40, Reduce front yard setback to , Resolutions & Approval Conditions. , r • 1 BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) of ) ZONING CASE NO. 40 ) ERVIN L. HEINRICH ) ) Lot 4, Tract 19040, (Georgeff Ranchos) ) ) FINDINGS AND FORMAL REPORT The application of Ervin L. Heinrich, Lot 4, Tract 19040, for a front and side yard variance, came on for hearing on the seventeenth day of December, 1963, at the hour of 8:00 P.M., at the City Hall of the City of Rolling Hills, California, and the applicant having submitted evidence in support of his application, and the Planning Commission being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Ervin L. Heinrich, is the owner of that certain real property described as Lot 4, Tract 19040 (Georgeff Ranchos), located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8,06 and 8.07 of Ordinance No. 33, of the City of Rolling Hills, California. II. That no person appeared at said public hearing in opposition to the application for a variance and that no evidence was received by the Commission in opposition thereto. III.' The Commission further finds that the proposed residence of applicant is to be located twenty-five (25) feet from the front -1- property line of said lot instead of thirty (30) feet as required by said Zoning. Ordinance and that the eaves will 2 project four (4) feet into the side yards instead of the 3 twenty-five inches permitted by said Zoning 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 further finds that by reason of the terrain Ordinance, and of said Lot 4, the variance should be granted to applicant in order to pre- serve substantial property rights possessed in the same vicinity and zone, and that the by other property granting of such variance will not be materially detrimental to the public wel- fare or injurious to property or improvements in such vicinity and zone in which applicant's property is located, and that there are exceptional and extraordinary circumstances and conditions by reason of physical location and terrain of said Lot 4, which do not apply generally to other property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance should be granted by the Planning Commission of the City of Rolling Hills to Ervin L. Heinrich of Lot 4 of Tract 19040 (Georgeff Ranchos) in accordance with the Plot Plan marked Exhibit 1 on file in these proceedings, and it is, therefore, so ordered. Dated: December 18, 1963.
