This is in response to your request for a will serve letter for the subject project, which was
received by the County Sanitation Districts of Los Angeles County (Districts) on January 29, 2009. The
proposed development is located within the jurisdictional boundaries of District No. 5. We offer the
following comments regarding sewerage service:
1. The wastewater flow originating from the proposed project will discharge to a local sewer line,
which is not maintained by the Districts, for conveyance to the Districts' Palos Verdes North
Slope Trunk Sewer, Section 3 Replacement, located in Crenshaw Boulevard south of Palos
Verdes Drive North. This 10-inch diameter trunk sewer has a design capacity of 2.1 million
gallons per day (mgd) and conveyed a peak flow of 0.9 mgd when last measured in 2007.
2. The wastewater generated by the proposed project will be treated at the Joint Water Pollution
Control Plant located in the City of Carson, which has a design capacity of 400 mgd and currently
processes an average flow of 297.9 mgd.
3. The expected average wastewater flow from the project site is 260 gallons per day. For a copy of

4. The Districts are authorized by the California Health and Safety Code to charge a fee for the
privilege of connecting (directly or indirectly) to the Districts' Sewerage System or increasing the
strength or quantity of wastewater attributable to a particular parcel or operation already
connected. This connection fee is a capital facilities fee that is imposed in an amount sufficient to
construct an incremental expansion of the Sewerage System to accommodate the proposed
project. Payment of a connection fee will be required before a permit to connect to the sewer is

5. In order for the Districts to conform to the requirements of the Federal Clean Air Act (CAA), the
design capacities of the Districts' wastewater treatment facilities are based on the regional growth
forecast adopted by the Southern California Association of Governments (SCAG). Specific
policies included in the development of the SCAG regional growth forecast are incorporated into
clean air plans, which are prepared by the South Coast and Antelope Valley Air Quality
Management Districts in order to improve air quality in the South Coast and Mojave Desert Air
Basins as mandated by the CAA. All expansions of Districts' facilities must be sized and service
phased in a mannerthat will be consistent with the SCAG regional growth forecast for the
counties of Los Angeles, Orange, San Bernardino, Riverside, Ventura, and Imperial. The
available capacity of the Districts' treatment facilities will, therefore, be limited to levels
associated with the approved growth identified by SCAG. As such, this letter does not constitute
a guarantee of wastewater service, but is to advise you that the Districts intend to provide this
service up to the levels that are legally permitted and to inform you of the currently existing
capacity and any proposed expansion of the Districts' facilities.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROLLING
HILLS APPROVING CONSTRUCTION OF A SEWER MAIN LINE IN
CONNECTION WITH RESIDENTIAL CONSTRUCTION AT 0 CHESTNUT
LANE
The City Council of the City of Rolling Hills does hereby resolve and order as follows:
Section 1. Norman and Karen Meidl, the owners of #0 Chestnut Lane (hereinafter "Owners")
intend to construct at their own expense the public sewer improvements shown on Exhibit A
attached hereto (the "Improvements").
Section 2. The City Engineer has determined that no other properties in the vicinity will be
connected to the Improvements via laterals. Hence, at this time, there is no need to form a
sanitary sewer reimbursement district for the benefit of the Owners.
Section 3. No property owner shall be permitted to connect to the Improvements by way of a
lateral and no pennit shall be issued for the connection of any other property to the
Improvements via a lateral unless a sanitary sewer reimbursement district is formed pursuant to
Chapter 13.16 of the Municipal Code providing for payment of a sewer connection charge that
will provide for pro rata reimbursement to the Owners of the cost of constructing the
Improvements. Upon completion of the Improvements, the Owners shall submit to the City
documentation verifying the cost of construction of the sewer line to enable the City to compute
the sewer connection charge should such a reimbursement district ever be formed.
Section 4. Nothing provided herein shall preclude the connection, without payment of a sewer
connection charge, of a main sewer line to the Improvements providing sewer service to
properties within the same sewer shed (as shown in the Low Pressure Sewer Feasibility Study
dated September 2008) as 0 Chestnut Lane.

Manager Raig said a letter was received from Doug McHattie of Bolton Engineering on
behalf of Norman and Karen Meidl of 0 Chestnut Lane requesting permission to use the
Association easement to connect to the sewer at Morgan Lane as required by the City for the
their new home construction. She added that they are currently considering two options for
the sewer line: the first would go under Johns Canyon Road; the second option is to put the
line in the front easement of the Stone property at 9 Johns Canyon Road.
A motion was made to approve the request to install a sewer line in the road or roadside
easement with the stipulation that the easement or road will be restored to its original
condition, m, President Crocker, s. Director Ferris, The motion passed unanimously.
Letter Dated 1 /11 /08 from Julio Sierra and Beatriz Tamavo re: Unp ermitted Building in
Easement Between 61 and 59 Eastfield Drive
Manager Raig explained that the Association received a letter from Julio Sierra and Beatriz
Tamayo of 59 Eastfield Drive stating that the driveway and drain of Joe Juge at 61 Eastfield
Drive encroaches into the easement asking the Association or City to take action on the
matter.
Association Member Beatriz Tamayo explained that her concern is that the only access to
the rear of her property at 59 Eastfield Drive is the side easement of Mr. Juge's property and
questioned if the driveway and drain should be in the easement between their properties.
Association Member Joe Juge explained that the location of the driveway and drain were
determined and approved by Association.
Manager Raig said that 59 Eastfield has 5 foot side easements which are not enough space
to allow vehicle access to the rear portion of the property. She added that notes in the file
indicate that Mr. Juge had an agreement with the previous owners of of 59 Eastfield Drive
to use his driveway to access the rear portion of their property.
Legal Counsel Croft asked Ms. Tamayo to determine how great the need is to access the
rear of the property and work with Mr. Juge to reach an agreement.
The Board agreed that the two neighbors should work together to solve the access issues and
asked Manager Raig to assist in arranging a meeting and working out an agreement with the
neighbors.

We now have permission from the attorneys to finish the grading at the Kim
residence #2 Outrider.
In order to complete the grading it is necessary to import soil. The reason being,
the backyard excavation yielded not only tons of rocks, but also trash that had been
buried at the rear of the property. Neither the rocks nor the trash could be used as fill.
The estimated quantity of fill required is approximately 287 cubic yards.
The Meidl job at #0 Chestnut has available dirt of suitable quality that will enable
the contractor to complete the grading. This material is from the excavation for the
footings of both the wall and house foundation.
The hoped for timetable is: Begin hauling Friday March 21, 2008 and complete
the following week.

underground sewer on Chestnut Lane with construction of the residence at 0 Chestnut
Lane and in compliance with the conditions of the project. Toward that end, this letter
is to advise you of the steps necessary to affect the connection.
Prior to obtaining County permits, it will be necessary to do the following:
1. Expand the existing Sanitary Sewer Reimbursement District 93-1 to include 0
Chestnut Lane.
2. An-iend the Reimbursement Agreement to include 0 Chestnut Lane.
3. Receive a Permit Fee per Section 5 of the Reimbursement Agreement.

THE CITY COUNCIL OF TI-IE CITY OF ROLLING HILLS HEREBY FINDS,
DETERMINES, RESOLVES AND ORDERS AS FOLLOWS:
Section 1. Chapter 13.16 of the Rolling Hills Municipal Code provides for the
formation of sanitary sewer reimbursement district whereby a person or group of persons can be
reimbursed for the cost of constructing a public sewer system.
Section 2. David and Kimberly Stone, 9 Johns Canyon Road; Joseph and Susan
Carey, 10 Johns Canyon Road; William and Susan Peters, 11 Johns Canyon Road; Paul and
Jennifer I-Iennessey, 12 Johns Canyon Road; and Wanda Lester, 2 Chestnut Lane (hereinafter
collectively referred to as the "Developer") intend to construct at their own expense the public
sewer improvements shown on Exhibit A attached hereto (the "improvements").
Section 3. The Developer has requested the City to form a sanitary sewer
reimbursement district for the purpose of reimbursing the Developer for a portion of the cost of
constructing the Improvements as proposed to be constructed.
Section 4. The City Engineer has determined that the sanitary sewer
reimbursement district shown on Exhibit B attached hereto (the "Reimbursement District") consists
of all territory which could possibly be connected to the Improvements.
Section 5. A draft of the reimbursement agreement between the Developer and
the City (the "Reimbursement Agreement"), which contains a description of the Improvements, a
diagram of the Reimbursement District, the estimated cost of the Improvements, and the costs of
connection to the Improvements, is on file in the office of the City Clerk and open to public
inspection.
Section 6. Based upon its review of reports and other information presented to
it, the City Council hereby finds and determines that the Reimbursement District includes all the
properties which could connect to the Improvements as proposed to be constructed. The City
Council hereby orders the formation of the Reimbursement District.
Section 7. The Reimbursement Agreement attached hereto as Exhibit C is hereby
approved and the Mayor and City Clerk are hereby authorized to execute the Reimbursement
Agreement for and in the name and on behalf of the City.
Section 8. The sewer connection charge set forth in the Reimbursement
Agreement shall not be due and payable unless the owner of the property subject to the charge
connects to the Improvements. No permit shall be issued for the connection of the property in the
Reimbursement District to the Improvements until, in addition to any other fees required by the
City, the charge required by this Resolution has been paid. Such charge shall be collected whether
or not additional public sewer is being constructed to serve the property. Property outside the
boundaries of the District shall not be issued permits to connect to the Improvements and shall not
so connect until the District boundaries are modified so as to include such property, and the
Reimbursement Agreement amended accordingly.
Section 9. All moneys paid for sewer connection permits hall be deposited into
a special "sewer connection trust fund" for the Reimbursement District. At the end of each fiscal
year, the Finance Director shall distribute such moneys to the Developer in accordance with the
terms of the Reimbursement Agreement. The foregoing reimbursement obligation of the City is
a limited obligation payable solely from the charges collected pursuant to this Resolution and the
Reimbursement Agreement and in no event shall the City's General Fund be liable for such
reimbursement.

REIMBURSEMENT DISTRICT AGREEMENT
THE CITY COUNCIL OF THE CITY OF ROLLING HILLS HEREBY FINDS,
DETERMINES, RESOLVES AND ORDERS AS FOLLOWS:
Section 1. On November 22, 1993, the City Council adopted Resolution No.
716, establishing a Sanitary Sewer Reimbursement District No. 93-1 and approving a
Reimbursement Agreement in connection therewith.
Section 2: Section 4 of the aforementioned Agreement provides that the
actual total costs of improvements will be set forth as an amendment to this Agreement.
Section 3: This privately funded sewer system received its final permit and
inspection on Thursday, September 1, 1994. The actual total costs of the sewer submitted by
the parties to this Agreement are $125,946.70 and Section 4 shall be amended accordingly.
Section 4. The first amendment of the Sewer Connection Reimbursement
Agreement establishing the actual total costs of the improvements as set forth in Section 4
of the aforementioned Agreement is attached hereto as Exhibit "A".

Dear Mr. Meidl:
It has come to our attention that you are ready to pull permits for construction of your new
residence. However there are few outstanding issues that must be attended to immediately:
The Resolution of approval (enclosed) specifically stipulates that prior to issuance of
building or grading permits the Resolution must be accepted by you and recorded, (condition
AF).
Submit two copies of a landscaping plan for the existing and proposed plants,
(conditions M and 0);
Submit plan showing location and cross section of the pool equipment (condition K).
Although this condition also requires that a plan be submitted for a sewer line, a rough plan
was submitted to the City during the hearings, so for now that will suffice. However, should
you have a final plan for the sewer line and connections, please submit to the City.
Provide a letter/certification from your civil engineer or soils and geology engineer
stating whether or not the grading quantities of 587 cubic yards of cut and 587 cubic yards of
fill remain the same or have to be increased, as a result of County plan review, (conditions F
and AD). Should these quantities change (increase), a modification to the approval would
have to be processed by the Planning Commission. If you commence construction and it is
determined that there is a change in the dirt quantities, then all work would have to stop until
the review process is completed.
Provide a letter stating whether or not the drainage plan as presented and dated Jan
16, 2007 will be modified. If modification is necessary it must be reviewed and approved by
the Planning Commission (Conditions L and AD).
Therefore, please submit the requested information as soon as possible and complete
and record the enclosed Affidavit of Acceptance Form together with the subiect
Resolution in the Office of the County Recorder prior to commencing any work.

Section 1. An application was duly filed by Mr. and Mrs. Norm Meidl
with respect to real property located at 0 Chestnut Lane (Lot 241-A-1-MS),
Rolling Hills, CA requesting a Site Plan Review and Variance to permit grading
and construction of a new 4,320 square foot single family residence, 885 square
foot garage, 96 square foot service yard, 837 square feet covered porches, future
stable and 436 square foot swimming pool in the front yard area.
Section 2. The Planning Commission conducted duly noticed public
hearings to consider the application on October 17, 2006, November 21, 2006,
December 19, 2006 and at a field trip visit on November 21, 2006. The applicants
were notified of the public hearings in writing by first class mail. Evidence was
heard and presented from all persons interested in affecting said proposal and
from members of the City staff and the Planning Commission having reviewed,
analyzed and studied said proposal. The applicants' representatives were in
attendance at the hearings.
Section 3. In 1992 a Site Plan Review application for a new 1,674 square
foot pre -fabricated residence, 350 square foot garage with a Variance to encroach
into the front and side setbacks with a 5-foot retaining wall was approved. A
12,000 square foot building pad with grading in the amount of 4,000 cubic yards
of cut and 4,000 cubic yards of fill and a 15-foot wide driveway were also
approved. The project expired and the owner re -filed in 1994 for the same
request. After reviewing the 1994 plan, the Fire Department required a 20-foot
wide driveway and a wider turn area into the garage. The applicant filed an
application in 1996 for a Lot Line Adjustment between subject property and the
adjacent lot, which were under the same ownership. With the approval of the lot
line adjustment, the size of the subject lot was enlarged from 2.0 acres gross to
2.35 acres gross. Once the Lot Line Adjustment was processed in 1996, the
applicant completed grading of the site and constructed the driveway, but not
the residence. Therefore, the site is ready for construction and will require
minimal grading.
Section 4. Fifty five (55%) percent of the lot was disturbed for the
previous approval. At the time the property was graded there was no provision
in the Zoning Code for maximum disturbance. Therefore, the previous
disturbance of 55% of the lot is legal nonconforming and Variance is not
required.

The Planning Commission's decision in this matter shall become effective thirty days after the adoption

This letter shall serve to notify you that the Planning Commission voted at their regular
meeting on December 19, 2006 to direct staff to prepare a resolution to approve your
request, with conditions, in Zoning Case No. 734 and shall be confirmed in the draft
resolution that is being prepared. The Planning Commission will review and consider the
draft resolution, together with conditions of approval, at an upcoming meeting on
January 16, 2007 and make its final decision on your application at that meeting.
The findings and conditions of approval of the draft resolution will be forwarded to you
before the Planning Commission meeting for your review.
The Planning Commission requested that the following information be provided and
conditions included in the resolution:
• Prior to the next meeting provide a plan showing the sewer line and connection
to the sewer line in the street
• Prior to the next meeting provide calculation for drainage and commitment from
the County Drainage Division that the existing drain line would suffice to carry the
drainage of this lot
• Calculate the dirt quantities, including dirt from pool, caissons, if any, footings
including wall footings and including all other dirt movement on the lot. You'll be
restricted to that number, any increase during construction will have to be
reviewed by the Planning Commission.
• Other conditions include planting, water conservation, pool equipment under the
pool area and screening of pool equipment, and no more than 2-foot footings for
the wall.
The decision shall become effective thirty days after the adoption of the Planning
Commission's resolution unless an appeal has been filed or the City Council takes
jurisdiction of the case within that thirty (30) day appeal period. (Section 17.54.010(B) of
the Rolling Hills Municipal Code). Should there be an appeal, the Commission's decision
will be stayed until the Council completes its proceedings in accordance with the

case to their regular meeting scheduled for December 19, 2006. The Planning
Commission at their meeting on November 21, 2006 requested that you provide a
detailed drainage plan including the existing and future (if any), above ground swales,
location of swimming pool equipment (not allowed in setbacks or front yard, however if it
can be placed in a housing underneath the pool, it would be acceptable), explanation of
the pad area and whether the 3-foot wall would increase or reduce the pad size and the
precise size of the building pad. You may want to verify with the LA County drainage
engineers that the above ground swales are necessary to carry the storm water from the
pad and structure. The Planning Commission is concerned with the aesthetics of above
ground swales. In addition, please provide the history on the issue of the previously
approved building pad (in 1992 and in 1994) to not to exceed 12,000 square feet and
how it became over 18,000 square feet. Staff has no records that would indicate that a
revised grading plan showing a larger pad was submitted and approved by the City or by
the LA County Building and Safety Department.
The Planning Commission also requested a cross section of the wall and drainage
swales behind the wall.
Please submit the above mentioned information by Friday, December 8, 2006, so that it
can be included in the Planning Commission packet for their December 19, 2006
meeting.

specifications on file with the County of Los Angeles Department of Public Works in a
manner satisfactory to the City Engineer.
IT IS RECOMMENDED THAT YOUR COUNCIL:
1. Approve the work that has been completed and accept the sewer
improvements for public use and maintenance.
Enclosed are the Index Map, Offer of Dedication, and Certificate of Acknowledgment for
your use.
Please instruct the City Clerk to send a copy of the City Council's action on this
recommendation to the City Engineer.
