SUBJECT: ZONING CASE NO. 750, Request for a Site Plan Review and Variance.
Dear Mr. and Mrs. Kevin Pluimer:
The Planning Commission scheduled a field inspection of your property to view a
silhouette of the proposed project on Tuesday, MARCH 18, 2008. at about 5:00 PM.
The Commission will visit two other properties, beginning at 4:00 PM, before visiting your
site.
The site is to be prepared according to the enclosed Silhouette Construction Guidelines
and the following requirements. Please note that inadequate staking may result in
postponement of the case to another month.
• A full-size silhouette in conformance with the attached
guidelines must be prepared for ALL STRUCTURES of the
project showing the footprints and roof ridges;
• Stake the limits/footprints of all of the proposed
structures;
♦ If showing 1000 sq.ft. set aside area for a future stable,
stake (delineate) the area of the proposed future stable
and corral and access thereto; show ridge height of the
future stable;
♦ Stake the proposed trellis in a different color ribbon;
• Delineate/stake the location of the rear property line,
(by 5 Lower Blackwater Canyon Road);
♦ Delineate/stake the side setback line and the roadway
easement line as they exist today and as if they were
moved;
The silhouette shall be constructed a minimum of 5-7 days,
prior to the field trip. so that neighbors who may be away
during the field trip visit would be able to view the
silhouette and comment to the City prior to the meeting.
The silhouette must remain on the property during the
e ntire review process of this case, including City Council's

review. It is. therefore, imperative that the construction of
the silhouette be of a sturdy nature, including the stakes
for the property, setback and easement lines.
After the field trip, the next regular meeting of the Planning Commission will take place
the same evening, Tuesday March 18, 2008 at 6:30'PM at City Hall.

SILHOUETTE CONSTRUCTION GUIDELINES.
A silhouette of proposed construction must be erected the week preceding the designated
Planning Commission or City Council meeting/field trip.
Silhouettes should be constructed with 2" x 4" lumber. Printed boards are not acceptable.
Bracing should be provided.
Lumber, wire or other suitable material should be used to delineate roof ridges and eaves.
Flags in close proximity to each other must be attached to the wire or twine to aid in the
visualization of the proposed construction.
Property lines, setback lines and easement lines must be staked along the areas of
construction. 2/ - 3' high wooden stakes must be used to delineate the lines. Such stakes must
be flagged and marked on their sides:
• Property line ( red or pink flag)
• Setback line (green flag)
• Easement line (yellow flag)
and remain in the ground throughout the entire review and approval process as well as
during the entire construction process, when required by the Commission.
The application may be delayed if inaccurate or incomplete silhouettes are constructed.

This is to inform you that the City Council at their April 28, 2008 meeting
received and filed the Planning Commission's decision in your application.
PLEASE NOTE THE CONDITIONS OF APPROVAL, INCLUDING THAT
50% OF THE CONSTRUCTION DEBRIS BE RECYCLED AND,
VERIFICATION SUBMITTED TO THE CITY, THAT THE STABLE USE BE,
REVISITED ONCE THE CITY AMENDS ITS ORDINANCE, THAT THE
BARBECUE/FIRE PLACE BE LEGALIZED, THAT ANY FUTURE/FURTHER
DEVELOPMENT ON THE PROPERTY BE SUBMITTED FOR PLANNING,

RESOLUTION NO. 2008-06
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ROLLING HILLS GRANTING A SITE PLAN REVIEW AND A VARIANCE TO
PERMIT CONSTRUCTION OF AN ADDITION A PORTION OF WHICH
WOULD ENCROACH INTO THE SIDE SETBACK AT AN EXISTING SINGLE
FAMILY RESIDENCE IN ZONING CASE NO. 750, AT 1 LOWER
BLACKWATER CANYON ROAD, (LOT 46 RH), (PLUIMER).
THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES
HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. Application was duly filed by Mr. Pluimer with respect to real
property located at 1 Lower Blackwater Canyon Road (Lot 46-RH) requesting a Site
Plan Review to construct 1,172 square foot addition to an existing residence and a
Variance to encroach with 62 square feet of the addition into the side yard setback. In
addition, the applicant proposes to encroach with a new 158 square foot attached trellis
into the side setback, which also requires a Variance.
Section 2. The lot is irregular in shape and is located at the convergence of
three streets, Lower Blackwater Canyon Road, Williamsburg Lane and Middleridge
Lane North. Lower Blackwater Canyon Road goes through the property and consists of
a sixty -foot wide roadway easement. However, only 18-20 feet of the roadway easement
is paved. The actual paved portion of the road meanders in and out of the easement and
is located approximately 50 feet east (below) of the residence.
Section 3. The applicants submitted a request to the RHCA Board of Directors
to reduce the roadway easement and to relocate the roadway easement to more closely
align with the actual paved road. Recently, the Board of Directors approved the
applicants' request to realign and to reduce the easement. The process to reduce and to
realign the roadway easement takes considerable amount of time, and the applicants
would like to move the project along, and therefore a Variance is requested at this time.
However, once the easement documents are prepared and recorded, the roadway
easement will be relocated and the Variance would no longer be required.
Section 4. The Planning Commission conducted duly noticed public hearings
to consider the application at their regular meetings on February 19 and March 18, 2008
and at a field trip on March 18, 2008. The applicant was notified of the public hearings
in writing by first class mail. Evidence was heard and presented from all persons
interested in affecting said proposal and from members of the City staff and the
Planning Commission having reviewed, analyzed and studied said proposal. The
applicant's representative was in attendance at the hearings.
Section 5. During the review process it was determined that the existing
structure approved and permitted for a stable use, which is currently not used for
strictly stable uses, could retain said use until such time as when the City completes its
study on stables and amends the Zoning Ordinance to address stables. With a condition
contained in this Resolution, this issue will be revisited upon the completion of the
Zoning Code amendment regarding stables.

Dear Mr. and Mrs. Kevin Pluimer:
This letter shall serve to notify you that the Planning Commission adopted a resolution on April
15, 2008, granting approval of your request. That action accompanied by the record of the
proceedings before the Commission will be reported to the City Council on Monday. April 28,
2008. You or your representative must be present to answer any questions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days after the
adoption of the resolution by the Commission, unless an appeal has been filed or the City Council
takes jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision will be
stayed until the Council completes its proceedings in accordance with the provisions of the
Municipal Code.
Please review the conditions in the resolution. Should you have any objections to any of the
conditions, you may appeal them to the City Council.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's Resolution, the Planning Commission's action will become final and you will be
required to cause to be recorded an Affidavit of Acceptance Form together with the subject
Resolution in the Office of the County Recorder before the Commission's action takes effect.
Instructions for recordation will be forwarded to you after the Council's proceedings.
