90, "SFR ""as built"" to meet curr, Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION.OF THE.CITY:OF ROLLING HILLS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Mr. William St. Sure Lot 37B-EF ZONING CASE NO. 90 FINDING AND FORMAL REPORT The application of Mr. William St. Sure, Lot 37B-EF, Eastfield Tract, for a variance of side yard requirements under Article III, Section 3.07 and Article V, Section 5.01 and a variance of rear yard requirements under Article III, Section 3.08 of Ordinance No. 33 came on for hearing on the 19th day of August, 1969 at the hour of 8:00 P.M. at the Administration Building of the City'of Rolling Hills, California, and the applicant, having submitted evidence in support of his application, the Planning Commission, being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Mr. William St. Sure, is the owner of that certain real property described as Lot 37B-EF, East - field Tract, located in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. II . The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evidence was received by the Commission in opposition thereto. III. The Commission further finds that the building pad on the lot, is pre -graded, and in order to locate the house satisfactorily within the limitations, variances of 10 feet in the rear yard, which would then be 40 feet, rather than 50 feet as required by ordinance, and 22 inches. for an eave which would project into the side yard would be necessary. The Commission further finds that the foundation of the house will not be in the side yard, but the eave at the southerly corner projects 72 inches beyond the foundation, and of this, 22 inches project into the sideyard, and further finds that the variances of side yard and rear yard requirements should be granted to applicant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variances will not be materially detrimental to the public welfare nor injurious to property in the same vicinity and zone. IV. From the foregoing it is concluded that variances of rear yard and side yard requirements should be granted by the Planning Commission of the City of Rolling Hills to Mr. William Ste Sure, Lot 37B-EF, East - field Tract, in accordance with the plot plan marked Exhibit I on file in these proceedings, and it is, therefore, so ordered. Chairman, Planning Commission Secretary, Planning Comm sion BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Dr. Victor Meyer Lot 9CH ZONING CASE NO. 89 FINDING AND FORMAL REPORT The application of Dr. Victor M:eyex, Lot 9 C1R, Crest Hills Tract, for a variance of front yard requirements under Article III, Section 3.06 of Ordinance No. 33 came on. for hearing on. the 17th of July, 1969 at the hour of 8:00 P.M. at the Administration Building of the City of Rolling Hills, California, and the applicant, having submitted. evidence in support of his application, the Planning Com- mission., being advised, now makes its Findings and Formal Report as required by the Ordinances of the City of Rolling Hills, California, I. The Commission. finds that the applicant, Dr. Victor Meyer, is the owner of that certain real property described as Lot 9CH, Crest Hills Tract, located_in the City of Rolling Hills, California, and that notice of the public hearing in connection with said application. was given as required by Sections 8.06 and 8.07 of Ordinance'Noo 33 of the City of Rolling Hills, California. II. o The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evidence was received by the Commission in opposition thereto. III The Commission further finds that because of the unusual shape of the lot and the curve of the road, placement of the house on the lot is limited, and because of the extensive grading required, the residence would be 20' from the road easement line of Cinchring Road instead of 30' as required, but would be below road level and not visible from adjacent properties, and further finds that a variance of 10of front yard requirements should be granted to applicant in order to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare nor injurious to property in the same vicinity and zone. Iv. From the foregoing it is concluded that a variance should be granted by the Planning Commisloo of thE.
