50, Reduce rear yard setback to 40, Resolutions & Approval Conditions• BEFORE THE PLANNING COMMISSION OF THE CITY OF ROILING HILLS, COUNTY OF LOS ANGELES STATE OFCALIFORNIA In the Matter of the Application of EARLE I, HENDRICKS Lot 57A-1-Miscellaneous Parcels ZONING CASE NO. 50 FINDINGS AND FORMAL REPORT The application of Earle L. Hendricks, Lot 57A-1, Miscellaneous Parcels, for a hack yard variance, came on for hearing on the 15th day of December, 1964 at the hour of MY) A.K. at. the City Hall of the City of Rolling Hills, California, and the applicant having submitted evidence in support of his appli- cation, the Planning Commission, being advised, now makes its Findings and Formal Report as required by the ordinances of the City of Rolling Hills, California. The Commission finds that the applicant, Mr. Earle L. Hendricks, is the owner of that certain real property described as Lot 57A-1, Miscellaneous Parcels, located in the City of Rolling Hills, California, and that notice of the public hearing in con- nection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33, of the City of Rolling Hills, California. 11 The Commission fulrher finds that no person appeared at said public hearing in opposition to the application for a variance and that no evidence was received by the Commission in opposition thereto. • • III: The Commission further finds that the proposed residence of the applicant is to be located forty (40) feet from the rear property line of said lot instead of fifty (50) feet as required by said Zoning Ordinance, and further finds that by reason of the terrain of said Lot 57A-1 the variance should be granted to appli- cant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare or injurious to property or improvements in such vicinity and zone in which applicant's property is located, and that there are exceptional and extraordinary circumstances and conditions by reason of physical location and terrain of said Lot 57A-1 which do not apply generally to other property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance should be granted by the Planning Commission of the City of Rolling Hills to Earle L. Hendricks of Lot 57A-1, Miscellaneous Parcels, in accordance with the Plot Plan marked Exhibit I on file in these proceedings, and it is therefore so ordered. Dated: January 27, 1965.
