none, Install a satellite antenna, Resolutions & Approval Conditions• • BEFORE THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS COUNTY OF LOS ANGELES, STATE OF CALIFORNIA In the Matter of the Application of Dr. Richard Spellberg Lot 239-5-MS ZONING CASE NO. 226 FINDINGS AND REPORT The application of Dr. Richard Spellberg, Lot 239-5-MS, Miscellaneous Tract, for a conditional use permit under Section 3.01 (D), Paragraph 3 (a) of Ordinance No. 150 came on for hearing on the 17th day of July, 1979 in the Council Chambers of the Administration Building, 2 Portuguese Bend Road, Rolling Hills, California, and the applicant, having submitted evidence in support of the application, the Planning Commission, being advised, now makes its Findings and Report as required by the Ordinances of the City of Rolling Hills, California. I. The Commission finds that the applicant, Dr. Richard Spellberg, is the owner of that certain real property described as Lot 239-5-MS located at 5 Chestnut Lane in the City of Rolling Hills, and that notice of the public hearing in connection with said appli- cation was given as required by Sections 8.06 and 8.07 of Ordinance No. 33 of the City of Rolling Hills, California. The Commission finds that no communication, written or verbal, was received in opposition to the request, and that Mr. and Mrs. Gary Hansen, 6 Chestnut Lane and Mr. and Mrs. Samuel Speranza, 12 Johns Canyon Road, expressed their approval in writing. II. The Commission finds that a conditional use permit was requested for construction of a tennis court. The Commission finds, further, that the applicant has stated that there is an existing pad on the property for the tennis court, the proposed court would not be visible from surrounding properties, and the existing driveway and parking area will accommodate six or more cars. The Commission finds that a conditional use permit should be granted in order to preserve substantial property rights in the same vicinity and zone, • • and that the granting of such conditional use permit would not be materially detrimental to the public welfare, nor injurious to pro- perty in the same vicinity and zone. III. From the foregoing it is concluded that a conditional use permit should be granted to Dr. Richard Spellberg, Lot 239-5-MS, 5 Chestnut Lane, for construction of a tennis court, subject to conditions as follows: 1. That the tennis court fence be a maximum of 'n/i6/7, feet in height above the surface level of the court; 2. That all slopes be landscaped with ground cover and trees to conceal the proposed retaining walls and screen the court area; 3. That a landscape plan and irrigation system be sub- mitted to the Landscape Committee for review and comments, and then submitted to the Planning Com- mission for final approval; 4. That all proposed walls be a uniform earthen color; said color and material to be approved by the Planning Commission; 5. That a $2,000 bond be deposited with the City, to be held until eighteen months after completion, to guar- antee growth of the landscaping; 6. That all landscaping and the irrigation system be completed concurrent with completion of the tennis court; and it is, therefore, so ordered.
