FINDINGS AND REPORT
The application of Mr. William Campbell, Lot 11-MR, Middle -
ridge Tract, for a conditional use permit under ARTICLE III, Section
3.06, Front Yard Requirements, Section 3.07, Side Yard Requirements
and ARTICLE V, Section 5.06, Ordinance No. 33 came on for hearing
on the 22nd day of August, 1978 in the. Council Chambers of the
Administration Building, 2 Portuguese Bend Road, Rolling Hills,
California, and the applicant, having submitted evidence in support
of the application, the Planning Commission, being advised, now
makes its Findings and Report as required by the Ordinances of the
City of Rolling Hills, California.
I.
The Commission finds that the applicant, Mr. William
Campbell, is the owner of that certain real property described as
Lot 11-MR, located at 3 Middleridge Lane North in the City of
Rolling Hills, and that notice of the public hearing in connection
with said application was given as required by Sections 8.06 and
8.07 of Ordinance No. 33 of the City of Rolling Hills, California.
The Commission finds that in a communication dated June 13, 1978,
signed by thirteen residents of Middleridge Lane North stated that
those residents had viewed the plans for the proposed addition and
had no objection to continuing the extension of the home into the
sideyards on both sides. In a letter dated July 17, 1978 Mr.
Robert Hatch, 5 Middleridge Lane North advised that he and his wife
considered the improvement to be beneficial to his property, recog-
nizing that the addition would increase the encroachment into the
easement between the properties, and he asked that in the event
the house was ever razed and there is an opportunity to rebuild, the
new plans be prepared so that the home would comply with Rolling
Hills requirements.
II.
The Commission finds that Mr. Campbell has requested a
conditional use permit for construction of a stable in the front
yard and for construction of residence additions which would extend
into the side yards on both sides of the residence, and which would
be an extension of an existing non -conforming condition. The Com-
mission finds that the conditional use permits should be granted
in order to preserve substantial property rights possessed by
other properties in the same vicinity and zone, and that the
granting of such conditional use permits would not be materially
detrimental to the public welfare nor injurious to property in the
same vicinity and zone.
III.
From the foregoing it is concluded that conditional use
permits should be granted to Mr. William Campbell for construction
of a stable in the front yard and for residence additions which would
extend into the side yard on both sides of the residence subject to
the following conditions:
1. That the permit shall not be effective for any purpose
until the owner of the property or his duly authorized
representative has filed with the City Clerk of the
City of Rolling Hills an affidavit stating that he is
aware of and accepts all conditions of the permit.
2. That it is declared to be the intent that if any pro-
vision of the grant is held or declared to be invalid,
the permit shall be void and the privileges granted
thereunder shall lapse.
3. That it is declared and made a condition of the grant
that if any condition thereof is violated, or if any
law, statute or ordinance is violated, the permit shall
be suspended, and the privileges granted thereunder
shall lapse, provided that the applicant has been given
written notice to cease such violation and has failed
to do so for a period of thirty (30) days.
4. That all requirements of the Zoning Ordinance and of
the specific zoning of the subject property must be
complied with unless otherwise set forth in the variance
or shown otherwise on the approved site plan.
5. That the barn structure be maintained not less than
five (5) feet from the road right-of-way.
6. This Conditional Use Permit shall be void unless used
within one year of the date of this grant.
7. Height of barn roof shall be limited to the elevation
of the existing roadway.
8. Road access paving to stable across bridle trail shall
be scored concrete or rough sanded slurry to provide
safety for horses to the satisfaction of the City staff.
9. The removal of all or any portion of the residence shall
cause provisions of this grant to lapse, and reestablish-
ment at that location shall be made only after appropriate
variances and permits are approved by the City of Rolling
Hills;
and it is, therefore, so ordered.
