SUBJECT: CONSTRUCTION OF A WALL IN THE FRONT YARD SETBACK

City received complaints that a wall along the driveway was being constructed in both
cases (separate complaints). Upon investigation by Rafael Bernal and Yolanta Schwartz,
it was determined that the walls were not retaining walls, were less than 3 feet in height
and that they were in the front yard setback. No building permits would be required for
these walls.
Under current regulations, these walls would not be permitted, because they are
considered structures (permanent foundation) and are in the setbacks.
However, we will be proposing to amend this provision in the Code to allow walls,
retaining or other, along driveways/stairs in any setback, providing they do not exceed 3
feet in height or trigger grading.
This code amendment, together with other provisions, will be presented to the Planning
Commission at either the December 2003 or January 2004 meeting. It will take many
months to get the Code amended.
We called the property owners and informed them of our intention. We also told them
that they could, for now, keep the walls. However, should the PC or CC of approve that
particular code amendment to allow up to 3' walls in the setback alongstairs, then
we'll have the owners either remove the walls or apply for a Variance to the Planning
Commission.

Subject: Zoning Case No. 321
A letter was sent to you on September 18, 1985 advising of the
Planning Commission's approval of a Variance for construction of a
garage encroaching into the established front yard on Lot 19-5-CH
on September 17, 1985. The Planning Commission's action was reported
to the City Council at a regular meeting on Monday, October 14, 1985,
pursuant to Section 17.32.140 of the Municipal Code. Since no
action was taken by the Council regarding the approval, the decision
of the Planning Commission has been ratified by the City Council,
and the Variance for construction as shown on a plan submitted for
Zoning Case No. 321 is approved.
An acceptance form as required by Ordinance 207 is enclosed.
Please complete the form, ahve the signature notarized and forward
to the County Recorder's Office, Room 15, 227 North Broadway, Los
Angeles, CA.'90012 with a check in the amount of $7.00. When the
Affidavit of Acceptance, duly executed and recorded, has been
returned to the City the Los Angeles County Department of Building
and Safety will be notified that building permits can be issued.

on Lot 19-5-CH was approved by the Rolling Hills Planning Commission
on Tuesday, September 17, 1985, subject to conditions recommended by
Planning staff. This notice shall serve as a copy of the Planning
Commission's decision. A full report of the Commission as required
by the Municipal Code will be be contained in the minutes of the pro-
ceedings before the Commission.
The Planning Commission's decision will be reported to the City
Council at their regular meeting on Monday, October 14, 1985 at
7:30 p.m. in the Council Chambers of City Hall, pursuant to Section

Dear Sirs:
Today I am requesting an extension on the variance given
to me on my residence at 13 Cinchring Road.
The reason for my request is that over a year ago I
hired Ron Davis, Architect, South Bay Engineering and
American Geotechnical to do my work for me.As of
this date I still haven't been able to secure permits
to complete the work.
American Geotechnical, as an example, told me that if
I paid their fee (double the other fee I had been quoted)
they would get my permits in three weeks. Four months
and 28 unanswered callslater, I still did not have
my report but,I did have my driveway dug up and muddy
for four months.
Due to the many delays not caused on my part, I would
appreciate my request being honored.
