183, Construct a pool, Resolutions & Approval Conditionsr BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. Barry Becker Lot 52-RH ZONING CASE NO. 183 FINDINGS AND REPORT The application of Mr. Barry Becker, Lot 52-RH, Rolling Hills Tract, for a conditional use permit under Section 3.01, Paragraph 3 (c) of Ordinance No. 112.for construction of a swimming pool came on for hearing on the 15th day of March, 1977 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. Barry Becker, is the owner of that certain real property described as Lot 52-RH, which was originally known as 1 Eucalyptus Lane, and which has been designated by the City Council as 10 Portuguese Bend Road, at the request of the Beckers, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds, further, that no communication, written or verbal, was received in opposition to the request for a swimming pool, but the City'Clerk reported that a neighbor had come to the office and discussed with her and the Chairman of the Planning Commission the general condition of the property, since the change of address resulted in location of the stable in the front yard, also storage of a recrea- tional vehicle in the area which is now the front yard, and landscaping along Portuguese Bend Road, which had provided screening, had been removed. • • II. The Commission finds that the applicant requests the conditional use permit for construction of aswinming poolin a legal location in the rear yard of the property. The Commission finds that a conditional use permit should be granted in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such conditional use permit would not be materially detrimental to the public welfare nor injurious to property in the same vicinity and zone. III. From the foregoing it is concluded that a conditional use permit should be granted under Section 3.01, Paragraph 3 (c) of Ordinance No. 112 for construction of a swimmingpool on Lot 52-RH to Mr. Barry Becker, 10 Portuguese Bend Road, and it is, therefore, so ordered. /s/ Forrest Riegel Chairman, Planning Commission WW.Ge etary, Planning ission
