370, Addition & remodel of existing, Resolutions & Approval ConditionsRESOLUTION NO. 9;%-2 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ROLLING HILLS APPROVING A FRONT YARD SETBACK VARIANCE IN ZONING CASE NO. 370 THE PLANNING COMMISSION OF THE.CITY OF ROLLING HILLS DOES FIND AND RESOLVE AS FOLLOWS: Section 1. An application was duly filed by Mr. and Mrs. Alfred Visco for a minimum front yard setback variance for property located at 15 Cinchring Road (Lot 22-6-CH), Rolling Hills, California. The application seeks a variance to allow a portion of a proposed garage addition to be constructed in the front setback of the property. The proposed encroachment is 12' where a non -conforming encroachment of 17'.0" exists. Section 2. The Planning Commission opened the public hearing on September 20, 1988 and continued it to October 18, 1988. A duly noticed field trip was conducted on October 4, 1988, to which the applicant and all members of the public was invited. The Commission has considered the evidence, both written and oral, presented to it in connection with this application. Section 3. In accordance with Sections 17.32.010 through 17.32.030 of the Municipal Code, the City Council finds as follows: 1. The subject property is unique in that it has an existing garage on which the applicant intends to construct additional square footage (388 sq. ft.). This is an existing nonconforming garage which extends into the front setback. The variance involves construction of a structure in an area already occupied by a legal nonconforming building. Thus, the new construction will enhance the appearance of an existing structure in the same location. 2. Approval of the variance does not give to the applicant a special privilege because it merely allows him to construct a garage addition to an existing building where the proposed encroachment is less than an existing non -conforming encroachment. 3. The variance is necessary to the applicant's ability to enjoy his property to the same extent as other similar properties in the same zone. It will permit applicant to construct in .accordance with a design plan that makes sensible use of existing unique conditions. Section 4. In accordance with the foregoing findings, the variance sought in Zoning Case No. 370 is hereby approved.
