102, Construct a deck in side yard , Resolutions & Approval ConditionsBEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application ) of ZONING CASE NO. 102 Mr. Howard Lester ) Lot 239-A-2 FINDINGS AND REPORT The application. of Mr. Howard Lester, Lot 239A-MS, Miscellaneous Tract, for a variance of Side Yard Requirements under Article III, Section 3.07 of Ordinance No. 33 came on for hearing on the 21st day of Sgptember, 1971 in the Council Chambers of the Administration Bui1.iling, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I•o. The Commission finds that the applicant, Mr. Howard Lester, is the owner of that certain real property described as Lot 239A-MS, Miscellaneous Tract, located in the City of Rolling Hills, California, anal that notice of the public hearing in connection with said appli- cation was given as required by Sections 8.06 and 8.07. of Ordinance No. 33 of the City of Rolling Dills, California. II. The Commission further finds that no person appeared at said public hearing in opposition to the application for a variance, and that no evidence was received by the Commission in oppisition thereto. III0 The Commission further finds that the applicant wishes to have a deck built in the side yard to provide additional space for entertaining in the' pool area, and to provide protection from' prevailing winds, and a more attractive surrounding for his pool,, which is exposed. Further, the Commission finds that because of the contour of the land on which the house :• is built, there are no neighbors close enoughto see the con- struction. The Commission finds, therefore, that a varianceitb allow for construction of a pool deck in the side yard inorder to preserve substantial property rights possessed by other property in the same vicinity and zone, and that the granting of such variance will not be materially detrimental to the public welfare or injurious to property in the same vicinity and zone. IV. From the foregoing it is concluded that a variance of Side Yard Regiirements under Article III,Section 3007 of Ordinance No. 33 should be granted by the Planning Commission of the City of Rolling Hills to Hr.
