FINDINGS AND REPORT
The application of Dr. Norton L. Donner, Lot 24-1-RH, Rolling
Hills Tract, for a variance of Front Yard Requirements under A }.. c1
III, Section 3.06 and an Extension of Non -Conforming Use of a Non -
Conforming Building, Article V, Section 5.07 of Ordinance No, 33
came on for hearing on the 19th day of September, 1972 in the
Council Chambers of the Administration Building, 2 Portuguese Bend
Road, Rolling Hills, California, and the applicant, having submitted
evidence in support of the application, the Planning Commission,
being advised, now makes its Findings and Report as required by the
Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Dr. Norton L. Donner,
is the owner of that certain real property described as Lot 24-1-RH,
Rolling Hills Tract, located in the City of Rolling Hills, California
and that notice of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 as the City of Rolling Hills, California.

The Commission finds, further, that no person appeared at said
public hearing in opposition to the application for variances, and
that no evidence was received by the Commission in opposition thereto.
Further, Mrs. Richard Gibson, 3 Meadowlark Lane, appeared before the
Commission and said she was in favor of the request, because the im-
provement would reflect favorably on surrounding properties. Further,
Mr. Lowell Lusk, architect for Dr. Donner advised the Commission that
the residence was built in 1939 on property that has since been sub-
divided, the existing residence contains 1470 square feet, the planned
addition, 2188 square feet, and the improved residence totalling
4,340 feet would substantially add to the value of the property, which
is of an irregular shape, and to the value of surrounding properties.

The Commission further finds that the applicant requests the
variances to permit construction of a residence addition to an exist-
ing non -conforming building, and that such addition would be a miri-
mym of 25' from the road easement of Meadowlark Lane, because of the
curve in the road. The Commission finds that a variance to permit
construction of anaddition to a non -conforming residence and a
variance of 5' of front yard requirements should be granted in order
to preserve substantial property rights possessed by other property
in the same vicinity and zone.
IV.
From the foregoing it is concluded that a variance of Front Yard
Requirements under Article III, Section 3.06 and an Extension of Non -
Conforming Use of a Non -Conforming Building, Article V, Section 5.07
of Ordinance No. 33 should be granted by the Planning Commission of
the City of Rolling Hills to Dr. Norton L. Donner, Lot 24-1-RH, Roiling
Hills Tract, in accordnace with the plot plan marked Exhibit I on file
in these proceedings, and it is, therefore, so ordered.
