RESOLUTION NO. 2004-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS GRANTING APPROVAL OF A CONDITIONAL USE PERMIT TO CONVERT AN EXISTING STABLE INTO A CABANA AT AN EXISTING SINGLE FAMILY RESIDENCE IN ZONING CASE NO. 691 AT 2 CINCHRING ROAD, (LOT 5-H) (VIRJEE). THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS: Section 1. An application was duly filed by Mr. and Mrs. Framroze Virjee with respect to real property located at 2 Cinchring Road, Rolling Hills, CA requesting a Conditional Use Permit to convert an existing 720 square foot stable into a cabana. Section 2. The Planning Commission conducted duly noticed public hearings to consider the application on June 16, 2004, July 20, 2004 and at a field trip visit on July 13, 2004. The applicants were notified of the public hearings in writing by first class mail. Evidence was heard and presented from all persons interested in affecting said proposal and from members of the City staff and the Planning Commission having reviewed, analyzed and studied said proposal. The applicants' representative was in attendance at the hearings. Section 3. The property is developed with a 3,251 square foot residence, 490 square foot garage, 720 square foot stable, and 295 square foot service yard. An 850 square foot swimming pool/spa was administratively approved and is currently under construction. The property is irregular in shape and it abuts three streets. Section 4. In July,2002, the Planning Commission approved a lot line adjustment between the subject property and 4 Cinchring Road, whereas 10,123 square feet of land was transferred from 4 Cinchring Road to this property. Section 5. The Planning Commission finds that the project qualifies as a Class 3 Exemption (The State of CA Guidelines, Section 15303) and is therefore categorically exempt from environmental review under the California Environmental Quality Act. Section 6. Section 17.16.210(A)(2) of the Rolling Hills Municipal Code permits approval of a cabana under certain conditions, provided the Planning Commission approves a Conditional Use Permit. The applicant is requesting to convert an existing stable to a 720 square foot cabana. With respect to this request for a Conditional Use Permit, the Planning Commission finds as follows: A. The granting of a Conditional Use Permit for the conversion of a stable to cabana would be consistent with the purposes and objectives of the Zoning Ordinance and General Plan and will be desirable for the public convenience and welfare because the use is consistent with similar uses in the community, and the area proposed for the cabana is already developed with a stable, and is located in an area on the property where such use will not change the existing configuration of structures on the lot. B. The nature, condition, and development of adjacent uses, buildings, and structures have been considered, and the construction of a cabana will not adversely affect or be materially detrimental to these adjacent uses, buildings, or structures because the proposed cabana will be located in a cluster with the pool and residence to promote pad integration and is of sufficient distance from nearby residences so that the cabana will not impact the view or privacy of surrounding neighbors. C. The project is harmonious in scale and mass with the site, the natural terrain, and surrounding residences because the cabana will comply with the low profile residential development pattern of the community and will be screened D. The proposed conditional use complies with all applicable development standards of the zone district because the 720 square foot size of the cabana is less than the maximum permitted under the Municipal Code and the cabana does not encroach into any setback areas. E. The proposed conditional use is consistent with the portions of the Los Angeles County Hazardous Waste Management Plan relating to siting criteria for hazardous waste facilities because the project site is not listed on the current State of California Hazardous Waste and Substances Sites List. F. The proposed conditional use observes the spirit and intent of Title 17 of the Zoning Code because an adequate area is set -aside for the construction of a future stable structure and adjacent corral. Section 7. Based upon the foregoing findings and the evidence in the record, the Planning Commission hereby approves a Conditional Use Permit for the conversion of an existing stable into a 720 square foot cabana, in accordance with the development plan dated June 10, 2004 and marked Exhibit A in Zoning Case No. 691 subject to the following conditions: A. The Conditional Use Permit approval shall expire within one year from the effective date of approval if construction pursuant to this approval has not commenced within that time period, as required by Section 17.42.070(A) of the Rolling Hills Municipal Code, or the approval granted is otherwise extended pursuant to the requirements of this section. B. It is declared and made a condition of the approval, that if any conditions thereof are violated, this approval shall be suspended and the privileges granted hereunder shall lapse; provided that the applicants have been given written notice to cease such violation, the opportunity for a hearing has been provided, and if requested, has been held, and thereafter the applicant fails to correct the violation within a period of thirty (30) days from the date of the City's determination. C. All requirements of the Building and Construction Ordinance, the Zoning Ordinance, and of the zone in which the subject property is located must be complied with unless otherwise set forth in the Permit, or shown otherwise on an approved plan. RESOLUTION NO. 2004-20 ZC No. 691 2 D. The lot shall be developed and maintained in substantial conformance with the site plan on file marked Exhibit A and dated June 10, 2004, except as otherwise provided in these conditions. E. The working drawings submitted to the County Department of Building and Safety for plan check review must conform to the development plan approved with this application. F. No grading is required with this application. G. Structural lot coverage shall not exceed 6,106 square feet or 12.4% in conformance with structural coverage requirements. H. Total lot coverage of structures and paved areas shall not exceed 13,773 square feet or 27.9% in conformance with lot coverage limitations. I. The disturbed area of the lot shall not exceed 39.0% of the net lot area in conformance with lot disturbance limitations. J. Residential building pad coverage on the existing 9,155 square foot residential building pad shall not exceed 4,086 square feet or 44.63%; coverage on the 14,400 square foot cabana/pool/stable pad shall not exceed 2,020 square feet or 14.0%. K. The proposed cabana shall not exceed 720 square feet and shall meet all requirements of the Zoning Code, which include, but is not limited to the following: a. No sleeping quarters or kitchen or other cooking facilities shall be permitted in the cabana or detached recreation rooms. L. Landscaping shall include water efficient irrigation, to the maximum extent feasible, that incorporates low gallonage irrigation system, utilizes automatic controllers, incorporates an irrigation design using "hydrozones," considers slope factors and climate conditions in design, and utilizes means to reduce water waste resulting from runoff and overspray in accordance with Section 17.27.020 (Water Efficient Landscaping Requirements) of the Rolling Hills Municipal Code. M. Landscaping plan in connection with the proposed cabana must be submitted for review and approval by the Planning Department prior to issuing a building permit for the conversion. The landscaping plan shall utilize to the maximum extent feasible, plants that are native to the area and are consistent with the rural character of the community. The landscaping plan submitted must comply with the purpose and intent of criteria for approving Conditional Use Permits. The trees and shrubs used in the landscaping scheme for this project shall be mature when planted, but which at full maturity shall not obstruct views from neighboring properties and shall not exceed the ridge height of the cabana. N. Landscaping plan shall be submitted for the Planning Department review and approval at the time approval is sought for construction of the stable. The landscaping plan shall utilize to the maximum extent feasible, plants that are native to the area and are consistent with the rural character of the community. The trees and RESOLUTION NO. 2004-20 ZC No. 691 3 shrubs used in the landscaping for construction of the stable shall be mature when planted, but which at full maturity shall not obstruct views from neighboring properties and shall not exceed the ridge height of the stable, when constructed. O. During construction, any soil disturbance shall preserve the existing topography, flora, and natural features to the greatest extent possible. p. During construction, conformance with the air quality management district requirements, stormwater pollution prevention practices, county and local ordinances and engineering practices shall be required, so that people or property are not exposed to undue vehicle trips, noise, dust, and objectionable odors. Q. During construction, an Erosion Control Plan containing the elements set forth in Section 7010 of the 2001 County of Los Angeles Uniform Building Code shall be followed to minimize erosion and to protect slopes and channels to control stormwater pollution as required by the County of Los Angeles. R. During and after construction, all parking shall take place on the project site and, if necessary, any overflow parking shall take place within nearby roadway easements. S. During construction, the property owners shall be required to schedule and regulate construction and related traffic noise throughout the day between the hours of 7 AM and 6 PM, Monday through Saturday only, when construction and mechanical equipment noise is permitted, so as not to interfere with the quiet residential environment of the City of Rolling Hills. T. The property owners shall be required to conform to the Regional Water Quality Control Board and County Health Department requirements for the installation and maintenance of septic tank, if required for the cabana. U. The property owners shall be required to conform to the Regional Water Quality Control Board and County Health Department requirements for the installation and maintenance of stormwater drainage facilities. V. The property owners shall be required to conform to the Regional Water Quality Control Board and County Public Works Department Best Management Practices (BMP's) related to solid waste. W. The property owners shall be required to conform to the City of Rolling Hills Outdoor Lighting Standards Ordinance, (Ordinance No. 287). X. A drainage plan shall be approved by the County District Engineer, to include any water from any site irrigation systems and to assure that all drainage from the site shall be conveyed in an approved manner. Ya. All utility lines to the cabana shall be placed underground. The roof material for the cabana shall comply with the City of Rolling Hills Building Code requirements. RESOLUTION NO. 2004-20 ZC No. 691 4 Y. The project must be reviewed and approved by the Rolling Hills Community Association Architectural Review Committee prior to the issuance of any building permit. Z. Until the applicants execute an Affidavit of Acceptance of all conditions of the Conditional Use Permit, the approval shall not be effective. AA. All conditions of the Conditional Use approval, that apply, shall be complied with prior to the issuance of building permits by the County of Los Angeles. The rear or easterly property line of Lot 5-CH is proposed to be relocated further east and be parallel to Portuguese Bend Road. Section 2. California Government Code Subsection 66412(d) authorizes lot line adjustments without requiring a tentative map, parcel map or final map if: (A) The lot line adjustment involves two or more existing adjacent parcels, where land is proposed to be taken from one parcel and added to an adjacent parcel; (B) A greater number of parcels than originally existed is not thereby created; (C) The lot line adjustment will create parcels that conform to local zoning and building ordinances; and (D) The lot line adjustment is approved by the City. The City may impose conditions on the Lot Line Adjustment in order to make the lot conform to local zoning and building ordinances, to require the prepayment of real property taxes prior to the approval of the Lot Line Adjustment or to facilitate the relocation of existing infrastructure or easements. Section 3. The Planning Commission conducted a duly noticed public hearing to consider the application at a regular meeting on May 21, 2002 and at a field trip visit on May 28, 2002. Section 4. The Planning Commission finds that the project is categorically exempt from environmental review under the California Environmental Quality Act pursuant to a Class 5 exemption provided by Section 15305 of the State CEQA Guidelines. Section 5. The Planning Commission has considered the evidence, both written and oral, presented in connection with this application and finds as follows: A. Section 16.16.010(B) of the Rolling Hills Subdivision Ordinance and Section 17.16.060(A) of the Rolling Hills Zoning Ordinance requires that each lot in any subdivision in the RA-S-1 Zone shall have a net area of not less than forty-three thousand five hundred sixty square feet (1.0 acre). Both lots are located in the RA-S-1 Zone. The proposed lot line adjustment will result in Lot 5-CH to be 1.13 net acres and Lot 6-CH to be 1.78 net acres after excluding roadway easements. RES.O. Section 16.16.020 of the Rolling Hills Subdivision Ordinance and Section 17.16.060(B)(3) of the Rolling Hills Zoning Ordinance require that in all cases where practicable, the sidelines of lots shall be at approximate right angles or radial to the street upon which such lot fronts. The existing sidelines of both lots are approximately at right angles or radial to the street. The proposed adjustment will allow the northerly side lot line of Lot 6-CH to be moved in a southerly direction and, will remain perpendicular to Portuguese Bend Road. 02 2322077. C. Section 16.20.230 of the Rolling Hills Subdivision Ordinance requires that ten (10) foot wide easements be dedicated for bridle trail and utility purposes over the strips and portions of land within and abutting upon the sidelines and rear lines of each lot. The proposed adjustment will not require the relocation of existing easements and pursuant to Rolling Hills Community Association no new easements are required to be dedicated. D. Conditions have been attached to this approval which provide that the proposed adjustment will not impair or limit the City's application of the Site Plan Review Ordinance to any future development of Lot 5-CH or Lot 6-CH. Section 6. In accordance with the foregoing findings, a Conditional Certificate of Compliance for lot line adjustment sought in Zoning Case No 651 as indicated on the map attached hereto as Exhibit "A" is hereby approved as a Conditional Certificate of Compliance subject to the following conditions: A. The lot line adjustment shall not in any way constitute any representation that Lot 5-CH and Lot 6-CH can be redeveloped in compliance with current zoning and building ordinance standards although a single family residence exists on each lot. No development shall occur on the properties without first complying with all applicable City Building and Zoning requirements and other applicable rules and regulations. • B. The lot line adjustment shall not in any respect limit or impair the City's application of the Site Plan Review Ordinance or any other discretionary review to Lot 5-CH and Lot 6-CH at such time as an application is made for development. C. The lot line adjustment shall not in any respect waive, release or be construed to supersede any restriction, dedication or condition set forth in Record of Survey No. 57-36, dated August 1946, and all such matters are hereby reserved. D. The Certificate of Lot Line Adjustment shall not be issued until a legal description complying with the delineation of adjustment, are approved by the City. Upon the City's approval of the legal description, the Conditional Certificate of Compliance shall be issued by the City, shall be recorded by the property owner in the offices of the Los Angeles County Recorder, and evidence of the recordation shall be returned to the City.
