FINDINGS AND REPORT
The application. of Mr. C. Fred Barth, Lot 56A-RH, Rolling Hills
Tract for a variance of Front Yard Requirements under Article III,
Section 3.06 and Side Yard Requirements under Article III, Section 3m!��7
of Ordinance No. 33 came• on for hearing on the 18th day of July, 1972
in the Council Chambers of the Administration Building, 2 Portuguese
Bend Road, Rolling Hills, California, and the applicant, having sub-
mitted evidence in support of the application, the Planning Commission,
being advised, now makes its Findings and Report as required by the
Ordinances of the City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. C. Fred Barth, is
the owner of that certain real property described as Lot 56A-RBI,
Rolling Hills Tract, located in the City of Rolling Hills, California,
and that notice. of the public hearing in connection with said appli-
cation was given as required by Sections 8.06 and 8.07 of Ordinance
No. 33 of the City of Rolling Hills, California.
II.
The Commission finds, further, that no person appeared at said
public hearing inopposition to the application for variances, and
that no evidence was received by the Commission in opposition thereto.
Further, the Commission finds that Dr. James Roberts of 15 Portuguese
Bend Road called to state that he and Mrs. Roberts wished to express
approval of the requests.
III.
The. Commission further finds that the applicant requests the
variances to permit construction of a tennis court which would extend
20 feet into the front yard and would occupy 10 feet of the side yard,,
retaining the 10 foot side easement. Further, the applicant advised
that it is his wish to build a standard 60' x 120° tennis court, and
the topography of the site does not provide a suitable location other
than the front and side yard. The Commission finds that variances
to permit construction of a tennis court with the westerly fince 59'
from the center line of Portuguese Bend Road, requiring a 21° variance
of front yard requirements, and the northerly fence on the 10° ease-
line of the property should be granted in order to.preserve substan-
tial property rights possessed by other properties in the sane vicinity
and zone.
IV.
From the foregoing it is concluded that a variance of Front
Yard Requirements under Article III, Section 3.06 and Side Yard Re-
quirements under Article III, Section 3.07 of Ordinance No. 33 should
be granted by the Planning Commission of the City of Rolling Hills to
Mr. C. Fred Barth, Lot 56A-RH, Rolling Hills Tract, in accordance with
the plot plan marked Exhibit I on file in these proceedings, and it
is therefore so ordered.
