FINDINGS AND REPORT
The application of Mr. Paul Lupo, Lot 192-B-1, Miscellaneous
Tract, for a conditional use permit under Section 3.01 (D), Paragraph 3
of Ordinance No. 150 came on for hearing on the 5th day of June, 1979
in the Council Chambers of the Administration Building, 2 Portuguese
Bend Road, Rolling Hills, California, and the applicant, having submit-
ted evidence in support of the application, the Planning Commission,
being advised, now makes its Findings and Report as required by the
Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. Paul Lupo, is
the owner of that certain real property described as Lot 192-B-1,
located at 4 Georgeff Road in the City of Rolling Hills, and that
notice of the public hearing in connection with said application was
given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of
the City of Rolling Hills, California The Commission finds, further,.
that Mrs. Victoria Link, 44 Portuguese Bend Road, telephoned on May 15
to say that she and Dr. Link had no objection to a tennis court on the
Lupo property, providing that the riding trail be preserved, and appro-
priate landscaping be required around the tennis court. In a telephone
call on May 9 Mrs Ervin Heinrich, 12 Georgeff Road, said she was
opposed to construction of a tennis court and is concerned about the
noise that could result. In correspondence dated May 8 and June 5
Dr. and Mrs. Paul Saffo expressed their opposition because of high
visibility, excessive moving of soil, and building into the canyon.

The Commission finds that the applicant has requested a
conditional use permit for construction of a tennis court in the rear
yard of his property, which is a flag lot resulting from subdivision
of a property on Georgeff Road. The Commission finds that extensive
grading and retaining walls would be required, necessitating importing
of approximately 780 cubic yards of soil. The Commission finds that
a conditional use permit should not be granted, in order to preserve
substantial property rights in the same vicinity and zone, and that
the granting of such conditional use permit would be materially
detrimental to the public welfare and injurious to property in the
same vicinity and zone.
III.
From the foregoing it is concluded that a conditional use
permit should not be granted to Mr. Paul Lupo, Lot 192-B-1, 4 Georgeff
Road for construction of a tennis court because the proposed develop-
ment would alter the character of the area, was opposed by residents
in the area, and its location at the intersection of two major trails
would make it highly visible, and it is, therefore, so ordered.
