TIGER 7 ) Lot 20, Crest Hills (R.S.;57-36) ) 8 ) 9 10 FINDINGS AND FORMAL REPORT 11 The application of John E. Tiger, Lot 20, Crest Hills, 12 for a side yard variance came on for hearing on the twenty-third 13 day of July, 1963, at the hour of 8:00 P.M., at the City Hall of 14 the City of Rolling Hills, California, and the applicant having 15 submitted evidence in support of his application, and the Planning 16 17 Commission being advised, now makes its Findings and Formal Report 18 as required by the Ordinances of the City of Rolling Hills, 19 California. 20 I 21 The Commission finds that the applicant, John E. Tiger, 22 is the owner of that certain real property described as Lot 20 of 23 24 Crest Hills, located in the City of Rolling Hills, California, 25 and that notice of the public hearing in connection with said 26 application was given as required by Sections 8.06 and 8.07 of 27 Ordinance No. 33 of the City of Rolling Hills, California. 28 II. 29 That no person appeared at said public hearing in 30 opposition to the application for a variance and that no 31 32 evidence was received by the Commission in opposition thereto. 1 2 3 4 5 6 III.. The Commission further finds that the proposed swimming pool addition of applicant is to be located on the twenty-five (25) foot easement line, instead of the ten (10) feet from the easement as required by said Zoning Ordinance, and further finds that by reason of the twenty-five (25) foot width of said easement and by reason of the terrain of said 7 Lot 20, the variance should be granted to the applicant in 8 order to preserve substantial property rights possessed by 9 other property in the same vicinity and zone, and that the 10 granting of such variance will not be materially detrimental 11 to the public welfare or injurious to property or improvements 12 in such vicinityand zone in which applicant's property is 13 14 located, and that there are exceptional and extraordinary 15 circumstances and conditions by reason of physical location 16 and terrain of said Lot 20, which do not apply generally to 17 other property in the same vicinity and zone. 18 IV. 19 From the foregoing it is concluded that a variance 20 21 should be granted by the Planning Commission of the City of 22 Rolling Hills to John E.
