Dear Mr. and Mrs. Tonsich:
This letter is to follow up on the several email reminders I sent you regarding the requirement
to submit a driveway plan to the City Council. As you are aware in Section 11, Condition J of
Resolution No. 1135 of the City Council's approval of your project it is required that at (or
before) the City Council meeting of February 25, 2013 you are to present a plan for approval
that moves your driveway to the south. In order to have this agendized for City Council
consideration you were initially given to January 28, 2013 to submit; thereafter in one of my
emails I asked that you submit by February 8, 2013. To date we have not received any plans for
the driveway. Should you fail to submit such a plan by Friday, February 15, 2013 we will have
no other choice but to place another stop work order on your project.
Additionally, the first third party review of the size of the basement resulted in non-compliance
with the approved square footage. Your agents were required to re -submit a couple of times
and provide justifications for their calculations. Willdan Engineering, the City's third party
consultant, had several conversations with your agents and had to re -review several plans and
request several modifications to the plans to establish compliance. Willdan Engineering has
informed us that due to the lengthy review of this initial work, the original estimate in the
amount of $7,500 may at the end not be adequate to cover their cost. It is estimated that
additional $2,500 would be required to complete the scope of work. This estimate is preliminary
and it may increase or decrease as the project continues. Any unused funds will be refunded to
you. Therefore, please submit $2,500 payable to the City of Rolling Hills by February 25, 2013.
Failure to provide the additional funds will also result in delay of your project.

This letter will serve to reply to your July 6, 2012, inquiry regarding the basis for the application
for residence structural increase at the above -referenced property.
We are revising the grading plan and applications as you have requested to clarify some of the
parameters as we have discussed. We have changed the following items for your review and
approval:
Initially, the basement was increased in size and depth due to the site geological conditions. .
This increased size was due to the necessity of placing the entire house on bedrock to limit the
differential settlement that could occur. This also eliminated the necessity to install caissons for
the rear portion of the house. The basement depth was increased from 11 feet to 14 feet due to
the lower depth of the bedrock. The basement is not encroaching in the sideyard setbacks, and
essentially expanded in an east -west direction, not towards either adjoining neighbor.
The basement has been extended to include being under the three car garage. This basement
will allow two car lifts to be installed to provide car storage below the garage in the basement
which allows the following: With the lift in the raised position, a car will enter the garage, the lift
will lower, the ceiling of the lift will then be level with the garage floor, and another car can be
garaged on this ceiling of the lift. This operation will be reversed to drive the two cars out of this
one car space.
Additionally, the garage is proposed to be increased approximately 100 sq. ft. due to a modified
design of the garage with three 9 foot wide garage doors that were previously designed at 8 foot
wide. 8 foot wide garage doors would have resulted in a limited useful garage when accounting
for wall thickness and the utility of accommodating full size vehicles and SUVs.
The proposed structural lot coverage does not exceed the guideline of 35%. Incidentally, the
Tonsich's lot is about 1.5 acres (about 62,000 sq. feet) gross and they are requesting about a
5,100 square foot house (which is consistent with similar properties at 36 Eastfield and 66

Eastfield recently offered for sale that exceed 5,000 square feet on lots of approximately 45,000
and 60,000 square feet respectively).
Furthermore, the design of the house is early California Ranchero, which requires 18 to 24 inch
thick walls with recessed windows and doors. This style of architecture is adversely penalized
when square footage is calculated to the exterior of the walls. In certain situations the square
footage of the house is determined by excluding the area of the exterior walls, the area of the
stairs/ elevators and chimneys which would reduce the floor area. Once these areas are
excluded, the net floor area is quite close to the approved square footage area.
Therefore, the application seeks to preserve the room sizes and layout as initially designed with a
slightly larger gross square footage necessitated by unforeseen geological conditions, and to
allow for the residence structure to encompass the entire area of the slightly increased
foundational walls.
The main floor of the house and the ridge height have remained the same as shown on the
approved plan.
Another item that has changed is the pool has been increased from 450 sq. feet to 750 square
feet. Due to the pool being in the front yard and proposing a larger pool than the original legal
nonconforming pool in the front yard requires us to apply for an additional variance. The pool will
not be visible from any adjacent street.
We will be submitting drawings and the required calculated areas for your review and approval by
August 1, 2012 for the Planning Commission field trip on August 14, 2012.

THE CITY COUNCIL DOES HEREBY FIND, RESOLVE AND ORDER
AS FOLLOWS:
Section 1. An application was duly filed by Mr. Nicholas Tonsich, property
owner, with respect to real property located at 40 Eastfield Drive, (Lot 91-EF), Rolling
Hills, CA requesting a two-year time extension for a previously approved Site Plan
Review for grading and construction of a new single family residence to replace an
existing single family residence in Zoning Case No. 745. The project was approved by
Resolution No. 1028.
Section 2. The City Council considered this item at a meeting on October 12,
2009 at which time information was presented indicating that additional time is
needed to commence construction.
Section 3. Based upon information and evidence submitted, the City
Council does hereby amend Paragraph A, Section 10 of Resolution No. 1028, dated
November 26, 2007 to read as follows:
"A. The Site Plan and Variances approvals shall expire within four years
from the effective date of approval if work has not commenced as defined in Section
17.46.080 of the Zoning Ordinance. No further extension shall be granted.
Section 4. Except as herein amended, the provisions and conditions of
Resolution No. 1028 shall continue to be in full force and effect.

THE CITY COUNCIL OF THE CITY OF ROLLING HILLS DOES HEREBY FIND,

Section 1. Application was duly filed by Mr. and Mrs. Nicholas Tonsich with respect
to real property located at 40 Eastfield Drive, Rolling Hills (Lot 91-EF) requesting a:site plan
review request for grading of 833 cubic yards of cut and 833 cubic yards of fill, which includes
excavation for a basement and construction of a new 4,075 square foot single family residence,
600 square foot garage, 492 square feet of covered porches, 110 square foot entryway, 2,979
square foot basement, and a service yard. The existing 442 square foot pool and 51 square foot
pool equipment will remain, although the swimming pool will be refurbished.
The applicants have originally requested a new driveway approach off of Eastfield Drive, to be
constructed on their property. Currently access to the property is through the.property at 38
Eastfield. The Traffic Commission recommended against the driveway in the proposed
location. Following the Traffic Commission's review, the applicant withdrew the request for
the new driveway approach.
Section 2. The Planning Commission adopted Resolution No. 2007-15, on September
18, 2007 granting approval in Zoning Case No. 745. The vote was 4-1. Commissioner Witte
abstained due to the fact that he was absent during a field visit
to the site and at the meeting following the field trip.
The City Council at their October 8, 2007 meeting took this case under jurisdiction. The
Council expressed concerns over the design and appearance of the proposed basement, the
visibility of the walls from Outrider Road, and the deck above the basement. The
Councilmembers were concerned that the deck gives a two-story appearance to the structure.
Section 3. The City Council conducted duly noticed public hearings to consider the
application on October 22, 2007, and at a field trip visit on November 13, 2007. The applicants
were notified of the public hearings in writing by first class mail and were in attendance.
Evidence was heard and presented from all persons interested in affecting said proposal,
including neighbors at 38 and 42 Eastfield, and from members of the City staff and the City
Council having reviewed, analyzed and studied said proposal. Those members of the City
Council present at the field trip directed staff to prepare a resolution of approval to be
considered at their November 26, 2007 meeting. Councilmember Lay requested that clearer
plans and side view of proposed structure be provided.
Section 4. In October 2002 the Planning Commission approved a Site Plan Review to
permit construction of an addition to the existing residence, to construct a 596 square foot
detached garage, to construct an 800 square foot guest house and a future stable on a lower
pad; a Variance request to permit the detached garage to encroach into the required side yard
setback and Conditional Use Permits to construct the guest house and the detached garage on
subject property. The City Council, after taking jurisdiction of the case in November of 2002
approved the project with minor changes.
Section 5. During the review process of the 2002 application geology study revealed
that the slopes below the proposed addition and below the proposed detached garage do not
meet the factor of stability as required by the Los Angeles County Building Code in order to
construct the guest house on the lower pad. In addition, the Los Angeles County Department
of Building and Safety required a horizontal setback of 15 feet between structures and the
ascending slopes, or terraced walls to act as support for the slope and the required separation.
To accomplish the requirement for slope stability and distance to the ascending slope,
remediation of the slopes was required, which resulted in exceedance in disturbed area of the
lot. In December 2005, the Planning Commission approved a request for Site Plan Review for
walls, and grading and a Variance for 60.0% disturbed area.
Section 6. The property is currently developed with a 2,355 square foot residence, 400
square foot detached garage, 442 square foot swimming pool, and 51 square foot service
yard/pool equipment shed. The detached garage currently encroaches into the side yard
setback and is proposed to be demolished.

Dear Mr. Tonsich:
The City Council scheduled a field inspection of your property to view a silhouette of the
proposed project on TUESDAY, NOVEMBER 6, 2007 at 8:00 AM.
The site must be prepared according to the following requirements. Please note that the
Planning Commission and Citv Council is requiring much more information than they
have in the past and have postponed several field trips due to inadequate staking.
• A full-size silhouette of the project showing the footprints
and roof ridges;
• Stake the limits/footprints of all of the structures;
• Show the height of the finished floor of the proposed
structure and the difference between the existing finished
grade and the proposed finished grade in the areas where the
pad is planned to be raised;
• Stake (delineate) the area of the proposed future stable and
corral and access thereto;
• Delineate the new wall in the front;
• Delineate/stake the location of the required setbacks; front,
rear and side and the side easement and property lines in the
vicinity of the project and the driveway;
• Delineate the length of the basement well along the house
and the width of the well; stake the well walls;
• Show at least a 4-foot wide walkway around the perimeter of
the entire structure, including behind the basement well;
• Show the limits of the residential building pad.
Should you be revising the project, and wish to submit revised plans prior to the field trip, please
submit by Thursday morning, November 1, 2007.
After the field trip, the next regular meeting of the City Council will take place on Monday,
November 26, 2007 at 7:30 PM at City Hall.

In summary, per the attached correspondence, the proposed additional driveway
is not recommended at the location specified on the construction plan and staked

additional grading on this property would necessitate the filing of a new

This memorandum is in response to a citizen's request for the relocation of a
driveway at 40 Eastfield Drive.
I understand the residents of 40 and 42 Eastfield share a driveway entrance
located on 38 Eastfield, and as part of a proposed construction of a new single
family residence are requesting a proposed driveway to serve 42 Eastfield only.
Based on my field visit on September 24, 2008 the new driveway location is not
recommended. The proposed driveway location would create sight visibility
problems for vehicles coming out of the driveway as well as drivers on Eastfield.
Additionally the proposed design does not seem adequate do to the magnitude of
50% cross slopes within a very narrow driveway.
I recommend the driveway design be modified and both the cross slopes and
vertical slopes be revisited to better address the sight problem created by
vehicles coming out of the 40 Eastfield proposed driveway. Moving the driveway
closer to the existing driveway at 38 Eastfield might give you an acceptable sight
distance.

SUBJECT: ZONING CASE NO. 745, Request for a Site Plan Review for grading and
construction of a new single family residence to replace an existing

Dear Mr. and Mrs. Tonsich:
This letter shall serve to notify you that the Planning Commission adopted a resolution
on September 18, 2007, granting a request in Zoning Case No. 745. That action
accompanied by the record of the proceedings before the Commission will be reported
to the City Council on Monday, October 8, 2007 beginning at 7:30 PM. You or your
representative must be present to answer any questions the Council may have.
The Planning Commission's decision in this matter shall become effective thirty days
after the adoption of the resolution by the Commission, unless an appeal has been filed
or the City Council takes jurisdiction of the case within that thirty (30) day appeal
period. (Section 17.54.010(B) of the Rolling Hills Municipal Code). Should there be an
appeal, the Commission's decision will be stayed until the Council completes its
proceedings in accordance with the provisions of the Municipal Code.
A copy of the resolution is induded for your review. Please familiarize yourself with
the conditions of approval.
If no appeals are filed within the thirty (30) day period after adoption of the Planning
Commission's Resolution, the Planning Commission's action will become final and you
will be required to cause to be recorded an Affidavit of Acceptance Form together with
the subject Resolution in the Office of the County Recorder before the Commission's
action takes effect. Instructions for recordation will be forwarded to you after the
Council's proceedings.

This letter is a follow up to the notice dated July 6 from our office concerning California
pepper trees recently planted in the rear easement of your property along Outrider Road.
The deed restrictions grant control of the easements to the Association, and it is the
policy is to keep them clear of planting and structures. The Association Board
understands that there are times when it is in the best interest of the homeowner and the
community to use a portion of an easement. For this reason, the Board has created a
process in which homeowners may request a license agreement to use a portion of their
easement for planting, sprinklers, fences, or structures. This process allows the Board to
consider the unique conditions of each individual property, the owner's needs and the
impact on the community in order to grant use of an easement.
If you are interested in keeping the trees in their current location, I would recommend
you apply to the Board for a license agreement. To do so, please write a letter addressed
to the Board detailing the location of the trees and if there are sprinklers in the easement,
your irrigation plan. Please include a survey or map indicating the placement of the trees,
property line, easement line, and roadway. The letter should explain why the trees should
be located in the easement.
Once the Board has received your request, they will schedule a field trip in which they
will view the property. Prior to the field trip, the easement and property line must be
clearly staked. Following the field trip, the Board will notify adjacent neighbors of the
request for a license agreement and make a decision at the subsequent meeting.

If a license agreement is granted, the Association's attorney will need a map or legal
description of the portion of the easement the Board has granted permission to use. He
will then draft a license agreement that will be signed by the Board and you with the
signatures notarized. The signed document will then be recorded with the County.
(Costs relating to the legal agreement and recording are approximately $450.)

the'Association office no later than Thursday, September 13tn
Alternatively, if you decide you would prefer not to go through this process, the trees can
be re -planted inside the easement line, on your private property without the Board's
permission.

This letter shall serve to notify you that the Planning Commission at their regular meeting on
August 21, 2007 directed staff to prepare a resolution, with conditions, to approve your request
in Zoning Case No. 745. The Commission will consider this resolution at their September 18,
2007 meeting. One of the conditions that the Planning Commission imposed on this project is
that any additional grading necessitating from the proposed construction, which includes the
construction of the stable, and from any requirement by the County to shore up the slope in any
manner be brought back to the Commission. As you know, any addition grading would exceed
the maximum permitted disturbance of 40% and a Variance would be required. I recommend
that you provide adequate information to the County at this stage to determine if additional
grading or remediation of the slopes would be required.
In addition, during the field trip the Commission questioned the chain link fence and the trees
located along what it appeared to be property line, which is also in the easement. Please contact
the Rolling Hills Community Association to obtain permission for planting of the trees and
locating the fence in the easement.
The resolution with findings and conditions of approval will be forwarded to you prior to the
next Planning Commission meeting. Please review the conditions of approval.
The Planning Commission decision shall become effective thirty days after the adoption of the
resolution unless an appeal has been filed by you, any interested party or the City Council takes
jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of the

In coordination with the development application under review by the Rolling
Hills Planning Commission, your request for an additional driveway apron to
serve 42 Eastfield Drive was reviewed by the Traffic Commission at its meeting
of July 26, 2007. As part of the Traffic Commission's review, the City's contract
Traffic Engineer further evaluated the request.
In summary, per the attached correspondence, the proposed additional driveway
is not recommended at the location specified on the construction plans and
staked in the field. The new driveway is alternatively recommended five -feet
east of the specified location and recommended to be 20-feet wide.
The findings of the Traffic Commission and Traffic Engineer will be forwarded to
the Planning Commission and ultimately to the City Council. If you have any

This memorandum is in response to a citizen's request for the relocation of a driveway
at 42 Eastfield Drive.
I understand Mr. And Mrs. Nicholas Tonsich currently share a common driveway
entrance with 42 Eastfield and as part of a proposed construction of a new single family
residence are questing a proposed driveway to serve 42 Eastfield only.
From my field visit on July 26, 2007 the new driveway location is not recommended.
The proposed location would create a steeper driveway than currently exists; the
steepness of the driveway would create visibility problems for those exiting the
driveway. Finally the proposed driveway location's width will not suffice and at least a
30' driveway for better ease of travel in and out of the property would be required.
I recommend the proposed driveway be 20' wide and be moved to approximately 5'
southeast from the existing driveway. This would substantially reduce the steepness of
the driveway, would make it easier to maneuver in and out of the property and eliminate
the visibility problem.

PLANNING COMMISSION MEETING FOLLOW UP AND
FIELD TRIP NOTIFICATION

SUBJECT: ZONING CASE NO. 745.
Dear Mr. Tonsich:
The Planning Commission discussed your project at their July 17, 2007 meeting and expressed
concerns over the size of the house in relationship to other homes in the area. There were also
questions concerning the need to raise the pad, the purpose of the proposed driveway approach
if it is not serving your home and request for assurance that no walls and further grading will be
required for the construction of the home in such close proximity to the edge of the building pad.
You may want to have some of these issues resolved prior to the field trip.
Your neighbors at 38 Eastfield expressed concerns over the existing driveway located on their
property and 'whether you could use the proposed driveway approach. They were also
concerned with privacy issue, should the building pad be raised, and therefore, the future home
would be higher than the existing home.
The Planning Commission scheduled a field inspection of your property to view a silhouette of
the proposed project on Tuesday, August 21, 2007, at 5:00 PM.
The site must be prepared according to the enclosed Silhouette Construction Guidelines and the
following requirements. Please note that the Commission is requiring much more
information than they have in the past and have postponed several field trips due to
inadeauate staking.
• A full-size silhouette in conformance with the attached
guidelines must be prepared for .ALL STRUCTURES of the
project showing the footprints and roof ridges;
• Stake the limits/footprints of all of the structures;
• Show the height of the finished floor of the proposed
structure and the difference between the existing finished
grade and the proposed finished grade in the areas where the
pad is planned to be raised;
• Stake (delineate) the area of the proposed future stable and
corral and access thereto;
• Show location of the septic tank, if known;
• Delineate the new wall;

• Delineate/stake the location of the required setbacks; front,
rear and side and the side easement and property lines in the
vicinity of the project and the driveway;
• Delineate the length of the basement well along the house
and the width of the well; stake the well walls;
• Show at least a 4-foot wide walkway around the perimeter of
the entire structure, including behind the basement well;
♦ Show the limits of the residential building pad.
The silhouette shall be constructed a minimum of 5 days prior to
the field trip, so that neighbors who may be away during the
field trip visit would be able to view the silhouette and comment
to the City prior to the meeting. The silhouette must remain on
the property during the entire review process of this case,
including City Council's review. It is, therefore, imperative that
the construction of the silhouette be of a sturdy nature,
including the stakes for the property, setback and easement
lines.
Prior to the filed trip, but no later than August 13. 2007, please submit 8 sets of architectural
drawings of the residence, including the height of the roof ridge, floor plan for the basement
indicating the livable areas within the basement, (as opposed to storage or mechanical rooms),
the required area of windows/doors and locations thereof. Should the project be revised, you
must submit the revised plan and computations by no later than August 12, 2007.
After the field trip, the next regular meeting of the Planning Commission will take place on
Tuesday August 21, 2007 at 6:30 PM at City Hall.
The owner and/or representative must be present to answer any questions regarding the proposal.
