING CASE NO. 827, AT 1 LOWER
BLACKWATER CANYON ROAD, (LOT 46-RH) (DENNEE). THE PROJECT HAS
BEEN DETERMINED TO BE EXEMPT PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mr. and Mrs. David Dennee with respect to
real property located at 1 Lower Blackwater Canyon Road (Lot 46-RH) requesting a Site Plan
Review to construct a 364 square foot addition to the existing residence for a total of 3,216
square foot residence.
Section 2. The property is zoned RAS-1 and consists of 4.5 acres gross, (196,020
sq.ft.). The net lot area for development purposes is 119,661 square feet or 2.75 acres.
Section 3. The lot is irregular in shape and is located at the convergence of three
streets, Lower Blackwater Canyon Road, Williamsburg Lane and Middleridge Lane North.
Lower Blackwater Canyon Road goes through the property and consists of a forty -foot wide
roadway easement.
Section 4. The property is currently developed with a 2,852 square foot residence,
porch, attached trellis, 792 square foot detached garage, 663 square foot stable, service yard,
swimming pool and equipment area, detached gazebo and trellis, barbeque and fire place.
Records for the property include building permits for the existing home, remodeling, a house
addition, garage, pool and stable. There are no permits of record for an outdoor barbeque,
fireplace and detached trellis but permits are required to be obtained concurrent with the new
work.
Section 5. In February 2012 the Planning Commission granted an extension to a
Conditional Use Permit, which was approved in January 2010, to convert an existing stable into
the recreation room, a Site Plan Review to construct an above grade deck and set aside an area
for a future stable and corral elsewhere on the property. This approval expires in February of
2014.
Section 6. On September 18, 2012 the Planning Commission conducted a duly
noticed public hearing on the subject application and a field trip to the property and directed
Staff to prepare a Resolution to approve the subject project. The applicant was notified of the
public hearings in writing by first class mail. Evidence was heard and presented from all persons
interested in affecting said proposal and from members of the City staff and the Planning

This letter shall serve to notify you that the Planning Commission adopted a resolution on
October 16, granting approval of your request. In order to expedite your request, the
Commission's action accompanied by the record of the proceedings will be reported to the
City Council on Monday. October 22.2012. beginning at 7:30 PM. You or your
representative must be present to answer any questions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days after the
adoption of the resolution by the Commission, unless an appeal has been filed or the City
Council takes jurisdiction of the case within that thirty (301 day anneal period. (Section
17.54.010(B) of the Rolling Hills Municipal Code). Should there be an appeal, the
Commission's decision will be stayed until the Council completes its proceedings in
accordance with the provisions of the Municipal Code.
Please review the conditions in the resolution. Should you have any objections to any of the
conditions, you may appeal them to the City Council.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's Resolution, the Planning Commission's action will become final and you will
be required to record an Affidavit of Acceptance Form accepting the conditions together with
the subject Resolution in the Office of the County Recorder. Instructions for recordation will
be forwarded to you after the Council's proceedings.

Subject: 1 Blackwater Canyon Road
Dear Mr. Dennee:
Thank you for stopping by the City Hall to inform me of your plans to make
improvements and additions to the existing residence at 1 Blackwater Canyon Road.
I would like to bring to your attention some conditions that exist on this property, which
were brought to City's attention when the previous property owner submitted application
and plans for additions and renovations, which they did not proceed with.
While researching files for the property prior to approval of the project, (which is a
standard procedure when additions are proposed for any property in the City), staff found
that there are no building permits for the fire place and barbeque located in the front of
the residence. In addition, the structure on the side of the house that was in the past
permitted as a stable and building permits were obtained for construction of a stable is
not being used as a stable.
As part of the approval for the additions for the previous owner, the City required that a
final inspection will not be granted for the construction/renovation, unless the fire place
and barbeque are inspected by the County Building Inspector and permits obtained. If
that cannot be accomplished then the structure would have to be demolished.
As far as the stable is concerned, the following was agreed to. The City is currently in the
process of reviewing and studying current regulations on stables and will be proposing
amended regulations, probably less restrictive than currently exist. Therefore, we are not
requiring at this time that those stables that were converted to other uses be legalized.
However, once the new ordinance is in place, the City will revisit the stables (that we are
aware of), which were converted and will require that they meet the NEW standards.
Therefore, the current use of the stable may continue, until such time as the City adopts
new regulations. Should you wish to legalize the existing stable into the use that it is
currently used as, you may apply to the City for a Conditional Use Permit to legally

change the use, and set aside an area on your property (1,000 sq.ft. minimum) for a future
stable and corral. Such area must be in a reasonable location with adequate access.
Building permits would need to be obtained for the conversion from the Los Angeles
County Building and Safety Department and the RHCA would also have to approve the
structure.
I discussed these issues and restrictions with your contractor, Bill Howe, but wanted to
summarize them for you as well.
